Why the AGENDA ITEMS FOR THE MEETING OF NATIONAL ANOMALY COMMITTEE does not contain the issue Merging of gradepay of LDC and UDC.

its a great thing that next meeting for anamolies is going on in july2012.Sir the meeting should also contain the agenda about those newly recruited employees who joined in service after 1st jan 2006.Those employees got their first increment in july2007 after 6 PC.i.e.after approx 18 months.So kindly consider this as one of the agenda of the meeting and oblige.

I had given the option for fixation of pay under 6th CPC w.e.f 01.01.2006 the office fixed my pay at the right stage in PB-I( Rs.6060+Rs.1900/-), but on the date of promotion (25.05.2007) again Fitment table was used and fixed my pay at Rs.8370/- + 2800/- (Rs.4500-7000/) . Now the mistakes has been detected and is being rectified under FR22-I(a)1 by allowing 3% NI with new grade pay Rs.2800/- which reduces my present pay upto large extent and also a huge amount is likely to be recovered.
Sir, in such circumtances, if office is rectifying its mistakes, may i not be allowed to correct my mistake i.e. to opt fresh option w.e.f 25.05.2007( date of promotion) so that no change in my present pay may occur
Agenda Item 33 to be discussed on 17th July,2012 as Circulated by AIRF. Senior promotee (say UDC promoted from Gangman/Khalasi of Railways as LDC and then as UDC) getting less pay than his junior UDC (who was directly recruited as LDC and after 15 years of stagnation given ACP benefit on promotion as UDC).Under the basic service law laid down under FR/SR, senior cannot draw less than his junior in the same grade & post. But overlooking this fundamental service law and without changing the same, by executive orders, such as DOPTOM No 35034/3/2008-Estt (D) dt. 9.9.2010 (clarification to Point 8 in the Annexure thereof), it was said that in this anamalous situation, the principles of FR/SR are inapplicable.Simply because some one joined and remained in the same deptt. and getting promotions is punished to someone who left some other deptt. and joined as direct LDC etc.What does this mean? Even the Supreme Court in same situation inCommissioner and Secretary to Government to Haryana and others Vs. Ram Sarup Ganda and others- 2007(2)SCT 476 has clearly ruled that senior promotee’s pay be made at par with his junior in the same post/grade and this is not implemented by DOPT. Even Honâble High Court of Punjab and Haryana at Chandigarh CWP No.12894 of 2010 on 23.07.10 in the case of UOI Vs. CAT, Chandigarh in the case filed by the affected departmental officers, has held so.But DOPT has not implementing in case of others, which is just a mockery of SC’s orders and entire judicial system being overlooked by executive without rhyme or reason causing extreme heartburn & demoralisation amongst promotee seniors. If details of cases filed are required, I shall furnish the same. This matter may be amicably got resolved with retrospective effect, when this anamoly due to 5th CPC was unresolved and many petitions in CATs/HCs across India have been filed.

Sixth Central Pay Commission has not addressed many issues pertaining to lower level employees seriously. Many fresh anomalies at lower level have been created instead of rectifying the existing ones. Officers, of the level of Director and above have been benefited from the pay commission. And at the bottom line, certain technical categories, especially teaching community has only been given the maximum benefit.
The difference is extremely high between Pay Band-3 and Pay Band-4. There should have been an intermediate Pay Band at the range of 28000-60000 which has deliberately been avoided for giving maximum benefit . At lower level the difference between two pay bands is only nominal. There are a number of Grade Pays at lower level with a difference of mere 100 rupees.

Min of Pay Band-2 - 9300(diff- 4100) Grade Pay- 4200, 4600,4800, 5400
Min of Pay Band-3 - 15600(diff- 6300) Grade Pay- 5400,6600,7600
Min of Pay Band-4 - 37400(diff: 21800) Grad Pay - 8700, 10000, 12000
Pay Band- 2 has been created after merging the pre-revised scales of 5000-8000, 5500-9000 and 6500-10500- and Pay Band-3 has been created after merging the pre-revised scales of 8000-13500 and 9000-13500. It is a visible anomaly that for arriving the minimum of the Pay Band-2 only the minimum of the lowest pre-revised scales merged (5000) has been taken (5000 x 1.74-later changed to 1.86) where as for arriving minimum of Pay Band-3 minimum of the highest pre-revised scales merged (9000 x 1.74) has been taken. Now the pre-revised scale of 6500-10500 has been taken out and merged with pre-revised scale of 7450-11500 and given the grade pay of 4600/-. However, minimum pay as fixed as per the existing fixation formula of employees in position as on 1.1.2006 is less than that of entry pay specified for direct recruits of grade pay of 4600/-. From all these things it appears that it is a deliberate attempt that the lower level employee never get any benefit even though their pre-revised scales have been upgraded.
Pay commission has not derived a separate fixation formula where merging of two or more scales has been taken place. Pay fixation in the revised scale is allowed to be done by pay drawn in the existing scale multiplied by 1.86 in all cases. In many cases the pay specified for corresponding grade pay for direct recruits is much higher than that of the pay fixed as per the fixation formula of existing employees. What the surprise is that such anomalies will not occur in the case of Pay Band-4 as the minimum of the Pay Band is much higher than that of multiplication factor of pay drawn in the existing scale by 1.86.
In many cases the clarificatory orders regarding pay fixation issued by the Department of Expenditure are also misleading and confusing. Method of calculation is not clear. Some examples are given below.
(i) For arriving the basic pay (pay in the pay band after including benefit of bunching) of Rs.6060/- for the upgraded post in pre-revised pay scale of Rs.3050-75-3950-80-4590 to Rs.3200-85-4900(Grade Pay: Rs.2000/-) at illustration 4A annexed to CCS(RP) Rules 2008.
(ii) For arriving the pay (pay in the pay band) of Rs.12540/- for Grade Pay Rs 4600/- as in First Schedule, Part-A Section II (Entry pay in the revised pay structure for Direct Recruits on or after 1.1.2006.
In the absence of a clear cut clarification regarding pay fixation consequent upon grant of revised pay structure of grade pay of Rs.4600/- in the pay band PB-2 to Assistants and PAs of CSS, AFHQ, Railway Board and MEA, pay fixation had become a big task which created a chain of anomalies. It was stated that for Assistants and PAs in position as on 1.1.2006 the pay was to be fixed according to the fitment table of the pre-revised scale of Rs.5500-9000 where as for Assistants and PAs promoted after 1.1.2006 the pay was to be fixed according to the fitment table of the pre-revised scale of Rs.7450-11500. When the pay structure(pre-revised scale) for Grade Pay Rs 4600/- is Rs.7450-11500, the question of taking pre-revised scale of Rs.5500-9000 did not arise. Subsequently the pay in respect of juniors was fixed in the pre-revised scale of 7450-11500 and seniors were granted the felicity of stepping up with juniors. This was not implemented uniformly in all Secretariat services and therefore, in certain depts. like AFHQ, the seniors had to forgo their one increment also.
From the above it is seen that at the outset the main anomaly is regarding pay fixation in the revised scale and as such the agenda items 01 to 07 are absolutely in the right direction to be settled.
A single solution to 90% of the anomalies is that the pay fixation is to be done with the multiplication of minimum of the upgraded pre-revised sale. This anomaly is serious in PB-1 & PB-2 only. Actions are summarized as under:-
(a) Pay scales of Rs. 5500 and Rs. 6500 have been merged and placed in the pre-revised scale of Rs.7450/- with 4600 grade pay(minimum pay= 7450 x 1.86=13860+4600=18460).
(b) This uniformity should be applicable in all cases with retrospective effect of 01-01-2006. If required, arrears payment can be dis-allowed in all such re-fixation.
Š In the case of promotion also, minimum pay is to be fixed at par with direct recruits of the respective grade.
