Fixation of Pay Under Fundamental Rules FR 22 – Illustrations

  

10.1      Various provisions on pay fixation have undergone rationalisation and simplification during the 80’s. The fundamental rules on these issues have been rewritten accordingly in 1989, so as to consolidate the provisions at one place. The new version of FR 22 has substituted old FRs 22, 22-C, 30 and 31.

  

10.2      Fixation on First Appointment

  

The pay of the government servant on his first appointment to a post will be fixed at the minimum of the pay scale of that post.

  

10.3      Fixation of Pay on Promotion/Appointment to a higher post

  

(i) Clause (a) (1) of FR 22 (I) deals with fixation of pay of a government servant holding a non-tenure post on his appointment to another post involving assumption of higher duties and responsibilities. Such appointment may be in the normal channel of promotion or otherwise, provided the appointment or promotion is made on fulfillment of the eligibility conditions, as prescribed in the relevant Recruitment Rules.

  

(ii)Initial pay in the time-scale of the higher post is fixed at the stage next above the notional pay arrived at by increasing his pay in respect of the lower post held by him regularly by an increment at the stage at which such pay has accrued, or Rs.100/- only whichever is more.

  

Illustrations

  

(a) A government servant drawing pay of Rs. 7075/- w.e.f. 01.04.1996 in the pay scale of Rs. 5500-175-9000 is promoted on 01.09.1996 to a post in the pay scale of Rs. 6500-200-10500. His pay shall be fixed as given below:

  

Notional Pay = Rs. 7075
Add one notional increment = Rs. 175
Notional Pay = Rs. 7250

  

The stage above this pay in the higher pay-scale is Rs. 7300/-.
Thus the pay is fixed at Rs. 7300/-
Date of next increment (D.N.I.) = 01.09.1997.

(b) A government servant drawing pay of Rs. 2660/- in the pay scale of Rs. 2550-55-2660-60-3200 w.e.f. 01.02.1996 is promoted to a post in the pay scale of Rs. 2610-60-3150-65-3540 w.e.f. 16.03.1996.

  

Pay = Rs. 2660/-
Add one notional increment (Minimum Rs. 100/-) = Rs. 2760/-
Pay fixed at Next higher stage
in the new pay-scale = Rs. 2790/-
Date of Next Increment = 01.03.1997

10.4 Option for fixation of pay under above rule from the date of next increment in the lower grade

  

10.4.1      A government servant is required to exercise option within one month from the date of promotion/appointment, to have the pay fixed under the above rule from the date of promotion itself or from the date of accrual of next increment in the lower grade/post. In case he opts for the above rule from the date of next increment, his pay on promotion is fixed at a stage next above the pay in the lower grade/post. It is then refixed under the above formula from the date of accrual of next increment in the lower grade/post. Thus in the illustration (a) above, in case the government servant opts for pay fixation as per this rule from
the date of next increment, his pay shall be fixed as follows:

  

(a) On 01.09.1996 the pay of the government servant will be fixed in the higher scale at a stage next above Rs.7075/- i.e. Rs.7100/-

  

(b) On 01.04.1997 the pay will be refixed as follows:

  

Pay in the lower grade on 01.04.1997 = Rs.7250/-
Notional pay on adding one increment of Rs.175/- = Rs.7425/-
Pay to be fixed at next higher stage i.e. Rs.7500/-

Date of next increment (DNI) = 01.04.1998

  

10.4.2      Thus on comparing the position, it is seen that the government servant starts drawing pay of Rs.7500/- from an earlier date i.e. w.e.f. 01.04.1997, if he opts for pay fixation under the rule from date of next increment (01.04.1997), as against from 01.09.1997 under the previous option.

  

10.4.3      Option once exercised by the government servant will be final & cannot be changed. In case the government servant does not exercise the option within one
month of his promotion his pay has to be fixed in the scale of the promoted post at the stage above the notional pay arrived at by increasing the pay in the lower post by one increment.

  

10.4.4      This option is not admissible to the government servant who is appointed:
a) to an ex-cadre post on deputation basis.
b) to a post on ad-hoc basis.
c) to a post on direct recruitment basis.

  

10.4.5      However, if the ad-hoc promotion is followed by a regular appointment without break, the government servant can exercise option within one month from the date of such regular appointment and the option shall be admissible from the date of initial appointment/promotion. Thus, if he opts for fixation of his pay under this rule from the date of his next increment, his pay shall be re-fixed from initial date of appointment at a stage next above his pay in the lower-grade and
under this rule from the date of next increment.

  

10.4.6      For the purposes of pay-fixation, FR 22 III clarifies that an appointment to another post on the same scale of pay or on identical scale of pay does not involve the assumption of higher duties and responsibilities. In other cases, decision of the administrative head has to be obtained. In case the posts belong to different departments, the decision of the Government of India is to be obtained.

  

10.4.7      As already mentioned, the provisions contained in the previous paras are
applicable in case of appointment made to a higher post subject to fulfillment of eligibility conditions in the Recruitment Rules. In the case of appointment made without fulfilling the eligibility criteria, the pay is to be fixed under the above provisions and restricted under FR 35. Such appointment may be on promotion or otherwise.

  

Illustrations

  

10.5      Treatment of Special Pay for purpose of fixation of pay on promotion

  

When the special pay is granted for specific addition to duties or for arduous nature of work, the pay in the higher post is fixed with reference to pay drawn in the lower post and special pay does not count towards such pay. However, if the pay so fixed in the higher post happens to be less than the pay plus special pay being drawn in the lower post at the time of promotion, the difference is protected as personal pay subject to the following conditions:

  

i) It must be certified that but for his appointment to the other post, the government servant would have continued to draw special pay.
ii) The protection will only be for so long as the government servant could have continued to draw the special pay.
iii) The personal pay will be absorbed in subsequent increases of pay.

10.6      Fixation of Pay on appointment to another post not involving higher duties & responsibilities

  

Sub-clause (2) of FR 22 I deals with fixation of pay on appointment, from one post to another, when such an appointment does not involve assumption of higher duties and responsibilities. Pay is fixed at the same stage in the new-scale, as is being drawn in the earlier post on the date of such appointment. However, if there is no such stage in the new-scale, his pay will be fixed at the next higher stage. While in the earlier case his date of increment remains the same, in the latter case his date of next increment will be on the Ist of the month in which he completes 12 months of appointment to a new post.

  

Illustrations

  

(a) A government servant drawing pay of Rs.15000/- w.e.f. 01.07.1996 in the pay scale of Rs.12000-375-16500 is appointed to another post in the pay scale of Rs.14300-400-18300 from 01.02.1997. As there is no stage as Rs.15000/- in the new scale, his pay will be fixed at Rs.15100/- with the date of next increment as 01.02.1998.

  

On such appointment, the government servant has the option to come over to the new-scale from the date of his appointment to such post or from the date of his next increment in the earlier post.

  

(b) In the above case, if he opts to come over to the new pay-scale from the date of his next increment, his pay will be fixed as follows:

  

From 1.2.97 to 30.6.97 he will draw = Rs.15000/-

in earlier pay-scale
Pay on the date of next increment in the
lower pay-scale (01.07.1997) = Rs.15375/-
Pay to be fixed in the new scale = Rs.15500/-
(At the next higher stage there is no
stage as Rs. 15375/-)
Date of next increment = 01.07.1998

  

(c) A government servant drawing pay of Rs.5750/- w.e.f. 01.05.1996 in the scale of Rs.5000-150-8000 is appointed on his own request on 01.01.1997 to the post carrying the scale of Rs.4500-125-7000. His pay will be fixed at Rs.5750/- (same stage) in the lower pay scale, with D.N.I as 01.05.1997. In case he opts for the new pay-scale from date of next increment i.e. 01.05.1997 (in the old pay-scale), he will continue to draw Rs.5750/- in the old pay-scale till 30.04.1997. From 01.05.1997 his pay will be increased to Rs.5900/- in the pay-scale of Rs. 5000-150-8000. As there is no stage as Rs. 5900/- in the pay scale of Rs.4500-125-7000, his pay will be fixed at the next higher stage, i.e. Rs.6000/- and date of next increment shall be 01.05.1998. In the above case if the pay of government servant is Rs. 7400/- instead of
Rs.5750/- in the earlier post, his pay will be fixed at Rs. 7000/- only, i.e. the maximum of the pay-scale of the lower post [FR 22 I(a) 3].

  

10.7      Fixation of pay on appointment on deputation

  

10.7.1      An employee appointed on deputation/foreign service may elect to draw
either the pay in the scale of pay of deputation/foreign service post or his basic pay in the parent cadre plus deputation (duty) allowance thereon plus personal pay, if any. The borrowing authority should obtain the option of the employee within one month from the date of joining the ex-cadre post unless the employee has himself furnished the option.

  

10.7.2      The option once exercised shall be final. However, the employees may revise the option under the following circumstances which will be effective from the date of occurrence of the same:

  

(a) when he receives proforma promotion or is appointed to non-functional selection grade in his parent cadre;

  

(b) when he is reverted to a lower grade in his parent cadre;

  

(c) when the scale of pay of the parent post on the basis of which his emoluments are regulated during deputation/foreign service or of the ex-cadre post held by the employee on deputation/foreign service is revised either prospectively or from a retrospective date.

  

10.7.3      Based on the revised/same option of the employees, in the event of proforma promotion / appointment to non-functional selection grade, revision of scales of pay in the parent cadre, the pay of deputationists will be refixed with reference to the revised entitlement of pay in the parent cadre. However, if the initial option was for the pay scale of the deputation post and no change in option already exercised is envisaged, the pay already drawn in deputation post
will be protected if the pay refixed is less. If the pay of an employee in his cadre post undergoes downward revision, the pay in the ex-cadre post is also liable to be refixed on the basis of revised pay and in accordance with the revised option or existing option, if the employee does not revise his option.

  

10.8      Deputation (Duty) Allowance

  

10.8.1      The deputation (duty) allowance shall be admissible at the following rates:

  

(a) 5% of the employee’s basic pay, subject to a maximum of Rs.500/- p.m. when the deputation is within the same station.

(b) 10% of the employee’s basic pay, subject to a maximum of Rs.1000/- p.m. in all other cases.

  

10.8.2      The deputation (duty) allowance as above shall be further restricted as under:

  

(i) Pay plus Deputation (Duty) Allowance does not exceed the maximum of scale of pay of ex-cadre post;

  

(ii) In the case where pay scales are dissimilar, then pay plus deputation (duty) allowance plus DA/ADA/IR etc. does not exceed the pay at the maximum of ex-cadre post plus DA & IR etc. thereon.

  

(iii) Pay plus deputation (duty) allowance as above shall at no time exceed Rs.22400/- p.m.

  

Note: The term “same station” for this purpose will be determined with reference to the station where the person was on duty before proceeding on deputation.

  

Note: When there is no change in the headquarters with reference to the last post held, the deputation should be treated as within the same station and when there is change in headquarters it would be treated as not in the same station. So far as places falling within the same urban agglomeration of the old headquarters are concerned, they would be treated as transfer within the same station.

  

10.8.3      Special rates of deputation (duty) allowance may be admissible under separate orders in any particular area on account of the condition of living there being particularly arduous or unattractive. Where special rate is more favourable than that under what is mentioned above, employees deputed to the area will be given the benefit of the special rate.

  

10.8.4      Whenever extension of the period of deputation for the fifth year or the second year in excess of the period prescribed in the Recruitment Rules is granted, it would be on the specific understanding that the officer would not be entitled to draw deputation (duty) allowance. The officers who opted to draw pay in the scale of the ex-cadre post shall, however, continue to draw pay in that scale during the extended tenure also.

  

10.8.5      If any employee with the permission of the competent authority proceeds on deputation / foreign service from one ex-cadre post to another ex-cadre post in the same or another organization without reverting to his parent cadre, and if the second ex-cadre post is at the same station as the first ex-cadre post, then the rate of deputation (duty) allowance would remain unchanged.

  

10.8.6      In case where a person on deputation/foreign service is transferred by the borrowing authority from one station to another without any change in the post
held by him, the rate of deputation (duty) allowance will remain the same as was decided at the time of initial posting and will not undergo any change.

  

10.9      Admissibility of other allowances and benefits while on deputation/foreign service

  

10.9.1      Any project allowance admissible in a project area in the borrowing organization may be drawn in addition to deputation (duty) allowance.

  

10.9.2      Any special pay (now Special Allowance) granted to an employee in the parent department under FR 9 (25) or a corresponding rule of parent
organization should not be allowed in addition to deputation (duty) allowance. However, the borrowing department may allow in addition to deputation (duty) allowance under special circumstances any special pay attached to the post held by the employee in his/her parent department, by suitably restricting the deputation (duty) allowance. This will require the specific and prior approval of
Department of Personnel & Training.

  

10.9.3      In case special pay is attached to the scale of pay of the ex-cadre post and the employee has opted to draw pay also in that scale, in addition to his pay in
that scale, he will also be entitled to draw such special pay. However, such special pay will not be admissible if he has opted to draw grade pay plus deputation allowance.

  

10.9.4      Personal pay, if any, drawn by an employee in his parent department will continue to be admissible on deputation/foreign service, if he opts to draw grade
pay plus deputation allowance. No deputation allowance on this personal pay will, however, be admissible.

  

10.9.5      Increments: The employee will draw increment in the parent grade or in the grade attached to the deputation post, as the case may be, depending on whether he has opted for his own grade pay plus deputation (duty) allowance or the time-scale of the deputation post. If he has opted for time scale of the deputation post, notional increment shall also continue to accrue to him in the
post held on regular basis in parent cadre/organization for the purpose of regulation of pay on reversion back to parent post at the end of tenure.

  

10.9.6      (a) Such allowance as are not admissible to regular employees of corresponding status in the borrowing organization, shall not be admissible to the officer on deputation/foreign service, even if they were admissible in the parent organization.

  

(b) Following allowances will be regulated with mutual consent of
the lending and borrowing organizations:
(i) HRA/CCA.
(ii) Joining Time and Joining Time pay.
(iii) Travelling Allowances and Transfer T.A.
(iv) Children Education Allowance.
(v) LTC.

  

(c) Following allowance/facilities will be regulated in accordance
with the rules as explained against each:

  

(i)   Dearness Allowance : The employee shall be entitled to dearness allowance at the rates prevailing in the borrowing organization or in the lending organization depending on whether he has opted to draw pay in the time-scale of the ex-cadre
post or his own grade plus deputation (duty) allowance.

  

(ii)   Medical Facilities : This will be regulated in accordance with the rules of the
borrowing organization.

  

(iii)   Leave : An officer on deputation/foreign service shall be regulated by the Leave Rules of the parent organization. If, however, an employee proceeds from vacation
department to non-vacation department, or vice versa, he shall be governed by Leave Rules of the borrowing organization. At the time of reversion from the deputation post to the parent cadre, the borrowing organization may allow him/her leave not exceeding two months. The employee should apply for further leave to his cadre controlling authority.

    I “Dr. Awadhesh Kumar” have been selected through UPSC on direct interview basis and received the final appointment letter to the post of Geophysicist (Junior) in Geological Survey of India, Ministry of Mines in the pay scale Rs. 15600- 39100 plus grade pay Rs. 5400/-, vide letter no. 4142/SP/A-19011/2-AK/2008/19B dated 03.05.2010 and Initial posting is Geophysics division, Eastern region, Kolkata.
    Presently I am working with RITES Limited (Govt. of India Enterprise), under Ministry of Railways since 07.09.2005 as a Manager (Geophysics) in the field of Geophysics and pay scale is Rs. 24900-50500 in IDA scale. The gross salary is Rs.45623/- Plus 30% HRA (i.e. Rs. 55693/-).
    In view of the above , kindly give the advice as per rule, Protect my Pay Scale and count service period or not?.

    I was appointed in Govt. Dept. on 29-5-2010 against the vacancy 1995. The recruitment exams for the vacancy of 1995 and 1996 was conducted at a time. But it has clearly mentioned in my appointment letter that the candidates appointed against the vacancy 1995 should rank senior to the candidates of 1996. But till date I’m getting Pay and allowances less than the candidates of 1996. Even I am under the CNPS as my date of joining is 29-5-2004. But the candidates of 1996 joined before 01-01-2004, and that’s why they are enjoying Traditional Pension scheme of Central Govt.

    1) How far it is justified…..?

    My basic pay as in 1-1-2006 is fixed by multiplying 6700 by 1.86 plus grade pay of Rs.4200. wheras my junior,s pay was fixed at multiplying 6000 by 1.86 plus grade oay of rs.4200. he got promotion to a pre revised scale of 6500-10500 on 1-8-2006 (i.e to my scale)he got one increment on his pay. suddenly based on one circular dt 09/9/2009 which says the pre revised pay scale of 6500-10500 is up graded to 7450-11000 with a grade pay of rs 4600. now he got his pay fixed at 7450 multiplied by 1.86 from 1/8/2006 whereas my pay on 1/8/2006 is only 6700 * 1.86+ one increment ie rs.1500 less. He is my junior in the pre revised scale as well as his baisc is also less than mine. I want to know whether my pay also may be steppedup

    Iam permanent central govt employee joined pay scale 6500 -200-10500 on 22/03/2000 complted more than 9 years in one department and got selection to Group-A post in scale 15600-39000 direct entry through UPSC (applied through proper channel) as per notification and join GSI. Ministry of mine, I got pay protection simply fixed last pay drawn in previous organisation i.e 16290/- with grade pay 5400/- but not given 3% advance increment while re pay fixation.
    kindly clarify pay band upgradation by direct recruitment is treated as promotion or not.

    My wife joined as a Staff Nurse in a Delhi Government Hospital on 24/4/2000. After the implemention of 6th pay commission, the basic pay is fixed at Rs.10400 with grade pay of 4600/-. The scale of staff nurse upgraded from 5000-150-8000 to 7450-11599 with grade pay of Rs.4600/-. Her ACP is due from the month of April 2010.

    What could be the basic pay in case of upgradation and what will be the basic pay after getting ACP.

    One officer is appointed permanent central govt employee joined pay scale 6500 -200-10500 on 22/03/2000 complted more than 9 years in one department and got selection to Group-A post in scale 15600-39000 direct entry through UPSC (applied through proper channel) as per notification and join GSI. Ministry of mine, I got pay protection simply fixed last pay drawn in previous organisation i.e 16290/- with grade pay 5400/- but not given 3% advance increment while re pay fixation, weather it is correct or not please Email as soon as possible.

What will be the illustration of fixation. please inform me.

    Sir,
    One officer working in Central Autonomous body applied through proper channel in the Central Government against advertisement. He as working in Central Autonomous body in the PB-3 and GP 5400. Already one increment drawn in 2009 and another due in 2010.
    Before joining the central government he has rendered the technical resignation from ther service of central autonomous body and then laterly joined the central government department.
    When he joined the central government department they made his pay fix at the minimum of the PB 3 GP, 5400. only.
    They have not protected the pay till date saying that there is no rule explicitly mentioning that the employees working in central autonomous body when join central government should get the pay protection.
    They have not followed the existing GOI orders FRSR etc saying that is is for Government staff and central autonomous body is not a government .
    Can u clarify whether the concerned employee is entitled for joining time, joining time pay, pay protection Transfer TA etc. For what purpose his past service will be counted in central government department.

    JUNIOR SCIENTIFIC OFFICER (JSO) IN THE GRADE PAY OF Rs. 4800/-(PB-2, 9300-34800)

    With due respect, I would like to submit the followings for your consideration please.

    2 I have joined my deptt. under Min of Def. on 8th Feb 1999 as Chargeman in grade pay Rs. 4200/- (PB-2, 9300-34800) and subsequently was promoted through DPC as Foreman on 12th May 2009 in grade pay Rs. 4600/- (PB-2, 9300-34800).

    3 I am a Central Govt. employee in deptt. under MOD since 08th Feb 1999 and holding a regular post in a sustentative/permanent capacity in the same deptt. I had applied through proper channel to the higher post of Jr. Scientific Officer (JSO), published by UPSC in Employment News. I got appointed to the above post of JSO in the grade pay of Rs. 4800/- (PB-2, 9300-34800) through UPSC on 2nd Aug 2010 in my parent/same deptt.Before pay fixation to the post of JSO my basic pay in the lower post (as Foreman held by me) was Rs. 14640/- in grade pay Rs. 4600/-, which has already been crossed against direct entry pay of Rs. 13350/- in the grade pay Rs. 4800/- (PB-2, 9300-34800).

    4 In view of the above facts/my service conditions you are requested to please examine my case of pay fixation and give a necessary guideline/expert advise along with a suitable illustration specifically as per my pay fixation to me so that I may be able to get my correct pay fixation from our local CDA at the earliest please.

On 01-01-2011 i have appointed in another KVK which is under management of State Agricultural University. My basic pay in earlier KVK is 9650. I need your help to get my pay and service protection.     Dear Sir,
    I have the honour to call your attention to see the following facts submitted by me. I seek justified or apt suggestions for protecting pay and seniority.

    1. I have joined on 30.10.2000 in the pay scale of 4500-7000 (pre-revised) as JTA. One of my colleague has also joined on 26.11.2000 in the same scale and same post.

    2. Because of achieving higher qualification during the same period, my colleague got promoted to 5500-9000 after 3 years on 26.11.2003. As per 5th pay commission, he was promoted to STA 5500-9000 scale on 26.11.2003 while I was as JTA on 4500-7000 scale.

    3. On 30.10.2005, I got promoted to STA (pre-revised 5500-9000 scale) and my pay has been fixed as 5th pay commission.

    3. On 01.01.2006, our pay has been fixed as per recommendation of 6th CPC and my colleague was drawing higher basic pay than me as he was senior to me though with same GP 4200. Upto this period, this was not an anomaly.

    4. On promotion to next cadre after five year, I achieved Ph.d as higher qualification and became eligible for promotion after 3 years on 30.10.2008. I got promoted to TO (pre-revised 6500-10500) on 30.10.2008 with GP 4600. My colleague also got promoted to TO on 26.11.2008 to TO (pre-revised 6500-10500) with GP 4600. As far as my joining date is concerned, I have joined around one month before to him and getting all benefits per 5th pay commission recommendation. Now in the post of TO, with one additional increment and one higher GP, his basic pay has been fixed at around Rs. 1500 higher than my basic pay fixed. Though I am at par with my colleague with same GP 4600 at same level and I have joined the same organization one month before he joined, how my seniority can be protected or my salary can be fixed with salary of my colleague.

    With due respect, I seek suggestions how this issue can be resolved and my pay has to be fully protected.

Now in my pay fixation I have been denied both increments as on promotion/appointment to higher post (non gazetted to gazetted) and annual increment on 01-07-2011 saying that you have come with same GP, so you will be given only pay protection. further annual increment has also been denied on the basis that on joining in march 2011, i will not complete 6 month in new post on 01-07-2011. kindly clarify if it right or i am entile for a increment.

    if an employee who has worked more than 10 years in a state govt department and later on selected in Central Govt at higher position, would he be able to get his previous pay protected in the selected govt department if he has got all full and final payments from his previous department (includes gratuity and other pensionery benefits).

    Should his pay be protected if he has got all the money in previously served tenure.

    With due respect I would like to share my case with you. I have joined Central government job in CPWD on 29th April 2003 as Junior Engineer (Elect.) under the basic 5000-15-8000 subsiquently got permanent. To have better job prospect I had applied to Indian Oil Ltd. (Central PSU). No objection was obtained for the same. I resigned the CPWD on 30th July 2008 & joined IOCL on 06-08-2008 at the entry level basic of 12000/-. My total service in CPWD was 5 years & 3 month.

    As per the 6th pay revision my basic along with grade pay at the time of resignation was 16500/-. And i had joined IOCL at basic of 12000. Now my question is can I get my pay protection in PSU as I was getting higher basic.

    Also in PSU there was pay revision with effect from 1.1.2007. Here my basic was fixed after considering the 12000 basic. And no fitment benefit was given as I had joined after 1.1.2007. Now my question is will I get fitment as i was in service much earlier than 1.1.2007. There is no break in my service.

    Also let me know is there in procedure to transfer my GPF & gratuity from CPWD to PSU?

    I need your valuable guidence.

    I have appointed as security officer in EFL university Hyderabad on 17-08-2011 through proper channel under advertisement,direct selection process from AMPRI (CSIR) Bhopal.under ministry of science and technology government of India.I was working as security officer with pay scale 9300-34800 with grade pay of 4600.(from 31-0802005 to 17-08-2011)in AMPRI (csir)Bhopal. I wanted to relocate to my state (A.P.)Hyderabad. In a new appointment the preference was given for experienced personnel.In the new appointment as security officer 9300-34800 with grade pay of 4200 was offered & advertised, whereas there is no grade pay of 4200 existing for security officers in any of the universities of the UGC ,all security officers are appointed with 4600 grade pay.Since i was already drawing 4600 grade pay with my previous employer AMPRI (csir),Bhopal.In my interview it was also requested to the members that my pay may be protected as security officer with grade pay of 4600.Know i have been paid with grade pay of 4200 only.i have put up a application where they are no able to decide my case to protect my pay with grade pay of 4600.I am getting less than the pay compared to my last unit /organisation.
    My pay may be protected and my pay may be fixed accordingly.as a natural justice to me.

The college implement the 6th pay commission pay scale on the same date (1st june’2010). but as per 6th pay commission pay scale my pay fixed on the basis of Basic pay 11375/ rather Basic pay 12000/- and also my grade pay was fixed at 7000/ (for senior lecturer)instead of 8000/(for Asst. Prof.). My query is
    1) whether my pay fixation is proper or not.
    2) Whether Pay fixation and promotion is not applicable on the same date.
    3) And from where such official documents can I collect on website.
    4) Because I am loosing Rs.6000/- per month for such fixation.

    i have been working as electrical fitter HS II in scale of pay 4000-100-6000 snd was drawing a pay of 4800.- DNI november 1999 was appointed as chargeman II in the scale of pay 5000-150-8000on 23 mar 1999 to the post on direct recruitment basis after a competing exam conducted by department in the parent department I was allowed to exercise an option and my pay was fixed 5150,-wef november 1999 and DNI as november 2000. Now after 12 years It was informed that I was not eligible option as my appointment was on direct recruit ment basis. I was asked to refund the excess pay for the last 12 years.
    1) I want to know whether there is any relevant order clarify my fixation .

    I was initially appointed as stenographer on 01.12.2007 in High Court of M.P. in the pay scale of Rs.5500-9000 and after six CPC M.P. Government revised the scale to 9300-34800 GP 3600 PB-2 as per M.P. Government. In the year 2011 I applied through proper channel and got selected in Department of Atomic Energy, RRCAT, Indore as a stenographer Gr.II in the pay scale of Rs.9300-34800 GP 4200 PB-2. Now the problem is that what would be my salary, I was said that the pay will be protected now it is being said your GP in High Court was lower than the present and it seems to be a promotion. Kindly tell me what should I do in my case and give me guideline/expert advice. If possible kindly give me a calculation on the basis of which I can make a representation. My last pay in the month of Sept, 2011 in High Court was Basic : 11980 GP : 3600 and I joined new job in Oct 7, 2011 and after a lapse of 7 month I am still being paid on the basic of Rs.9300/-.

    With due respect i have to say that i was appointed Assistant Professor in IMS, BHU, Varanasi and joined from 21.06.2011 in pay band 3 with ( 15600-6000-39100). Prior to this i was working in IGIMS Patna as assistant professor in pay band 3 with(15600-6000-39100 with minimum basic pay 38000 due to band pay 30000 and AGP 8000). Salary structure of IGIMS is like AIIMS , New Delhi and it is an autonomous institute like AIIMS and governed by Bihar Govt. So i was getting a band pay of 30000 and grade pay 80000 leading to my basic salary 38000. In present posting i am on the same post of assistant professor in same pay band 3 (15600-6000-39100) but getting basic pay just 21600 as Band pay 15600 and grade pay 6000. I have joined in this position with NOC from previous employer alongwith experience certificate, character certificate, and last pay certificate..Should i able to get my last salary protected and if that possible..under which rules…Please clarify sir….and provide necessary guidelines with expert advice for my last pay protection.

Subsequently the same individual promoted to the grade from which he has been reverted.     I was on deputation in an organisation in position of Executive Engineer for a period of more than four years. My cadre post in my parental organisaton was Assistant Engineer. Before ending of deputation period, i was absorbed in borrowing organisation in the post of Executiv Engineer and I joined the borrowing organisation on 30th Decemeber 2009 as regulor cadre. During deputaion period my date of increement was on 1st of january, but after joining my date of increament has been shifted to 1st July 2010 without giving any benefit of one increament on my earlier pay. Pay ofice of borrowing organization’s plea is that term One Year Probation is mentioned in appointment letter while services was transferd from parental orgaization to borrowing organisation and all funds already have been transfered to borrowing organisation. Please clarify that the such act of pay office is justified or not.

    Regarding.
    Ref:- 1.DOT’s approval letter for deputation to TCIL vide No. 11-11/97-STG-IV dtd:3-11-1998.
    2. Ad hoc basis promotion order vide No.12/79/99/STG-I dtd.10-8-1999
    3. Regular basis promotion order vide No.412-25/2009-Pers.I dated: October 14th,2009.
    4. Addendum to order at Sl.No.3 vide order No. 412-24/2010-Pers.I dtd: 20th September, 2011.
    I am a retired DGM, BSNL, Coimbatore SSA. I am an affected person in Pro forma Promotion case. The history of the case is as mentioned below.
    1. I was deputed to TCIL, Government of India under taking company on A/N 31-12-1998 from the then DOT, Coimbatore SSA in the cadre of Sr.SDE after reverting from officiating DE on local arrangement basis, with the competent authority’s approval vide letter under reference No.1.
    ( volunteers had been called for by TCIL thro’ DOT.)
    2. During my deputation period, an ad hoc Promotion order on 10-8-1999 from TES Gr-B to STS Scale of ITS Gr-A for 298 officers was issued by DOT after conducting DPC vide letter under reference No.2. Above me 255 seniors and below me 42 juniors were promoted and all were joined in the new post as per this ad hoc promotion order except me as I was on deputation.

    3. From the date of joining as per this ad hoc promotion order dated 10-8-1999, all my seniors and juniors were working continuously without break till 13-10-2009.

    On my repatriation from TCIL on 4-10-2003, I was given 2nd ad hoc promotion on 17th Nov 2003 by conducting fresh DPC. And I joined in the new post as DE on 10-12-2003 and I got my 1ST TBP on 10-12-2007 as per promotion policy issued in Jan,2007.

    On 14-10-2009, BSNL had issued a regular promotion order vide letter under reference No.3. stating that all working executives in STS of ITS Gr-A on ad hoc basis are promoted on regular basis without break W.E.F 14-10-2009.While issuing this regular promotion order, the “pay fixation option clause” was inadvertently omitted in the order.

    Here, I would like to mention that there was no change in the position of my seniority in both the ad hoc promotion list and as well as in the regular promotion list.

    On 27-4-2010, I got DGM promotion on ad hoc basis and retired from service on 30-11-10.
    After retirement, based on my representation dtd 25-7-2011 by quoting the GIO 12,13 below FR22 and the instructions issued vide in G.I. Dept. of Pers. & Trg., O.M.No.13/2/2007-(Pay-I), dtd 10th Aug 2007 by referring to O.M.No.13/2/97-Estt.(Pay-I) dtd 12th dec 1997, BSNL has issued an addendum on 20-9-2011 to the regular promotion order dated 14th Sep,2009 with the inclusion of pay fixation option clause vide the letter under reference NO.4.
    Hence, the regular promotion order becomes complete in all respect w.e.f 20-9-2011 only. whereas, I have retired from service on 30-11-2010.
    Under the above circumstances, Now I would like to request you to clarify the following.
    1. Whether I am eligible for Pro Forma Promotion based on ad hoc promotion order dated 10-8-1999 itself or not under Next Below Rule.
    OR
    2. Now, after my retirement on 30-11-2010, Can I make the claim of Pro Forma Promotion w.e.f 10-8-1999 based on the regular promotion order dated 20-9-2011 which becomes complete in all respect after inclusion of Pay fixation option to the regular promotion order dated 14th Sep, 2009.

How to fixed his pay FR 22.

    I have recruited as a Postal assistant through sports quota in gujarat on 05.09.2004. subsequently i have selected as a tax Assistant in Revenue department through sports quota in gujarat. accordingly i have joined in the Revenue department on 27.01.2010. now as a tax assistant my gross salary is 19000. when i relieved as a postal assitant my gross salary was 20000. so How to fixed my pay FR 22.

    Sir i have been selected as a Dy.Superitendant of Police (Wireless) through MPSC(Maharashtra State Govt) Direct Recruitment not from Open competative Exam, presently i am working in BSNL (A Govt of India Enterprise) i.e PSU,as a Junior telecom officer having basic pay scale Rs.29120 and in IDA pay scale (20600-46500)and completed 11yrs service in BSNL,so my query is as i am switching over my job from BSNL to state Govt of Maharashtra in the Class 1 cadre as a Dy.SP in the pay scale of (Rs.15600+5400 grade pay)so after joining in state govt.shall i get the pay protection?cause presently i am drawing gross salary around Rs.56000 and if i join in state it will be Rs.41000.so is there any provision of pay protection while switching from CPSU to state Govt.? I have applied for the post Through Proper Channel.All intimations given to the parent Dept.

    One officer is appointed permanent central govt employee joined pay scale 6500 -200-10500 on 22/03/2000 complted more than 9 years in one department and got selection to Group-A post in scale 15600-39000 direct entry through UPSC (applied through proper channel) as per notification and join GSI. Ministry of mine, I got pay protection simply fixed last pay drawn in previous organisation i.e 16290/- with grade pay 5400/- but not given 3% advance increment while re pay fixation, weather it is correct or not please Email as soon as possible.

    Sir i joined esic medical college on 06/02/2012 from state govt autonoumous by selection process. i have applied through proper channel after obtaining NOC from my parent department. i was supposed to complete i,e 2 years on 22/02/2012 in my parent institute. i have passed all department exams in that period. My present institution forced me to join early as there was MCI inspection to start new medical college where i have to set up department for starting new medical college, i have applied for continuity and pay protection. But now these people asking for my probation completion certificate for pay protection which i cannot get my parent institute as iam lacking only 15 days for 2 years. i would have joined on 24/02/2012 which was last date to join esic. siir pls guide will get pay protection. My work was statisfactory and if would have worked till 22/02/2012 i could have got my probation compleletion . But i was forced to join early i was not knowing the above fact i resigned technically and joined for the benfit of esic

    I joined as a lecturer on 25.10.91 in a 2000/- to 3500/- scale
    Later Hon’ble gave order to receive UGC lecturer scale of a degree College lecturer with pay fixed as per rule and to get the arrears from the date of joining as per rule.Govt. also made affidavit to pay the arrears due and admissible.
    Kindly suggest the pay fixation rules and career advancement as per UGC guidelines. Since 5th and 6th pay fixation has passed in between, which rule is to be followed for Senior lecturer and Reader pay fixation. Since arrears will be given now, is it not pertinent to follow the latest pay fixation rules, while calculating arrears. Kindly suggest, if there is any references on this matter.

    I have been promoted from grade pay of Rs 4200/- to grade pay of Rs 4800/- (PB-2).For direct rectt. the basic pay is Rs 13350+4800. Since my basic in the lower grade is Rs 10560+4200 and had not yet cross Rs 13350, an option for pay fixation (i.e. on the date of next increment) is opted by me.
    What will be my basic pay in the upper grade (i.e. Rs 4800)?

    sir, An officer junior to me was having same basic pay as on 1/1/2006 on implementation of 6th pay commission but on getting the benefit of one increment as his dni was between feb06 to june06 (retd.on july06)his basic pay increased by one increment and so junior is getting more pay than me.Now can i write the dept. to give me one increment also to equalise my b.p.(superannuated on 28/2/2006.dni was May 2006)? thanks
