LEAVE TRAVEL CONCESSION



LTC Encashment – Journey by air – LTC for Disabled Persons – IRCTC Package etc.,

Subject: Encashment of earned leave along with Leave Travel Concession while in service – 3rd June 2009

The undersinged is directed to refer to Rule 38-A of CCS (Leave Rules, 1972 regarding encashment of earned leave alongwith LTC while in service which says that Government servants are permitted to encash earned leave upto 10 days at the time of availing Leave Travel Concession subject to the condition that earned leave of at least an equivalent duration is also availed of by the Government servant simultaneously. This Department has been receiving a number of references from various faced by them as the facility of LTC is also admissible while availing Casual Leave.


2. The matter has been examined in this Department in consultation with the Ministry of Finance and it has now been decided to permit Government servants encashment of earned leave upto 10 days at the time of availing LTC without any linkage to the number of days and the nature of leave availed while proceeding on LTC.


3. These orders shall take effect from the date of issue.


4. Formal amendment to the provisions of CCS(Leave) Rules, 1972 are being issued separately.


Sub: Encashment of Leave on Average Pay (LAP) while availing Railway Passes / PTOs – 11th June, 2009

The Department of Personnel & Training (DOP&T), in consultation with the Ministry of Finance after examining references received from various Ministries/Departments citing practical problems faced by them as the facility of LTC is also admissible while availing causal leave, have issued instructions permitting Government Servants encashment of earned leave upto 10 days at the time of availing LTC without any linkage to the number of days and the nature of leave availed while proceeding on LTC.


2. The matter has been considered by the Board and in partial modification of the earlier instructions contained in letters of even number dated 29.10.2008 & 03.12.2008, it has been decided to permit Railway servants encashment of LAP upto 10 days without any linkage to the number of days and nature of leave availed at the time of availing Passes/PTOs.

3. These orders shall be effective from the date of issue of this letter.

4. Formal amendment to the Railway Services (Liberalised Leave) Rules, 1949, of the Indian Raiway Establishment Code Vol. I, 1985 Edition (Second Re-print Edition 2003) will be issued separately.

5. Please acknowedge receipt.

Subject:Regulation of Journey by air while availing Leave Travel Concession – clarification regarding – 27th July, 2009

The undersigned is directed to refer to Ministry of Finance,Department of Expenditure O.M.No. 19024/1/2009-E.IV dated 13/7/2009 modifying the O.M. No.7(2)/E.Coord/2005 dated 23rd November, 2005 and superseding of O.M.No. 19024/1/E.IV/2005 dated 24/3/2006. It has been decided by the Department of Expenditure that in all cases of air travel both domestic and international where the Government of India bears the cost of air passage, the officials concerned may travel only by air India. The matter whether these orders will apply in cases of LTC has been considered in consultation with Ministry of Finance, Department of expenditure and it is confirmed that these orders/conditions will apply in cases of LTC also.

2. This issues in consultation with Ministry of Finance (Department of Expenditure) vide their ID No. 39/DS(EG)/2009 dated 20/7/2009.

Subject:- Regulation of Journey by air while availing Leave Travel Concession – clarification regarding – 9th September, 2009

The undersigned is directed to refer to this Department’s O.M. of even No. dated 27.7.2009 on the above subject and to say that consequent to issue of Ministry of Finance, Department of Expenditure O.M.No. 7(1) E.Coord/2009 dated 7/9/2009 on expenditure management the reimbursement of the expenses on air travel while availing of the Leave Travel Concession by Government servants will be restricted to the cost of travel by the economy class, irrespective of entitlement, with
immediate effect.

Subject:- Use of own car / hired taxi on LTC journey on account of physical handicap – 28th October, 2009

The undersigned is directed to refer to this Department’s O.M. No. 3101114/2008-Estt(A)dated 23.9.2008 in which it was stipulated that LTC facility shall be admissible only in respect of journeys performed in vehicles operated by the Government or any corporation in the public sector run by the Central or State Government or a local body.

2. Instances have come to notice where Government servants on account of physical handicap/disability of self or dependant family members are unable to perform the LTC journey by the authorized modes of transport and are compelled to undertake the journey by own car or private taxi. Representations are being received to allow reimbursement in such cases. Matter has been examined in consultation with the Ministry of Finance, Department of Expenditure and it has been decided in relaxation of LTC Rules to authorize the Head of Department to allow use of own/hired taxi for LTC journey on account of disability of the Government servant or dependent family member after obtaining following papers/conditions to avoid misuse of such relaxation:-

(i) Medical Certificate from competent authority.

(ii) Undertaking from Government servant that journey in authorized mode is not feasible and he actually travelled by own car/hired taxi.

(iii) such claim should not be more than journey performed by the entitled class by rail/air by the shortest route.

Subject:- Encashment of earned leave alongwith LTC -Clarification – 24th November, 2009

The undersigned is directed to refer to DOP&T 0.M.No.310111412008-Estt.(A), dated 23rd September, 2008 allowing encashment of earned leave alongwith LTC and to say that various references are being received from MinistriesIDepartments with regard to the applicability of Rule 38-A of the CCS (Leave) Rules, 1972 to the Central Govt. employees. In this regard it is clarified that

(1) Central Govt. employees governed by CCS (Leave) Rules, 1972 who are entitled to LTC but opt for the facility of LTC provided to their spouses employed in PSUslCorporationlAutonomous Bodies etc. and

(2) Central Govt. employees governed by CCS (Leave) Rules, 1972 who are otherwise not entitled to LTC, on account of their spouse being employed in Indian Railways/National Airlines who are entitled to privilege passeslconcessional tickets are entitled to leave encashment while availing the LTC facility of their spouselprivilege passes/concessional tickets of their spouse on fulfillment of all the conditions as stipulated in Rule 38-A of the CCS (Leave) Rules, 1972 twice in a four years block of LTC.

Subject:- LTC to Central Government Employees -Travel by tour packages operated by IRCTC – 2nd December, 2009
The undersigned is directed to refer to DOP&T O.M. of even number dated 14.3.08, allowing tours by road conducted by the Indian Railway Catering and Tourism Corporation (IRCTC), a Government of India’s undertaking under the Min. of Railways for the purpose of reimbursement of LTC by Government servants on the lines of ITDCISTDC and to say that as the IRCTC is also offering tour packages involving air travel in the sectors like Delhi – Leh, Delhi – Srinagar, Jaipur -Goa, ChennailCalcutta – Port Blair etc., the question of allowing LTC packages of IRCTC, including the component of air travel has been examined in consultation with the Min. of Finance.


2. It has now been decided to allow the re-imbursement of air fare along with rail and road fare in the case of LTC journey ‘of Government servants in tours offered by IRCTC for reimbursement under LTC provided the IRCTC indicates and certifies the 3 components separately and booking of tickets is done by IRCTC fully complying with the instructions of Govt. of lndia issued from time to time in this regard such as journey by Air lndia under LTC 80 scheme in economy class without package benefits etc.

Subject- Sixth Central Pay Commission – Recommendations relating to LTC – Acceptance
of – 23rd September, 2008

Consequent upon the acceptance of the recommendations of Sixth Central Pay Commission, it has been decided to make necessary additions/changes in the CCS(LTC) Rules, 1988 as indicated below:-

Rule 4(d) Definition of Family:-
The parents and lor step parents (stepmother and stepfather)who are wholly dependent on the Government employees shall be included in the definition of family for the purpose of LTC, irrespective of whether they are residing with the Government employee or not.

The definition of dependency will be linked to the minimum family pension prescribed in Central Government and dearness relief thereon. The extant conditions in respect of other relations included in the family including married / divorced / abandoned / separated / widowed daughters shall continue without any change.

Rule 8 Types of LTC:-
Fresh recruits to Central Government may be are allowed to travel to their home town along with their families on three occasions in a block of four years and to any place in India on the fourth occasion. This facility shall be available to the Government officers only for the first two blocks of four years applicable after joining the Government for the first time. The blocks of 4 years shall apply with reference to the initial date of joining the Government even though the employee changes the job within Government subsequently. The existing blocks will remain the same but the entitlements of the new recruit will be different in the first eight years of service. All other provisions concerning frequency of travel under LTC are retained.


Rule 12 Entitlement:-
Travel entitlements, for the purpose of official tour/transfer or LTC, will be the same but no daily allowance shall be admissible for travel on LTC. Further, the facility shall be admissible only in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body. Air Journey by Private Airlines will however, continue to be admissible as per Ministry of Finance O.M. No. 19024/1/E-IV/2005 dated the 24th March, 2006 and in terms of the orders of DOPT in this regard..

Encashment of Earned Leave alongwith LTC Government officers are allowed to encash ten days earned leave at the time of availing of LTC to the extent of sixty days during the entire career. The leave encashed at the time of LTC will not be deducted from the maximum amount of earned leave encashable at the time of retirement. It is further clarified that where both husband and wife are Government servants, the present entitlement for availing LTC shall remain unchanged, and encashment of leave equal to 10 days at the time of availing of LTC will continue to be available to both, subject to a maximum of sixty days each during the career.


2. These changes are effective from 1st September, 2008.


3. The LTC claim pertaining to the period prior to 318t August, 2008 shall be regulated as per rules applicable on the date of journey and LTC claims already settled will not be re-opened.


4. In so far as persons working in the Indian Audit & Accounts Department are concerned, these orders are being issued in consultation with C & A.G. of India.

    Please clarify me that I had taken ltc for all india last year. I had performed my journey by shatbdhi exp than onward journey by rajdhani for the class of my entitlement. But my department refused to pay fair for the same and they only paid me the direct fair for the train. As we know that there is no such provision of direct tickets in shatbdhi & rajdhani trains so person cannot avail the faculty to travel by rajdhaniif it his posting station is not connected rajdhaniby

    I want to avail LTC from delhi to trivadrum by NACIL. my grade pay is 5400. NACIL inform me the one-way fare, i.e. rs 18639/- from delhi to trivandrum and i booked four tickets for my family. now my office is saying that they will reimburse me only rs 7505 for one ticket. my question is that when i had booked my travel tickets fron approved NACIL under LTCQ scheme why full fare is not reimbursed to me.kindly send me my entitlement fare with copies of recent regulations,amendements and rules applicable for availing LTC facility by the employees working under the grade pay of rs 5400.     my grade pay Rs.4200/-, I was availed irctc tour package from indore to char dham yatra and paid rs.13900/- per person for tour package, I apply for a certificate from irctc for ltc as per dopt instruction dated 26th march 2008. irctc sent to me a certificate amount Rs.4690/- per person in place of rs.13900/-, for which amount i claim for ltc.

    As per Swamy’s Handbook 2010 (Page289-290)’chapter 25-Miscellaneous’ under ‘Service Book’ Para 9 (ii) Permanet home address it is mentioned that” To be mentioned in Comumn 11 as declared in the Attestation Forms (This is different from Home Town Declaration under LTC Rules). Kindly clarify when, under specific provisions, the Home Town has been changed (allowed only once in total service period)that will mean for change of Home Town for LTC purposes or for permanent home town that was declared in the Atestation Forms.

    I join the Central Govt. on March 2006.
    I already availed the Two LTC (both hometown) for the block yr 2006-2009. one in Oct 2008 and second in Aug 2009.

    Now I want to avail the third LTC (block year 2006-2009)(Anywhere in India) as per the saying in
    “DOPT’s Office Memorandum F.No. 31011/4/2008-Estt.(A) – Subject- Sixth Central Pay Commission – Recommendations relating to LTC – Acceptance of – 23rd September, 2008″

    Please clarify about it.

    My wife is working in National Horticulture Board, Ministry of Agriculture, GOI, Gurgaon. Her organization is an autonomous body but follows the rules of Govt. of India.

    I wanted to confirm the rules position in respect of Leave Encashment during LTC in case the wife is working in a Govt. of India office while the husband is working in a Pvt. Company and claiming LTC facility from his company. Is she eligible to claim Leave Encashment facility during LTC, kindly confirm.

    I am planning to avail LTC (any where in India) for 2006-09 from Bangalore to Rishikesh via Delhi, Haridwar. I am entitled to travel by air. I have booked LTC air tickets by Air India through one of Bangalore’s flight booking agents M/S Balmer Lawrie & Co Ltd. (return ticket between Bangalore and Delhi). The ticket shows that it is under LTCQ (instead of LTC 80). When enquired with agents, it was told that some sectors will have have a mention as LTC 80 in the tickets, where as some will have it as LTCQ. But our Organisation people are telling that they have received a recent clarification saying that LTC 80 only should be allowed for LTC purpose. Kindly clarify.
