Subject: Posting of husband and wife at the same station.

In view of the utmost importance attached to the enhancement of women’s status in all walks of life and to enable them to lead a normal family life as also to ensure the education and welfare of the children, guidelines were issued by DOP&T in O.M No. 28034/7/86-Estt.(A) dated 3.4.86 and No.28034/2/97-Estt.(A) dated 12.6.97 for posting of husband and wife who are in Government service, at the same station. Department had on 23.8.2004 issued instructions to all Mins. / Deptts. to follow the above guidelines in letter and spirit.
  
2. In the context of the need to make concerted efforts to increase representation of women in Central Government jobs, these guidelines have been reviewed to see whether the instructions could be made mandatory. It has been decided that when both spouses are in same Central Service or working in same Deptt. and if posts are available, they may mandatorily be posted at the same station. It is also necessary to make the provisions at Paras 3(iv) and (vi) of the O.M. dated 3.4.86 stronger as it is not always necessary that the service to which the spouse with longer service belongs has adequate number of posts and posting to the nearest station by either of the Department may become necessary.
  
3. On the basis of the 6th CPC Report, Govt. servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age. On similar lines, provisions of O.M. dated 12.6.97 have been amended.
  
4. The onsolidated guidelines will now be as follows:
  
(i) Where the spouses belong to the same All India Service or two of the All India Services, namely lAS, IPS and Indian Forest Service (Group ‘A’);
        The spouse may be transferred to the same cadre by providing for a cadre transfer of one spouse to the Cadre of the other spouse, on the request of the member of service subject to the member of service not being posted under this process to his/her home cadre. Postings within the Cadre will, of course, fall within the purview of the State Govt.
  
(ii) Where one spouse belongs to one of the All India Services and the other spouse belongs’ to one of the Central Services:-
        The cadre controlling authority of the Central Service may post the officer to the station or if there is no post in that station, to the State where the other spouse belonging to the All India service is posted.
  
(iii) Where the spouses belong to the same Central Service:
        The Cadre controlling authority may post the spouses to the same station.
  
(iv) Where the spouse belongs to one Central Service and the other spouse belongs to another Central Service:-
        The spouse with the longer service at a station may apply to his/her appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station to the nearest station where the post exists. In case that authority, after consideration of the request, is not in a position to accede to the request, on the basis of non-availability of vacant post, the spouse with lesser service may apply to the appropriate cadre authority accordingly, and that authority will consider such requests for posting the said officer to the station or if there is no post in that station to the nearest station where the post exists.
  
(v) Where one spouse belongs to an All India Service and the other spouse belongs to a Public Sector Undertaking:
        The spouse employed under the Public Sector Undertaking may apply to the competent authority and said authority may post the said officer to the station, or if there is no post under the PSU in that station, to the State where the other spouse is posted.
  
(vi) Where one spouse belongs to a Central Service and the other spouse belongs to a PSU:-
        The spouse employed under the PSU ‘may apply to the competent authority and the said authority may post the officer to the station or if there is no post under the PSU in that station, to the station nearest to the station where the other spouse is posted. If, however, the request cannot be granted because the PSU has no post in the said station, then the spouse belonging to the Central Service may apply to the appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station, to the station nearest to the station where the spouse employed under PSU is posted.
  
(vii) Where one spouse is employed under the Central Govt. and the other spouse is employed under the state Govt.:-
        The spouse employed under the Central Govt. may apply to the competent authority and the competent authority may post the said officer to the station or if there is no post in that station to the State where the other spouse is posted.
  
(viii)         ”The husband & wife, if working in the same Department and if the required level of post is available, should invariably be posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age. This will not apply on appointment under the central Staffing Scheme. Where only wife is a Govt. servant, the above concessions would be applicable to the Govt. servant.
  
5.         Complaints are sometimes received that even if posts are available in the station of posting of the spouse, the administrative authorities do not accommodate the employees citing administrative reasons. In all such cases, the cadre controlling authority should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefor, may be communicated to the employee.
  
6.         Although, normal channels of representations/complaints redressal mechanism exist in the Min. / Deptts., added safeguards to prevent noncompliance may be provided by ensuring that the complaints against nonadherence to the instructions are be decided by the authorities at least one level above the authorities which took the original decision when they are below the level of secretary to the Govt. of India/Head of the PSU concerned and all such representations are considered and disposed off in time bound manner.

    I am a TAMIL NADU State Government employee. My husband is working in a PSU (Steel Authority of India Limited, JHARKHAND state). Since mine is a TAMIL NADU state service, I have requested SAIL Management for transfer of my husband from Jharkhand state to Tamilnadu state where SAIL offices are located at four cities viz. Chennai, Tiruchirappalli, Salem and Coimbatore. But no response from the management.

    Sir,
    I am a central government employee working in Bihar and my wife is state government employee working in Tamil Nadu. I have kits of less than 10 yrs old. As per the OM F.NO.28034/9/2009-Estt.(A)dt.30.09.2009, I can apply to my cadre controlling authority(Director General, New Delhi) for my transfer. The application should go through Head of the institiution(Director). I served more than one decade in the present office.My Director is not forwarding the application to my cadre controlling authority for the past 9 months or returning the application back to me which against the service rules. Please suggest me, what shall I do?

    I am a central government employee working in Tamilnadu and my wife is state government employee working in Tamil Nadu. Out of my 10 years service in Central Government, 7 years (i.e. from 1999 to 2006)worked in out of State. But now again I have been transferred to out of state. I have a kit of 10 yrs old. As per the OM F.NO.28034/9/2009-Estt.(A)dt.30.09.2009, Can I apply to my cadre controlling authority to retain me in tamilnadu state. Yours suggestions at the earliest please.

    My wife is working in Central Warehousing Corporation (A govt of India Undertaking) at CWC Moga-I Punjab as Junior Technical Assistant and I am working in SBI Alipore Kolkata as Manager. We have been married in the month of June 2009. Since then she has applied for her transfer to Kolkata.The CWC where she is working has about 30 offices in West Bengal and about 10 of them in Kolkata. She has been trying her level best since last 10-11 months for it but there is no result. The personnel department of CWC at Delhi is not paying any attention to her request. Please look in the matter Sir and guide me as the distance between Moga and Kolkata is 50 hrs. journey by Train.We are really facing a lot of problem

    i’m working in minestry of rural development govt.of india at present working in gujrat state.my wife also workin in minestry of labour govt.of india CBWE nagpur. menwhile she has been transfered from nagpur to mumbai before two monts.and til-date not joined. but she want to stey in same place.i have one daughter 3 year old.there is no other to look after her.and i have no father and mother.i ‘m also out of station in this situtaion may be possible for stay in nagpur.we are faceing a lot of problem and also suggest any govt.rule for this situtation. so kindly suggest me for the above same as early as possible.

    My wife is working in central government and was posted in ghaziabad.I am working in a multinational company in NOIDA. We have two small kids. Recently my wife has been transferred to a distant location.She pleaded the provisions of DOPT O.M No. 28034/7/86-Estt.(A) dated 3.4.86 as amended by OM 28034/2/97-Estt.(A) dated 12.6.97 but she was informed that the benifit of the OM is not applicable to her. We are facing lot of problem. We are not in a position to look after the kids properly.
    Please do reply whethe we are elegible for the benifit of the said OM.

My office has transferred me from out of station(rural village, since 27 yrs serviced many officials are in same station retained, but 12 yrs served my self transferred to other station.No adverse remarks in my case, I requested my SPOs/PMG for retention or posting in any office at Chickmagalur,but not agreed to retain or posting in same station.     Guidelines were issued by DOP&T in O.M No. 28034/7/86-Estt.(A) dated 3.4.86 and No.28034/2/97-Estt.(A) dated 12.6.97 for posting of husband and wife who are in Government service, at the same station. On Dated the 30th September, 2009 Govt. says that the husband & wife, if working in the same Department and if the required level of post is available, should invariably be posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age.
    In this prepective, kindly clarify:

    1. Whether the employer / CCA can deny to transfer his employee/cadre on the said issue on the basis of shortage of staff. If so, how long can he do this?

    2. If shortage of staff is the reality, then why Govt. Issue this type of orders which is hardly possible to carry?

    3. “Shortage of staff” is such a thing which is also tough to overcome. In this situation whether the REQUEST for transfer will not mature forever?

    As the case such that, I had applied along with this order to my competent authorities through proper channel once again. Simply without any reason they returned back my application. From last 1.5 yesrs only i am living with my family. Before that 7 years I worked in other states. Even though they were not accepted my case. When the Lord will come to the earth directly. What we want to do for accptance of this order. My family & childrens growth already affected more. It is not understood our departmental higher authorities. A order which was produced before 50 years about transfer of central govt employees after completion of 3 years which was still now copying by the officers, they didn’t considered the changes occured in the world after 50 years. Even in state govts are accepting these type of cases and giving relief to the wife and husband immediately. But central govt higher authorities still sleeping in many more cases. It is objectionable. It needs look of Honble President of India at the earliest otherwise nobody will considered.

    It needs to remove the word “may” wherever it is in the OM order. Instead of “may” need “must”. Then only the officers will consider this OM. Hence it is necessary to return back the OM to the same officer who was prepared. Otherwise it will not get any brightness to the families who are living seperately.

    In my department(CWC) there are 23 places for my same cadre. Only my wife is working in the state government. Others wife’s nobody working in government side. Due to the jealous, my case is not consider to retain me in the same place. The eudcated officers should be stand on “TRUTH” but nowdays nobody I seen. Due to seperation of wife&husband what they are getting. Also it is an order given by the LORD, Nobody should not seperate the wife & husband. In fact it is not known to my higher authorities. So that they were not retained me in the same place or within the state.
    Also I requested for nearer states also ie. AP, KA, KL etc., It was also not accpted. Striaght away they were transferred me to north.

    Not acceptable authorities are insisting that Womens should not study and acting simply against the “Womens education”. (or) The educated woman should not marry the educated man and vice versa. Not acceptable authorities are against the “Womens working”. Let us say. And they are implementing some other activities also.

    My wife is working in central government and was posted in Ahmedabad.I am also working in central government in anand in same department. But she is in Administrative Region office in ahmedabad and I am working in operative office at anand. Her job is not transferable in operative office. So may i apply for the post of operative office which is same department and same cadre. We are living with my old age mother and elder handicaed brother. But I am not in a position to look after the kids properly because of long distance from ahmedabad.

    Kindly give me the sollution which is applicable for me. kindly send ruling which is neccesary for me in the application for transfer in such casses.

    The Posting & transfer industry in India is very Flourishing its turnover is in crores .It is used to set personal scores ,ego satisfying weapon & punishment tool very rarely it is used because of administrative exigencies . It is a bitter & hidden truth also not all but very few single working Bossess/Collegues harbor grudges towards DICS (double income couple syndrome ) because of their double income they dont see & realise the pain ,pressure which the working couple faces especilly when they hv to raise kids & also fulfill other social responsibility

As i m working in Min. of Earth Science.Is it possible if i could get Child Care Leave of two Years at a stretch to take care of my children studing abroad.There is no clarification regading this in our Dept. Pleas guid me what can i do as i have already taken 4 years EOL.

    sir,
    we both were working in the same central government office at indore. my husband was officiating on the post of aao for more than a month, which was vacated due to retirement on superannuation. there was a clearcut resultant vacancy of aao. though my husband was seniormost he has been transferred to new delhi and one junior has been promoted to the same post. why such injustice has been done with me.Dopt orders are not applicable to all central government departments? please help me

    Dear Sir,
    I am working as Associate Professor in North-Eastern Hill University, Shillong. It is a central university. My wife is working as Assistant Professor in ICT Mumbai. It is a deemed university(earlier it was in Mumbai University). I want to transfer my job at analogous post in ICT, Mumbai. Is it comes under the government rule? Please help how to proceed?
