Sub: Regulation of Pension in the case of an employee appointed on immediate absorption basis in an Autonomous body (Pensionable service)

An employee having 17 years of service in a permanent capacity in a Cntral Governnment Autonomous body (Pensionable service), applied for a direct recruitment post under the Central Government service through proper channel. On selection, he submitted technical resignation from the Central Autonomous body and joined the Central Government service in August 1989 on immediate permanent absorption basis.

For the service under the Central Autonomous body, he was granted pro-rata pension and gratuity from the Pension Fund constituted and maintained by the Autonomous body. In accordance with the option available at that time, he drew 100 % lumpsum payment in lieu of pension. The employee is therefore not entitled to count the qualifying service under the Autonomous body as qualifying service under the Central Government for pension. On completion of 15 years, one-third of the pension was restored to him.

The officer has now completed 22 years of qualifying service under the Central Govenment service and is retiring. As per the latest orders, issued by the Government of India based on the recommendations of the Sixth Pay Commission Report, those who have completed 20 years of qualifying service is eligible for full pension at 50 % of the Average emoluments or the last pay + Grade Pay, which ever is higher.

Is he not eligible for the full pension from the Central Government Office as he has completed more than the minimum qualifying service of 20 years in the Central Government OR
Is there any specific orders/Rule for restricting it or linking it to the pension he was granted for the pension received from the Autonomous body ?
    Kindly enlighten.

I am Senior Section Officer(SSO)(7450-11500 RSRP97) In Railway accounts. I was promoted to SSO(A/Cs) from SO(A/Cs)(6500-10500) in Jan 2007 and my basic fixed on 7900/- in july 2007(on option). In Vth CPC SO and SSO have been merged in Grade pay Rs.4800/- w.e.f. order issued in sep 2008. Now my pay fixation have been made according to pay on 01.01.2006(basic 7100/- of SO) but fixation of promotion of SSO and the pay(basic 7900/- from July) have been ignored. Also all arrears have been calculated on lower basic resulting over payments due to new orders of merging of grade and posts9i.e. loss of around 24000/- and commulative loss of Rs.1500/- p.m. at present. Is any solution is available to recoup yhis financial loss.

    Sir,
Primary teacher’s pay has been upgraded from Rs 4500-7000 to Rs 6500-10500. I was drawing pre-revised pay of Rs 4750 on 31 Dec 2005. My pay in pay band 2 has been fixed at 9580 + GP of Rs 4200.
I feel that the pay in pay band should have been 6500 x 1.86 + GP 4600. Am I correct ????

    Sir,
With due respect I beg to draw your kind attention towards my pay fixation done by Head of Office, B.G.D.C., Patna survey of india. The fact related to this, is given below for reconsideration and favorable order please.
That I was appointed as T.T.T.’A’ on 11-07-2005. I had been under training of 400.80 course at IIS&M (STI), Hyderabad and classified as Surveyor w.e.f. 01-10-2007. I was posted to B.G.D.C., Patna on 02-07-2007.
Consequent to implementation of 6th CPC in August 2008. I was asked to give option for opting 6th CPC on prescribed form. It was also assured that beneficial option will be chosen for fixation of pay accordingly. I signed the option form without ticking any option and my pay was fixed on Rs.10670+ G.P. Rs.4200 in September 2008.
In June 2009 my pay was reduced to Rs. 9710+Grad Pay Rs. 4200 quoting FR 22(1)A(2) which is not applicable in my case. In other G.D.C. like Chattisgarh G.D.C,Tamil Nadu& Andman Nicobar G.D.C, Assam & Nagaland G.D.C, Kerela G.D.C, Survey Air & Delhi G.D.C, Orrisa G.D.C,Uttar Prades etc. the pay of my batch mates who were also classified as Surveyor w.e.f. 01-10-2007, were fixed on Rs. 10670+ Grade Pay Rs. 4200 in September 2008.It is also brought to your kind notice that they are still enjoying the pay fixed as above which is correct as par Rules (5) of CCS(Revised Pay) Rules 2008.
. This clears that 6th CPC were implementation w.e.f. their date of classification.
After reduction in my pay I had requested Addl. S.G., B.G.D.C.,Patna twice for reconsideration of my case and also requested to grant 6th CPC w.e.f. 01-10-2007(ie. date of classification) but no action is initiated stating that Rules 5 of CCS(Revised Pay) Rules 2008 is not applicable.
Since my appointment occurred on 11-07-2005 and I had already drawn higher pay ie. Rs. 5500 /- per month w.e.f 01-10-2007 before implementation of 6th CPC , I may kindly be granted 6th CPC w.e.f 01-10-2007.
Therefore, I request to you, the man of helm, to consider my case keeping in view the above facts and send a favorable suggesion on my email wxsingh@yahoo.com Without no faults of mine, I am being deprived from the benefit given to others.
    Thanking you,
    Yours faithfully
    (Akash Ranjan Singh)Surveyor.
