MACP JOINT COMMITTEE MEETING AND DECISIONS – CONFEDERATION OF CENTRAL GOVERNMENT EMPLOYEES & WORKERS

The joint Committee set up by the National Anomaly Committee to consider the MACP related issues met on 27th July, 2012.  The Staff Side was represented at the meeting by the following comrades:

The report prepared by the sub-committee after three rounds of discussions was reviewed at the meeting.  The points that came up for discussion and the decisions taken are as under:

Grant of MACP in the promotional hierarchy:  The Staff Side pointed out that the ACP which was in vogue till the advent of MACP had been on promotional hierarchy.  In the name of improvement of the scheme, the Government cannot unilaterally change it, especially when the concerned employees do not consider it as advantageous.  They suggested that the employees must be allowed to retain the ACP for the first two promotions and for the third promotion MACP can be extended.  However, the Official Side said that it would not be possible to have any hybrid scheme.  In fact, they added that the 6th CPC had suggested for two career progressions only and that too on grade pay hierarchy.  The govt. had improved upon and therefore it was not possible for them to agree for the suggestion of the Staff Side.  They also stated that the reason for bringing about grade pay hierarchy was to bring about uniformity in the scheme across the Departments as the promotional hierarchy varies from one department to another.  They declined to consider the suggestion for promotional hierarchy based MACP.

The Staff Side then pointed that in the last meeting of the Committee, the Official Side taking into account the difficulties and disadvantages experienced by the employees in many departments which were presented by the Staff Side had agreed to consider department wise/cadre wise options.  The Staff Side further pointed out that the suggestion of the Official Side would not go to resolve the issue.  They said that option must be provide for each individual employee to choose either the ACP or MACP whichever is beneficial to him as is provided in the CCS(RP) Rules.  The unilateral withdrawal of a benefit from an employee is not permissible.  They also stated that the Official Side has not pointed out the difficulties in agreeing to this proposal.  After some discussions, the Official Side said that they would re-examine the issue of individual option and will come up with their considered view at the next meeting of the NAC.

Counting 50% of service of the Temporary status/casual labourers for the purpose of MACP:  In the light of the discussion at the meeting, the Official Side agreed to examine the matter.

Treatment of employees selected under LDCE Scheme and GDCE Scheme:  The Official Side agreed to issue orders on the same lines as has been issued under the ACP Scheme.  The Staff Side stated that wherever examination is the criterion for promotion/fast track promotion, the service rendered by such employees in the lower post must be ignored and such promotion should be treated as appointment and the promotion scheme to commence from the date of such appointment.  This was not agreed to by the official side on the plea that such appointments are against promotion quota and therefore, they are to be considered as promotion only.  The Staff Side them pointed out that this issue had been the subject matter of judicial consideration before the Tribunal and the Tribunal has given the decision in favour of the employees.  The Official Side wanted a copy of the judgement to react to this.

Date of effect of the Scheme:  The Staff Side pointed out that the date of effect of MACP Scheme must be from 1.1.2006.  The analogy of the 5th CPC has no application as ACP was introduced after discussion with the Staff Side on a later date.  Since the Government issued the orders of the 6th CPC and the acceptance of the MACP with modification almost simultaneously, it should have been made effective from 1.1.2006.  They also pointed out that the MACP is not an allowance to be made application from 1.9.2008.  The Official Side pointed out that the benefit emanating from the MACP i.e. the third promotion was applicable to all existing employees who were in service after 1.9.2008.  The Staff Side demanded that the benefit has been denied to those who retired between 1.1.2006 and 30.8.2008.  The Official Side agreed to consider application of the new MACP with effect from 1.1.2006 for those who retired/died between 1.1.2006 and 30.8.2008.

Financial up-gradation under MACP in the case of staff who join another unit/organization on request.  It was agreed at  the last meeting that the services rendered in another recruiting unit/organization will be taken into account for counting service for promotion under MACP.  The Staff Side however, pointed out that in many cases, the employees are compelled to seek reversion in order to be transferred to another recruiting unit.  In their case, the promotion so earned at the present recruiting unit and which have been foregone is being counted as one promotion under MACP.  The Official Side agreed to look into this matter and issue necessary clarificatory orders.

Stepping up of pay of senior incumbent with the junior as a consequence of ACP/MACP.  The Official Side stated that in the light of the judgments delivered in the matter they will have the case looked into and necessary instructions issued.  They also stated that certain instructions in the matter has already been issued, copy of which will be made available to the Staff Side.         

The bench mark question for promotion under MACP.  The Official Side agreed to issue a clarificatory order stating that if the promotion is on seniority cum fitness basis, MACP will also be on seniority cum fitness basis.

                There had been no discussions on other points incorporated in the report.  The stand taken by the Official side in those matters remains unchanged.  You may kindly access the report from the website of the Department of Personnel along with the relevant orders.

    Sub: Appeal for grant of Grade Pay Rs. 4200/- om award of financial upgradation under MACPS to UDCs in place of Grade Pay Rs.2800/-.

    Respected Sir,

    I would like to bring following few lines to your kind notice for sympathetic consideration :

    1. I was appointed as Watchman in the scale of pay of Rs.196-232 on 23.6.1983.

    2. Subsequently, through Departmental examination I was promoted to the post of LDC w.e.f. 08.02.1991 in the scale of pay of Rs.950-1500.

    3. Further, I was promoted to the post of UDC w.e.f. 01.12.1995 through Departmental examination in the scale pay of Rs.1200-2040 which was revised to Rs.4000-100-6000 on implementation of 5th CPC recommendations. On implementation of 6th CPC recommendations my pay was fixed in the Pay Band (PB-1) Rs.5200-20,200 with Grade Pay Rs.2400/- w.e.f. 01.01.2006.

    4. After implementation of 6th CPC recommendations in terms of DoPT OM No.35034/3/2008-Estt(D) dated 19.5.2009 I have been awarded with Last financial upgradation under MACPS w.e.f. 01.9.2008 in the Grade Pay Rs.2800.

    5. In this connection, I would like to bring to your kind notice that UDCs who have been awarded financial upgradation under ACPS on implementation of 6th CPC recommendations their pay have been fixed in the Pay Band (PB-2) Rs.9300-34,800 with Grade Pay of Rs.4200/- w.e.f. 01.01.2006 whereas for those UDCs who have been upgraded under MACPS, they have been placed in the Grade Pay of rs.2800/-.

    6. As the UDCs who have awarded financial upgradation under ACPS and MACPS are shouldering the same responsibilities, it is felt that the UDCs who have awarded financial upgradetion under MACPS they should also been given Grad Pay Rs. 4200/- at with UDCs who have been granted financial upgradation under ACPS.

    6. I, therefore earnestly pray to you to kindly consider my appeal sympathetically and take up the matter suitably with the competent authority so that UDCs like me are granted Grade Pay Rs.4200/- on award of financial upgradation under MACPS instead of Rs.2800/-.

    For those central govt. employees who have awarded financial up-gradation from Rs.4600/- to next higher grade of Rs.4800/- with a meagre increase of Rs.200/- under MACPS after a long waiting of 10 years, it is felt that there is no meaning of Career progression for them at all.

    Please take up the matter suitably with the competent authority so that they are granted Grade Pay Rs.5400/- on award of financial up-gradation under MACPS instead of Rs.4800/-.

    Respected members of the Official & Staff Side of the NAC,

    Sirs,

    It can be evidently seen from the apprehensions expressed by the clerical staff regarding the financial consequencies being faced by them due to improper and unjustified implementation of the grade pay under the MACP Scheme. Grant of grade pay of Rs. 2800/- to the UDCs under the MACP is a serious anomaly and needs to be addressed expeditiously. There is absolutely no logic and justification to grant grade pay of Rs. 2800/- to the clerical staff who have completed 24 years of service, whereas under the erstwhile ACP Scheme, grade pay of Rs. 4200/- has been allowed on completion of 24 years of service. This financial deficit of Rs. 1400/- each month to the similarly placed staff is causing immense mental trauma and, therefore, needs to be reconciled immediately. The decision to extend the option to the clerical staff for selection of grade pay under the ACP/MACP is a fair and wise idea and should be implemented forthwith. It is my submission on behalf of the entire clerical staff to finalize the above decision and issue orders accordingly at the earliest please.

    Sir ,This is unacceptable : Because now only there exists a real non uniformity in the same office same department and inbetween the same post. There are two categories established in between the same level of employees . One group who got ACP in the promotional hierarchy before 31/08/2008 and subsequently availed the benefit of MACP also. Their superiority over their colleagues prevail intangibly. Comparably they crossed many years than their counterparts . .The other one is their deprived counterparts surrounded by uncertainty and isolated. Both had been selected by the same eligibility criteria by UPSC or SSC but only in different periods. Every staff in every government department is experiencing this embarrassed situation .Is then the same work enthusiasm has remain unaffectedly by this type of discrimination? No answer. Then how the above statement by the officers side would be correct? How could they ensure uniformity in the scheme across the Departments by bringing all benefitted and deprived categories under a dilapidated roof. Everyone should get what he deserves for a healthy administration. It may be given in the form of departmental promotion or by MACP under promotional hierarchy.The MACP should be an incentive or a booster to the staff to execute his own official function, as it is and not others.. An LDC deserves promotion only as UDC. A Nurse could not claim the pay scale of a computer programmer. Then why all the departments pay scale should be taken for consideration for career progression or financial benefit of entire employees having different work and different selection criteria. Even the Govt itself divided various categories of section officers ,Account officers, organized &unorganized, gazetted nongazetted and so many. They have differrent pay scales. Where the uniformity has gone? Imposing the different pay scales with a change of Rupees 50/- adopted by various department for various reasons in their hierarchy is not justified for awarding career progression common to all employees. Instead of revoking the given benefits the government should abolish the hurdles of unjustified pay scales in every departments .Instead of making grade pay common ,the pay scales and promotional hierarcy of all departments should be made common and this is the correct solution for the current problem.only this will bring back the happiness of the employees.

    Sir,
    I am a direct recruit Assistant since June 29, 1974. I was promoted as Section Officer in 1991. After completion of 24 years of service I was granted 2nd ACP in the pay scale of Rs.10,000-Rs.15,600 (Now PB-3 with a grade pay of Rs.6,600/-) with effect from 9.8.1999. I did not derive any benefit (notional or actual) from NFS which was introduced with effect from 03.10.2003, in which SOs with 4 years of service got pay scale of Rs.8,000-Rs.13,500. Hence, NFS is not applicable to me as I was drawing a higher pay (Rs.10,000/-) in a higher pay scale (Rs.10,000-Rs.15,600) from an earlier date (9.8.1999). Please confirm that I am eligible for 3rd MACP, effective from 01.09.2008, in the PB-3 of Rs.15,600-Rs.39,100 with a grade pay of Rs.7,600/- in terms of DOPT’s circular No.35034/3/2008-Estt.(D) dated 9.9.2010.     sir,

    I am an employee of Survey of India,I was recruited on 1984 as TTTB,I got Gde IV,Gde III and got Gde II in 1.1.92 by dept exam,I was fixed 4875/- on 5th cpc.Sir I would like to say that when the bench mark year will be fixed for my macp?
    another Q is, ignoring of transfer promotion will be treated as punishment for macp?

    Sirs,
    This is regarding promotional hierarchy under MACPS.
    To my understanding and wisdom, somewhere there is failure in presenting the case before the official. As for instance, Official side has declined the suggestion for promo hierarchy based MACP on the pretext that “the reason for bringing about grade pay hierarchy was to bring about uniformity in the scheme across the Departments as the promotional hierarchy varies from one department to another”. This is an absurd arguement by official side.
    B’coz, under ACPS, there was NO uniformity between various Deptts. Whereas with the intro of MACPS, there is NO uniformity within a same Deptt between same cadre rungs.
    Merely it is obviously an inane pretext by official side to deny the benefit of promo hierarchy to the employees. And, no was there to defend it effectively and meaningfully. If more justifications are required, we’re ready to explain. But who wud listen to it.
