Confederation General Secretary informs that the next Meeting of the National Anomaly Committee will be likely held on 27.03.2010.


Many issues including Increment to those employees whose date of increment is between february and june and Stepping up of pay of senior officials on par with the pay of higher pay granted to new recruits on or after 1.1.2006 etc will again come up for discussion in the said meeting.

    NAC is going to hold meeting on27/3/10
    i am a retired JA grade officer from S.C.RLY in 2002.
    as you are aware though JA/SG grade officers perform same duties/ hold same posts SG grade officers are placed in PB4 whre as JA grade officers are placed in PB3 CREATING LOT OF HEARTBURN to allJA grade working &retired officers.this has been represented already as anomaly.
    please DISCUSS this item.

III stenographer whether they will die or alive. If it is discuss to let them live then please accept the 6 CPC recommendation and upgrade them to a clear place. Plase let us live!!!! Kindly do not humiliate us. ——from all Gr.III Stenographers and their familiy.

    The upgradation of grade pay of LDCs will be made or they will be equated with Group-D staff, either of the cases should be finalised. At least the the LDCs will be loiter here and there in the Office without any responsibility if the later is done.

    since Assistants/PAs have been given Grade Pay of Rs.4600/, the difference in grade pay between Assistants/PAs and SOs/PSs is narrowed down to just Rs.200/-. please discuss grant of grade pay Rs.5400 to SOs/PSs from the date of promotion and this benefit must be given to those who have been given financial upgradation under MACPS.

    Please consider the MACP, it should be given in the hierarchy of post (as in the case of 5 cpc) and not in hierarchy of grade pay. Those who are in PB-I (LDC, UDC, Steno D/Steno III) are the most sufferers under MACP.

    The next NATIONAL ANOMALY COMMITTEE is going to sit in the month of June, I personalty request to Sec. kindly discuss UMF at par PB-4, and 12k in pb-4 or reduce the lower limit of pb-4 grade pay so that difference in 12000 and 14000, scales in 5th CPC justified. It is further requested that we are gout. employees and cannot represent directly, so we fully depend on JCM/unions mercy.

    E-Research Institutions in INDIA, (CSIR, ICMR, ICAR, DRDO and other S&T departments)

    Research scientists and technologists in the Scientific institutions are treated at par with the teachers of the Diploma holders in Polytechnics this needs attention of the government. The following suggestions are made,

    1. The PB-3 research staff, after 3 years is placed in PB-4.

    2. The 5th cpc pre-revised scale 12000-18000 be placed in PB-4 or reduce the starting scales from Rs. 37400 to 30000 keeping in view of the less multiplying factor(1.86) up-to pre-revised S-3 scale.

    3. The variable increment stipulated under Rule 9 be reviewed and extended 4% to all categories without restricting to 20% of the total strength.

    4. The Research staff (Scientific and Technical) includes, Qualifications like, Medical, Engineering, computer science, bio-informatics; humanities (MBA), social- sciences, life science, basic sciences, and library science etc. were appointed on following grades.

    A. RGP= 6600 for Jr. Scientist/Jr. Technical Officer, (PB-3)
    B. RGP=7600 for, Sc. /TO, (PB-3)
    C. RGP=8900 for Sr. Sc. / TO, (PB-4)
    D. RGP=10,000, Asst. Directors/principal sc./TO (PB-4)
    5. The Scientific Administrators/ Executive Scientist, should be placed in higher grades at par with GP12000 and HAG as they are responsible for high quality of innovations/research and guidance as eminent research scientists, at the level of Dy. Director and Directors of different scientific Institutions.
    We hope that confederation in next meeting, consider the demands of scientific community positively and put our demand asymptotically before the competent authority and do some thing in the benefits of research cadre in INDIA.

    Respected Chairman, Member-Secretary and Members of the Anomaly Committee,

    Sir,

    Please discuss the MACP scheme in detail and the consequences on its implementation in the forthcoming NAC meeting. Please note that there is no future for grade III Stenographers who are stagnated for many years. We were of the hope that at least we will be upgraded to the grade pay attached to PA post (Hierarchy of the post). But, now the situation is too worst and was a shock to note that we will be given grade pay of Rs.2800/- (hierarchy of grade pay). Sir, Please understand that the promotional avenues are very meagre for us as we will be promoted only on retirement of our seniors, which is too far (in our Directorate my senior would be retiring in the year 2026). Till then what would be my fate????????.

    Hence, it is earnestly requested to analyse such issues and see that the new MACP scheme is on par with the ACP given by 5th CPM. (Upgradation should be given in the hierarchy of the post and not in the hierarcy of the grade pay). Please consider it.

    Dear anomaly committee members, We the superintendents of CPWD is in peculiar situation. The 6 CPC turned down the request of parity with the Section officers of CSCS although the duties and responsibilities are identitical with respect to the Manual on Office procedure of DOPT 12th edition. The CPWD Manual Vol.I is also specifying the same duties and respnsibilities as written the Manual on office procedure of CSCS Staff. Further, the superintendent Gr.II who drawn a pay scale of Rs.5500-175-9000 are now being merged with the Head Clerk who was drawn Rs.5000-150-8000.

    Further, al though the 6th CPC recommended the merger of superintendent Gr.I ( gazetted drawing 6500-200-10500) with the Superintendent Gr.II (non gaZetted drawing 5500-175-9000) the finance ministry not accepting the same. Our department has rightly put up the case to the ministry but the cabinet has turned down the same without any justification. The govt. order is clearly says that the respective ministry can take up the issues in the case of 5500-175-9000 for granting higher grade pay. The labour ministry has rightly upgraded the scale of 55000-175-9000 whereas we are loosing. The pondicherry govt. has rightly merged the superintendent Gr.I and II even before the 6 cpc recommendations. Even this argument is also rejected by the ministry on the ground that the nature of work differs whereas in CPWD both the Gr.I and Gr.II are doing the same work and there is no differentiation. Even if there is differentiation why the department post the officials in place of Gr.I supdt and expect the gr.II superintendent to do all works hitherto done by the Gr.I supdt.

    The govt is contemplating to grant higher grade pay for UDCs who have rendered more than 5 years and the finance ministry has recommended the DOPT to look into this matter on the ground that the CSCS staff is in disadvantageous position. It is against the spirit of the recommendations of the 6 CPC as the the 6 CPC rightly conceeded the parity of field offices with that of HQrs. The UDCs of CSCS is getting promotion to 7450-11500 straightaway whereas the UDCs never reach the position and at the most they can reach only 6500-200-10500. is not discriminatory. Why the disparity when all are equal.

    I request the NAC members to kindly look into the plea of Superintendents of CPWD and grant 4800 to all the superintendents similar to that of section officer and 4600 to Head clerk.

    (OT Technician and other Lab Technicians who generally 10+2 and 1 or 2 Years Diploma, and Graduate Technicians are not provided with corresponding incentives.Please rectify the anomaly and place us at least parity to Nurses.)

    there is mention about central government employees performing special duty such as teachers, nurses etc. whose payment should be increased substantially with the 6th CPC recommendation.

    the 6th cpc also mentioned about constabulary as performing special nature of duty. who are they?

    i am a nuclear installation security officer. do i come under “constabulary” keeping in mind the nature of job that i am performing?

    I am working in one of the Army Medical Unit as UDC. I am entrusted with the entire administrative tasks assisted by one erstwhile Gp `D’ staff. These erstwhile Gp `D’ staff is helping me in mail entry/sorting and dispatching only and he is having a little knowledge of English. My boss is an Army doctor and the entire responsibility of personal management of erstwhile Gp `D’ staff ,administrative tasks of other Gp `C’ staff and officer`s correspondences and their documentation lies on me. Since I am the sole administrative staff, I have to perform the tasks of Accounts management/book keeping both public and unit funds, cashbook maintenance,, record management, service book maintenance, preparation and submission of pay bills/claiming other pay related claims, TADA Claims, Stores Management etc and general routine office correspondences.
    My responsibilities are enormous, it is regretted to inform you that Govt has not recognized our services and placed in the Grade pay of Rs.1900 for LDCs and Rs.2400/- for UDCs. My case is not an isolated one. There are many hundreds of LDCs/UDCs in the small units of Army itself. We are bearing the maximum responsibilities and are now equated with the Gp `D’ employees. Earlier I had a little respect from the Gp `D’ employees of my office. After the implementation of 6th CPC and the MACPS even that is also lost. My assistant is now demanding table and chair better than me to do his work. I can understand the Government`s intention is to bring equality in the pay structure of Government employees and to reduce the disparity between high and low grade as practiced in the developed nations. It is a welcoming trend, but when they are trying to satisfy the up-liftments of other categories without any functional disturbances why, LDCs/UDC is deprived from such upgradations. I could recollect news which came in one of the leading news paper that the finance commission has agreed higher scales for LDCs/UDCs but the finance ministry has turned down the proposal stating that it entails huge financial implications to the Government exchequer. From the foregoing now I have a doubt in my mind that the Government has not recognized us Indian citizens for whom equality and Directive principles of the state policy is not applicable

    I am working as L.D.C. since last 10 years.Here, Promotional Opportunity is very less and MACP is the only way for upgradation. Grade Pay of a LDC is only Rs. 1900/- and after servicing 10 years he will be enhanced only Rs. 100/-, which is not only surprising but also pathetic. I REQUEST YOU TO KINLDY JUSTIFY LDC & UDC.We ARE GETTING LOW PAY in the 5TH & 6TH PC WHERE NOT GIVEN JUSTIFICATION POSITEVELY FOR LDC & UDC. We respect the Government view that Gr-D should be upgraded but please upgrade the present LDC’s who are appointed on that grade. Most of the people working in LDC’s are graduates and clear the Staff Selection Commission Exam. Now we are degraded by depromoting to Gr-D staff.     The benefit of the MACPS has not yet strightway been recommended for the autonomous bodies, which may be done without any further delay. Secondly, the policies of the M
    MACPS have created a lot of discrepancy amongst same cadre in many offices. Therefore, either it should be made optional either to go for ACP or MACPS at any point of time finding which one is beneficiary to the concerned employee or the financial upgradation shall be as per
    promotional hierarchy instead of the next immediate
    higher grade pay. It may please be noted that though the
    Govt. has allowed 6th CPC with effect from 1.1.2006 but MACPS has been made effective with effect from 1.9.2008
    which perhaps contradicts each other.

    I agree with Sri S. Banerjee. Further, the differences work pattern of LDC and Gr.- D are as follows :- 1. Min. Qualification of LDC :- H.S.(10 + 2)as per DOPT Order of 2009 whereas no such qualification required for Gr.-D , 2.Work Nature :- All admistrative, accounts, Store, Computer, typing, report and all responsible job available in this Office have to be performed by LDC, whereas no such responsibilities for Gr.-D. But, unfortunately differences between Grade Pay is only Rs. 100/- !!!!!!!!!! Perhaps Govt. try to make LDC as Gr.- D. Therefore, it is highly requested to bring the matter positively and seriously in Annomoly Committee for some result for which we are waiting for a long time.

    Sir, steno cadre earlier basic 4000 pay scale
    if someone recruited in Gr.III(Now Gr.II) it is OK. they will get gp 2400. In the case of old scale Gr.II, 5000, there is no direct recruitee. How to find out Junior-Senior in the smae rank for stepping up.

    I am working as a Junior Reception Officer in MHA which has traditionally equivalent to the Post of UDC, the next grade i.e Sr Reception Officer is equivalent to Asstt and Supervisors to that of a Section Officer. It is presumed that the grade pay of UDCs are likely to be revised. My humble request to you is that the grade pay of all personnel equivalent to UDCs should be revised, otherwise, there will be more heartburn among other cadres.

    All the personnel in the grade and equivalent to UDCs will remin ever grateful to if you take our case in the next NAC.

    This MACP – II orders made huge difference in same cadre within marginal gap of seniority also and the facilities are blocked for me, as it mentioned for Grade pay Rs. 4800/- & Rs. 5400/- after completion of 20 & 30 years. For example, a Junior Engineer of CWC under earlier ACP will go up to the revised Pay Band-3 with Grade Pay of Rs. 6600/- on completion of 30 years of service, whereas under the MACP Scheme, after 30 years of service and getting MACP – III, I shall get the Grade Pay of Rs. 5400/- only in PB-2.

    Sub: Anomalies in the pensionary benefits payable to section of employees absorbed in Autonomous bodies / PSUs etc— Reg.

    I was working as AAO in Postal Accounts office, Chennai. I had 23 years service in Postal Department. Then I took appointment in ESI Corporation in 1998. I have further service of 14.5 years in ESIC. I opted for pensionary benefits for the combined service under the Central Government and Employees State Insurance Corporation as per the pension rules of Government of India at that time. I am likely to get only DCRG and full pension after retirement from ESIC.

    When a Government servant is absorbed in an Autonomous body / PSUs etc, he will have
    an option (a) to receive pro rata retirement pensionary benefits or (b) continue to have the pensionary benefit of combined service under the Government and in the Autonomous Body. Under the option (a), 100% commutation of pension was paid up to 1995 if opted for it. Such employee was not entitled to get anything from his parent department there after. This option
    shall be exercised within six months. Since I desired full pension, I opted (b) for combined pensionary benefits. My friends opted (a) i.e pro rata pension. The pensionary benefits, due for my 23 years service,was paid by Postal Department to Employees State Insurance Corporation for counting my service in order to provide combined service pension after retirement.

    Thereafter, the various pension rules amended subsequently have extended additional benefits such as restoration of 1/3 rd commuted pension to the employees opted for lump sum payment on absorption. Others are drawing monthly pension. Dearness Relief on pension is also given from 1999 onwards. The sixth central pay commission has granted full pension for 20 years service which is more beneficial to absorbed employees opted pro-rata pension. Thus attractive pensionary benefits are extended to the employees opted (a) whereas the employees opted (b) for combined pension are fully ignored, discriminated and denied such benefits.

    I want to submit that the parent department is gaining by not restoring / paying 1/3 commuted value of pension with DA monthly and Employees State Insurance Corporation is benefited by receipt of undue pensionary benefits from parent department whereas I am discriminated by virtue of the option exercised at the time of absorption based on the pension rules of those days. My colleagues are enjoying additional pensionary benefits since they have opted for pro rata pension. Since the option given at the time of absorption is null and void and meaningless on account of attractive benefits granted to one section of employees discriminating the other, the Confederation is requested to take up this anomaly before the National Anomaly Committee and cause necessary action for the issue of suitable orders granting the following benefits to the employees opted for pension under combined service.

    1. The Parent department (Postal department) shall be ordered to restore 1/3rd commuted value of pension after 15 years from the date of absorption.

    2. The ESI Corporation (the Autonomous body) shall refund the undue pensionary benefits along with interest to me which was collected by it from the parent department. It may retain proportionate pensionary benefits for 5.5 years required to sanction full pension after retirement, since option was already exercised for full pension.

    16. What is the Government of India doing for removing in-between Grade Pays between the two Posts for Lower Level Officers (Please see Table given below)

    17. How many Vigilance Cases are pending in Departments of Government of India against (i) Higher Level (Class-1 Officers) (ii) Lower Level Officials, (Please give separate figures)?

    18. What is the Government planning/doing to provide equal number of promotions to Lower Levels, as is given to Higher Levels (Class-1 Officers) ?

    20. Why the Government of India is not interested to give the benefit of Actual Grade Pay of next promotion to lower levels, even after their 10 years of Service ?

    24. What is the Government of India planning/doing for upholding the promotions of Class 1 Officers for more than 10 years, so as to bring all the Officials under the Modified Assured Career Progression (MACP) and reduce the overall burden of expenditure on Salaries etc. ?

    One rank one pension is accepted and implemented by the Govt. as per PCDA pension Allahabad circular No. 370 and Ministry of Defence letter No.PC 10 (1)/2009-D (Pen/Pol) dt 08-03-2010. A Subedar of group A/X retired after completing of 28 years of service will get pension of Rs 13105 (Table No.36) as per above letter. Whereas a Subedar retired on 01 Oct 2008 after competing same service in same group is getting Rs 11535. It means the pensioners of post 2006 will get less pension then pre-2006 pensioners inspite of rank; service, group and other conditions are same. There may be many cases like this. The pensioners who retired immediate after implementation of sixth CPC (after Sep 2008) also received less amount of commutation and graduaty because of changes in commutation table and graduaty rules. Now as per Ministry of Defence letter No.PC 10 (1)/2009-D (Pen/Pol) dt 08-03-2010 they will get less pension then pre 2006 pensioners. This is unconstitutional. You are requested to raise the query of affected pensioners to increase the pension of post 2006 retirees with competent authority.

    I have submitted comments on 26th march,2010 regarding the big parity created between the pay scales of Dy.Secretary and Director of CSS by the Committee of Secretaries in the implementation of 6th pay Commission.The matter does not appear to receive attention of the concerned authorities. The post of Director is only a Selection Grade Post, but there is no difference in the duties and responsibilities of both the posts. In so far status of the both posts is concerned, both the posts have equal status and either can be posted on the same post. Will the members of anomaly committee clarify the big difference created in the pay scale of Dy. Secretary and Director in view if the position stated in sub-paras a),b)&c) of my comment stated above. I also request Staff side to kindly take up this matter in next meeting of the anamoly Committee and to request the govt. to remove this anamoly and for keeping the efficiency and morale of Deputy Secretaries of the CSS.

    Now our grade pay is 2000. But the lab technician of cghs,aims,rail and other institute ate getting grade pay 2800.
    The entry qualification is matriculation with science and DMLT. But today we have entry qualificationmatriculation with 1 year experience.
    Is it a justified matter that till today only experience is a qualification. Ministry should handle this matter as nurses,pharmacists getting a similar advantage all over india.Please light this matter and relief the Laboratory technician of lower grade pay.

    Dear Sir,

    I would like to highlight a glaring injustice done to the post of Deputy Secretary in the Central Secretariat Service in granting new pay scales to this post and its inclusion to grade PB-3 as compared to the post of Director. The 6th Pay Commission has recommended a new pay scale of Rs. 15,600 – 39,100 to the post of Deputy Secretary and Director in the Central Sectt. Services as against their Pre-revised Pay Scales of Rs. 12,000-375-16,500 and Rs. 14,300 -400- 18,300 respectively.. However, the Committee of Secretaries has revised the Pay Scale of Director in the Central Secretariat Services to that of Rs. 37,400 – 67,000 from Rs. 16,500 -39,100 and revised the grade pay to Rs. 8700/- from Rs.7600/-. And also the post of Director was included in Grade PB-4, whereas no such change was recommended in respect of the post of Deputy Secretary.

    2, I would like to bring to your kind notice some of the facts which would highlight as to how a big anomaly has been created and how much injustice done to the post of Deputy Secretary in granting lower Pay Scale, lower Grade Pay than that of the post of Director and also by downgrading it to level grade PB-3:-

    a) The Post of Director was initially created as Selection Grade Post to provide better promotional Avenues to the Deputy Secretaries of the Central Secretariat Services who are Stagnated at the maximum of their Pay Scale and are not likely to be promoted as Joint Secretaries till their retirement. But in the course of time, with the intake of officers of other services on deputation on both these posts. the purpose for which the post of Director was created was eluded. .

    b) In the office hierarchical order, though the Director is senior to Deputy Secretary, but the post of Deputy Secretary and Director, both enjoy equal powers, duties and responsibilities in their sphere of their official status. A Deputy Secretary cannot be placed to function under the Director. As against the post of Director or Deputy Secretary either can be posted. For their functions and responsibilities, both are responsible to their immediate boss i.e. the Joint Secretary. A Joint Secretary is only empowered to write Confidential reports of the Deputy Secretary and not the Director. Moreover, no separate duties have been specified in the Office Manual for the post of Director.

    c) The post of Deputy Secretary is a middle level Group ‘A’ Gazette Post which has been clubbed with Group ‘B’ Gazette Post and down graded to PB-3 level whereas the same level post of Director has been clubbed with senior level posts and graded as PB-4. Denying the similar/higher scale to the post of Deputy Secretary as that of Director, is considered to be most irregular and unjustified when both the posts are of equal level and have the same duties and responsibilities.

    d) The pay Scale of Rs 16500-39100 is too low and does not match to the pre-revised scale and status of Deputy Secretary. It is worth to consider that the Basic Pay of Deputy Secretary has been raised by Rs. 4,500/- whereas the basic pay of the Director has been raised by Rs. 23,100/- which almost 6 (six) times more than that of the post of Deputy Secretary when both posts have assigned same duties and responsibilities. No justification is available for this big gap.

    e) Prior to implementation of 6th Pay Commission, the Posts of Lt. Col. and Col. in the Army were equal to the Post of Deputy Secretary and Brigadier is equal to the Post of Director. The 6th Pay Commission granted pay scale of Rs. 16500-39100 to Lt. Col. and was included in Grade PB-3 as that of the Deputy Secretary. The Pay Scale of Lt. Col. has been revised to Rs.37,500/- with grade pay of Rs.1200/- and has now been included in grade PB-4 after big resentment shown by the Army. This has not been done in the case of Deputy Secretary who is equal to the posts of Lt.Col. and Col. in the Army. This will certainly affects the morale, efficiency and functioning of Deputy Secretaries in the Defence Ministry and other Ministries in relation to attached and subordinate offices.

    3. The anamoly Committee may kindly consider/examine the matter in the light of the views and justification in expressed in sub-para (a) to (e) above. The proposal for revision of pay scale and its incusion in Grade PB-4 does aprear to have been find favour by the Ministry of Finance in the absence of above given justification. As Such, there is wide spread resentment among the Deputy Secretaries of the CSS for lowering their status and pay scale as compared to theeir counterparts.

    3. It is, therefore, requested that the pay scale of Rs . 15600-39100 assigned to Deputy Secretary may please be revised Rs. 37,400-6700 with grade pay the post may please be upgraded and included in grade PB-4 in order to maintain equality and equal level to that of the post of Director and Lt. Col. and Col. in the Army and equivalents.

    This may kindly be considered in the next meeting of the anamoly Committeein the light of the justification given particularly in view of sub paras above and considered views may kindly be offered.

    PEON/DAFTRY ARE PLACED BETTER THAN LDC

    Here is an example of two new entrants on compassionate ground – both joined on 1.1.2001 – one joined as Peon (VIII Standard) and the other as LDC (Graduate). Both have no Computer/Typing knowledge. The Peon has been promoted on 1.1.09 (to the rank of Daftry) and his Grade Pay is fixed at Rs. 1900/- (Minimum qualification required for Daftry is Class VIII and this rank was also Group ‘D’ till V Pay Commission). The LDC though was due for promotion on 1.1.09 was denied promotion as she could not clear the Computer/Typing Test and thus is presently drawing Grade Pay of Rs. 1900/-. Thus both the LDC as well as the Daftry are drawing the same grade pay of Rs. 1900/-. The LDC is preparing pay bills, processing the TA bills etc. and the Daftry is carrying files prepared by the LDC to the senior officers). As far as the Daftry is concerned, his work is limited which does not require any skill. Here the Peon who got one promotion will get more promotions and get his next Grade Pay would be fixed at Rs. 2400/-, whereas the LDC may work as LDC for several more years till she is exempted from passing the Computer/Typing Test, whereby losing financial benefits severely.

    HAS’NT THE GOVERNMENT CONSIDERED THIS POINT. Definitely the Government should have. But why the Government has’nt come forward in increasing the Grade Pay of LDCs. The fact could be considering the more number of LDCs serving and any financial increase for LDCs may have more financial burden to the Government. Had it been a rank where the number of employees is less, then the Government would definitely have increased the Grade Pay not only to Rs. 2400/- but even to Rs. 4200/-.

    WILL IT HAVE UNBEARABLE FINANCIAL BURDEN TO THE GOVERNMENT IF THE GRADE PAY OF LDCs IS INCRESASED:- Absolutely not. Why? The present rate of dearness allowance hike is expected to be not less than 9% (effective 1.7.10) and the net hike in the case of the said LDC would be Rs. 1121/- per month whereas increase in the Grade Pay to Rs. 2400/- from the existing Rs. 1900/-, the burden would be a maximum of Rs. 720/- (including all allowances) for ‘X’ class cities and for ‘Y’ and ‘Z’ much less. Thus the additional burden involved is negligible when compared to the DA hike.

    Is’nt it high time the Government/Anomaly Committee consider the genuine grievances/problems and feel the cry of thousands of the LDCs and enhance the Grade Pay to not less than Rs. 2400/-.

    In the event of the Grade Pay allowed to continue at Rs. 1900/- or being fixed at Rs. 2000/-, the anomaly would continue as per the example quoted above.

    LET THE GOVERNMENT CONSIDER THE GENUINENESS OF THE FACTS AND ACT IN FAVOUR OF THE GENUINE CRY OF THE POOR LDCs.

    Yes I agree with you that LDC and UDCs are demoralized with grade pay att with their basic pays since now a days we are doing multitasking duties not only office work on word, excell but as well as working with technical eqpt such as preparing presentation in power point programme installing software making drafts operating photocopier and scanning so how one can say that LDC and UDCs are non-technical. Technical staff is getting rest since responsibility which are assigned to them are doing by clerical staff.

Now again declared ACP every 10 years service i.e 10/20/30 my 20 year service completed on 27/06/2007 but govt not given ACP to me. Hence i request kindly clarify whether ACP applicable to me or otherwise.Also request that ACP be granted to all pers without any condition as pers their length of service.Thanks for this kind of act

    REDRESSAL OF GENUINE GRIEVANCES IN RESPECT OF
    CENTRAL PARA-MILITARY FORCES SERVING /RETIRED PERSONNEL

    Introduction

    All India Central Paramilitary Forces Ex-Servicemen Welfare Association (Regn. No. S/636/7) is a revamped name of Central Paramilitary Forces Ex-Servicemen Association which was registered vide Regn. No.175/99 dated 17th Feb 1999. It is constituted with the sole aim of looking after the welfare of Ex-Servicemen, Widows and their Dependents and to protect the interest of Serving Personnel of Central Paramilitary Forces (CPMFs) of the Country under Union Home Ministry viz. Central Reserve Police Force (CRPF), Border Security Force (BSF), Central Industrial Security Force (CISF), Indo Tibetan Border Police Fore (ITBPF), Sashastra Seema Bal (SSB), National Security Guard (NSG) and Assam Riffles. We area the lot dejected by the Central Govt. for the past several years. Since the inception of our Association, we adopted the path of peaceful agitations to achieve our goals, but no fruitful results could be achieve as yet due to the continued apathy of the Govt. towards our cause.
    Role and Function of Central Paramilitary Forces
    The Central Para-Military Forces under the administrative control of MHA are also declared as “Armed Forces ;of the Union of India†with the approval of Parliament. The Paramilitary Forces are assigned with the task of safe guarding almost the entire 9000 kms long International Border of our Mother-land, fighting the enemies , terrorists and extremists along the Line of Control besides countering insurgency and anti-national elements to maintain Internal Security and to protect the lives of innocent civilians and VVIPs. While the duties of Military and Paramilitary ;Forces are identical in nature, the risk factors faced by Paramilitary Forces are much higher . As per available statistics provided by the MHA itself, more than 8000 CPMF personnel were killed and about 4000 severely injured/disabled during various operations in the last five years, which is not only much higher than that of Army during the corresponding period but also more than that of causalities suffered by the Indian Troops in any war fought by India since Independence.
    All the CPMF are headed by Directors General. These Directors General are IPS Officers (on deputation from States for a short period) except of Assam Rifles which is headed by a serving Lieutenant General of the Indian Army. The operational responsibilities of Para- Military
    Forces are similar in nature compared to those of Army. In certain occasions troops of CPMF are placed under the operational command of Army under the unified command system to combat ;the enemies in which soldiers of the CPMFs and Army fight shoulder to shoulder against the enemies. Though the troops of CPMF are deployed all over the Country yet maximum units of the CPMF are deployed in snow clade mountains, in-hospitable and inaccessible areas of the rugged terrains of J&K & NE region of the Country, the deserts of Rajasthan ands the Left Wing Extremists affected states under adverse climatic conditions and lack of amenities, for round the clock vigil on the International Border, surveillance of their respective areas of responsibility against infiltration /ex-filtration of antinational elements, apprehend/ kill hard core terrorists, nab peddlers/ drug traffickers and boot-ledgers, manning the vital installations in vulnerable areas, beside protect the lives of innocent civilians and VVIPs. These duties are always performed by soldiers of CPMF against all odds with great zeal , vigour, valour, extreme patriotism, impeccable integrity, unflinching loyalty and utter disregarded of their

    personal safety and comfort for which about 8000 jawans of CPMF had sacrificed their lives during last 5 years. But, the Govts. (Central/States) have not yet properly rehabilitated the Widows/ Dependents of those brave soldiers.

    Since all the Central Paramilitary Forces are declared as ‘Armed Forces of the Union’
    And its retired personnel are termed as ‘Ex-Armed Forces Personnel ‘ by the Govt. ;of India hence, CPMF Ex-Servicemen are also legally entitled for all the benefits /concessions presently enjoyed by Ex-Servicemen of the Armed Forces under the Ministry of Defence. But, the benefits and concessions extended to Armed Forces Personnel under the Defence Ministry are not being extended to the Armed Forces Personnel under the Defence Ministry. The reason for this discrimination is stated to have been that services of Paramilitary Forces and Defence Forces are governed by different sets of Rules, hence benefits available to one section cannot be extended to the other as per the provisions . The Defence Forces have separate sets of Service and Pension ‘Rules. In a Democratic Country like ours, it is a paradox that while the Paramilitary Forces doing identical nature of duties that of Army, are governed by CCs Rules, which deprived them of the benefits/concessions being enjoyed by serving/retired Military Personnel. This is in contravention of the provision of Article 14 of the Constitution of India and against the spirit of Natural Justice and Ethics of ‘Equal Pay for Equal Work’. Hence, it is requested that necessary Gazetted notification declaring all Armed Forces, notwithstanding under which Ministry it function, entitled for the benefits/concessions presently enjoyed by Armed Forces under Defence Ministry, may kindly be issued at the earliest.
    Detailed Justification for Our Demands

    The Para-Military Forces do the fighting, face the enemy with same vigour, valour and patriotism and suffer the consequences like the Defence Forces . In short the traumas, tragedies, agonies and bereavements are practically the same as in the cases of the Armed Forces under the Ministry Defence. On the other hand, the facilities, advantages and encouragements extended to Defence Forces are denied to Serving/retired Personnel, Widows and their Dependents of CPMF
    Without any valid reasons tenable under the rules of law. Thus unwittingly but arbitrarily the Paramilitary Fraternity are treated as Second Class and Inferior while facing the same risk, exposed to enemies on the same way that of Army and daring to execute the same defence task with great zeal, vigour and valour. This step motherly attitude of the Govt. needs to be ceased forthwith and remedial measures taken accordingly by including the Central Paramilitary Forces also in the ambit of recently announced ‘Pay Commission for Armed Forces’ and thus these anomalies could be eliminated.

    The Chiefs of Army , Navy and Air Force with the whole hearted support of Hon’ble Defence Minister had taken up the issue of granting more pay and allowances than recommended by the 6th Pay Commission in the interest of their officers and men. But, the interest of Officers and Men of Armed Forces under MHA, Viz CRPF BSF, CISF, ITBPF, SSB, NSG and Assam Rifles and their Ex-Servicemen were NOT given due consideration by the Ministry of Home Affairs and the Chiefs of these Para-Military Forces, while submitting the recommendations initially to the Pay Commission and later on to the Govt. As a result, more than 10,000 Cadre Officers and about 8 lakhs soldiers of CPMF are deprived of their legitimate entitlement at par with the Army. Para-Military Forces (Armed Forces of Union of India) have also not been included in the ambit of recently announced “Pay Commission to Armed Forces†. The cases of CPMF personnel and their Cadre officers were not taken up properly because neither they have any Service Association, like other organizations or any other appropriate platform like staff council to project their own Association which takes care of their service interest. A very small

    group of IPS officers, commanding these Armed Forces (except Asssam Riffles ) are least interested to look after the welfare of the jawans and its Ex-servicemen. The Assam Rifles are commanded by about 1000 Army Officers without giving a chance of command to its Cadre Officers. The reason for such step motherly treatment meted out to personnel of CPMF, we assume from our experience is that, these Forces are commanded either by IPS officers or Army officers who are least bothered about the welfare of CPMF personnel. Moreover, the serving CPMF cadre officers have NO ROLE in the Decision Making/ policy Formulation Process of these Forces.
    Normally chiefs of CPMFs come on deputation to these Forces from States Cadre for a very short period and because of which they; do not get adequate time to study the actual problems faced by these forces. As a result adhocism prevails in these Forces, as far as policy formulation and its implementation are concerned. It is worth mentioning that such a large body of Troops need to be commanded by the officers of same organization having adequate experience of the Force which will ultimately bring continuity in the command system, policy formulation and its implementation and get rid of the unwarranted adhocism in these forces.

    OUR LEGITIMATE DEMANDS

    1. Ex-Servicemen Status:- As per the definition of Ex-Servicemen, ‘all persons who served in any of the Armed Forces of the Union of India at lease for a period of five years and discharged by way other than dismissal are termed as ‘Ex-Servicemen’. All the Central Paramilitary Forces are declared as ‘Armed Forces of the Union of India’ by the Union Home Ministry vide Notification No. 241231/74/2004-PC dated 6 Aug, 2004 (Copy enclosed as APPX-A). This makes all retired personnel of ;CPMFs rightfully eligible to be termed as ‘Ex-Servicemen’ with all consequential benefits. But the Govt., simply denied it on flimsy technical reasons. However, it was admitted and stated by the lMHA that Ex-Paramilitary Personnel can be termed as ‘Ex-Armed Forces Personnel’ with all consequential benefits vide their Letter No. 24121/74/2004-PC dated 10 June 2005 (Copy attached as APPX-B ) . But, nothing came out within this span of five years. We want either Ex-Servicemen Status with all consequential benefits or declared/notified as “ Ex-Armed Forces Personnel†to be treated at par with Ex-Servicemen with all facilities/ concessions being enjoyed by them.

    2. Separate Pay Commission for Armed Forces:- One of our prime demands was ‘Separate Pay Commission for Armed Forces’. But, when a separate pay commission for Armed Forces, was announced by the Govt., the CPMFs were not included in the ambit of it. Since all the CPMFs are ‘Armed Forces of the Union of India’ hence, Paramilitary Forces should also be included in the ambit of the ‘Pay Commission for Armed Forces’. Necessary Notification/Govt. Order may kindly be issued in this respect at the earliest.

    3. CSD Canteen Facilities:- For various reasons our long standing demand for CSD canteen facility was not considered. Instead, the MHA introduced Central Police Canteen System (CPC) vide Memo No. 27011/18/2006-R&W dated 18.09.2006. It is still in the embryonic stage, even after a period of more than three years of its introduction. Since the MHA could not obtain VAT exemption for the goods sold through these canteens from the States hence, the rates of goods purchased from these canteens remain the same as that of local market. As such the concept of Central Police Canteen System has not been beneficial for the Serving/Retired Personnel of CPMF. So we demand to extend CSD Canteen facilities to CPMFs through insitu CSD Canteens or by opening additional CSD Canteen outlets at convenient places.

    4. Ardh Sainik Kalyan Board:- The Govt. had ordered to constitute a Welfare and Rehabilitation Board (WARB) vide MHA Officers Memo No. 27011/37/2007-R&W dated 17 May, 2007. The duties and responsibilities of Central., State and District Welfare Officers were entrusted to various Para Military Forces as per its deployment. The officers designated as CWOs, SWOs and DWOs have to perform these duties in addition to their routine duties and responsibilities in their respective Forces. Keeping the prevailing security situation in the country in view, these officers hardly get any time to discharge these additional duties. So the present Welfare Board is nothing but a mockery of our demand. The lasting solution to this point is to establish ‘Ardh Sainik Kalyan Board’ with independent Central, State and District Welfare Officers similar to those of Kendriya / Rajya / Zilla Sainik Boards for which necessary infrastructure including staff an accommodation be provided. The expenses incurred may be shared by Central and State Govts. Retired CPMF officers commensurate with their rank and experience may be designated as Central/State/ District Welfare Officers.
    5. (a) Create Organised Service for Group ‘A’ Officers of CPMF:-

    There are about 10000 Group ‘A’ officers in CPMF Cadre. In the absence of ‘Organised Service in CPMFs, normal growth of the Cadre Officers is deprived vis-à-vis the officers of organized service of Equivalent Status which is against the instruction of Deptt. Of Personnel & Training. In Para-44.25 of the 6th Report of the National Police Commission, it was pointed out that IPS Cadre should be opened to officers of CPOs, who have put in 8 years also, but the recommendation was never implemented. Vide Para-22.32,the 5th CPC had recommended to revise cadre mechanisms to bring uniformity in the career progression of all Group-A officers. But the 6th CPC has not recommended ‘Organised Service’ for CPMFs Cadre Officers on flimsy reasons. The Medical Service in CPMFs is a Subsidiary Stream’ while “General Duty is the Main Streamâ€. During the year 2004, the Medical Officers in CPMFs were given an Organised Service to meet their career aspiration and many such Medical Officers, once junior than Group ‘A’ General Duty Officers have now reached up o the level of Additional DG

    5. (b) Inclusion of the Post of 2 I /c of CPMF in the Pay Scale of PB-4:-

    The rank / status of Second-in-Command (2 I/C) in CPMF is akin to that of Lt.Col. But, unfortunately, the post of 2 I/C is still in the pay scale of PB-3 whereas the post of Lt.Col. has beenincluded in the pa y scale of PB-4 by the Govt. on concerted pressure from the MoD. It is nothing but natural to consider the case of 2 I/C of CPMF to be included in the pay scale of PB-4 so as to enable them get their due status and monetary benefit there to .

    6. 100% Posts of DIsG and 50% Posts IsG and Above to be Filled by Promoting Cadre Officers.:-

    As per the recommendations of 6th CPC as accepted by the Govt., 100% posts of DIsG and 50% posts of IsG and above are to be filled by promoting cadre officers which is not being implemented scrupulously in all CPMF. There is no cadre DIG in Assam Rifles though number of eligible cadre officers are available . In other CPOs also DIsG from IPS cadre are posted on deputation . There are also instances in CPMF where the tenure of deputation is not being followed strictly. Immediate step may kindly be taken to ensure a fair deal of CPMF cadre officers so as to enable them get their legitimate promotion in time.

    7. Armed Forces Service Pay to CPMF Peersonnel:-

    Paramilitary Forces are the first line of defence in any security operations or disaster management. But , CPMF Personnel have not been granted the service pay (MSA) as admissible to Military Personnel. It is humbly requested that Armed Forces Service Pay (AFSP) at rate Rs. 2,000/- for personnel below officers rank and Rs. 6000/- for officers, as granted to Military Personnel to be granted to CPMF Personnel also.

    8. One Rank-One Pension:-

    This is also one of our main demands since very long. Recently a High Level Committee has been constituted under the Chairmanship of Cabinet Secretary with Home Secretary , Defence Secretary and Secretary (Expenditure) as its members to study the concept of One Rank-One Pension for Ex-servicemen of Defence Forces. Ex-servicemen of CPMFs should also be included in the purview of the ibid committee.

    9. Separate Service and nPension Rules for CPMFs:_

    Though Paramilitary Forces are declared as ‘Armed Forces of the Union ‘ yet the CPMFs are governed by CCS Rules. Since the nature of duties of CPMFs Personal and other Central Govt. Employees are different as day and night, hence it is not desirable to treat them on a par. Under the provision of CS Rules, the CPMF Personal are deprived of kind of benefits and concessions being enjoyed by Defance forces Personnel. Considering the arduous nature of duties of CPMFs personnel, which are tougher than that of Army Personnel, a separate set of rules may be framed with regard to Terms & Conditions of Service, Pay & Allowances, Pension & Post Retirement Benefits/Concessions exclusively for the CPMFs similar to Defence Service Regulations.

    10. Stoppage of Contubutory Pension Scheme:-

    The Govt had assured that a Group of Ministers (GOM) were examining the matter of exemption of CPMFs Personnel from the purview of newly defined Contributory Pension Scheme for Central Govt. Employees.But, the decision taken by the Govt. on the report of GOM has not yet been made known. We demand that immediate action be taken to exempt the CPMF Personnel, enrolled on or after 01 January 2004, from this scheme and they be given pension as is being given to Personnel enrolled prior to 01 January 2004. Though the Govt. vide OM No.38/41/06PRPW(A) dated 05 May 2009 have extended certain additional relieves on death/disability provisionally, yet the orders for exemption of CPMF from the ambit NPS is to be issued.

    11. Frame Appropriate Rules for Compassionate Appointment:-

    All Central and State Govt. Employees are privileged of Compassionate Appointments. While the windows and dependents of deceased State Govt. Employees are suitably placed in the Govt. service immediately after the demise of the Govt. Servant, the State Govts. Flatly refuse the request of compassionate appointments to Widows/Dependents of CPMFs Personnel killed in action/died in harness on the plea that the death of CPMF Personnel are not attributable to Military Service. There is a need to review the compassionate appointment

    procedure and a new Directive be issued to all States / Central Govt. departments to reserve 10% of vacancies for compassionate appointments to widows/dependents of Armed Forces Personnel killed in action /died in harness so as to enable the widows/dependents of CPMF Personnel get a job in their Home States.

    12. Provision of Enhanced Disability Pension/Ex-Gratia:-

    Every personnel in physically fit when he is enrolled. But, if he becomes disabled while discharging his duties before completing 10n years of service, by way of loss of limbs or serious injuries, he will be invalidated without any pension and compensation. This is clear case of Human Rights Violation. The Govt. is bound to compensate him and his family by providing pensionary benefits irrespective of the length of service. The present disability pension be enhances suitably.

    13. Restoration of Stopped Pension of BSF Personnel:-

    BSF authorities in consultation with the MHA permitted its men to resign with pensionary benefit by misinterpreting Rule 19 of BSF Rules 1969 right from 1979. Later in 2001 BSF authorities stopped all such pensions following an observation of the Hon’ble Supreme Court. Few of them rejoined in service but majority; of them including those who were drawing pension continuously for more than 20years were unable to rejoin sue to obvious reasons. These personnel are starving only due to the mistake of MHA and BSF authorities. An immediate solution of the case is to be found and orders for resumption of pension to affected personnel issued on a priority basis.

    14. Minimum Pension after 10 Years of Service:_

    For various reasons personnel are often retired prematurely. Appropriate rules may be framed for minimum pension to those who left/resigned after rendering qualifying service of 10 years in CPMFs.

    15 .Stoppage of Unjustified Reduction in Family Pension:-
    As per existing rules, the family pension is reduced after a period of ten years. When the pension amount perse considered to be inadequate for a family for their sustenance , then further reduction in family pension after 10 years in arbitrary and against the spirit of Natural Justice. This issue may be addressed immediately , keeping the humanitarian aspect in view.

    16. Stop Deputation of IPS/ Army Officers to CPMFs:-

    The promotional avenue of Gp ‘A’ officers in CPMF is being stagnated by deputation of IPS and ;army officers in CPMFs . This system has not only adversely affected the morale of the Cadre Officers of CPMFs but the functional efficiency also of these Forces. So the system of deputation of IPS and Army officers to CPMFs be stopped immediately. Similarly, the Assam Rifles cadre officers be given the command of AR units which are presently commanded by Army Officers.

    17. Free Medical Treatment:-

    The CGHS facilities are available only in the State capitals /Major cities. Poor ex-CPMFs men residing at far flung areas/ distant places are unable to avail of the facility.

    Therefore, a system may be evolved for free treatment to ex-servicemen/families of CPMF similar tp yjr Ex-Servicemen Contributory Health Scheme(ECHS).

    18. Free Educational Facilities and Reservation of Seats for Professional/ Vocational Courses:-

    Only 910 wards of CPMFs Personnel are benefited by the newly introduces Prime Minister’s Scholarship from 2006-2007. Children of CPMF Ex-Servicemen are studying without any kind of concessions. No seats are reserved for wards of Ex-CPMF Personnel for professional courses. This aspect needs to be looked into and appropriate action is required to be initiated to introduce new scholarship up to Higher Secondary level and reserve a certain number of seats for the wards of CPMFs ex-servicemen for professional course, all over the Country.

    19. Re-employment Facilities:-

    In order to maintain high physical standard and fitness maximum numbers of CPMF Personnel are compelled to retire voluntarily after completion of 20 years of service i.e. much before attaining the superannuation age. These personnel are left with no other option, but to seek re-employment inn the civil sector. Hence, these retired personnel of CPMF be provided with re-employment facilities as being enjoyed by military ex-servicemen.

    20. Reservarion of Vacancies in all Forces for Enrolment of Wards/Dependents of Serving / Retired CPMFs Personnel:-

    Reservation for vacancies in all Forces for enrolment of wards/dependents of serving /retired CPMFs personnel be launched every year by allotting 10% of total vacancies, earmarked for enrolment as being done by Defence Forces.

    21. Creation of New Post- Chief of CPMFs:-

    A new post be created/ designed as ‘ Chief of CPMFs’ under whom all Central Paramilitary Forces are to be placed to enhance the operational and administrative efficiency, uniformity among all CPMFs, creating a sense of spirit-de-corps among the troops of the forces and boost the morale of the forces personnel. The officer so appointed should have had served in any of the CPMFs for a minimum of five years span to enable him to have first hand knowledge/ information about the role and functioning of these forces. The tenure of the appointment shall be of a minimum of three years.

    22. Removal of Anomalies in the Pay Scale of Group- ‘B’ Civilian Cadre in CRPF:-

    It is quiet lunethical that an employee who was drawing grade pay of Rs. 4,800/- (as Subedar Major ) will get only Rs. 4,200/- as Grade Pay on his promotion (as Administrative Officers-Group-‘B†Gazetted Post). But this ;is what is happening in CRPF since as per the policy in vogue the Subedar Major (Ministerial and Personnel Assistants ) on their promotion to forego their combatant rank and then only promoted as AO/PS. The only benefit they derive out of this promotion is that they can serve upto 60 years of age instead of 57 years stipulated for combatised personnel. But , once they become civilians, they are deprived of the benefits of uniform, ration and a loss of Rs.5, 400/- or they be promoted as Asstt.Comdt., so as to enable them to get all the benefits.

    23. Separate Ministry for Internal Ssecurity and CPMFs Affairs:-

    The Union Home Ministry is assigned with numerous tasks including Internal Security of the Country. The officers and staff of the Ministry are so heavily committed that hardly find any time to monitor, evaluate and guide the operational as well as administrative functioning ;of widely deployed CPMFs properly. As a result, the welfare measures of its personnel and ex-servicemen are not being properly implemented in time . The need of the hour is to establish a Separate Ministry to be designed as ‘Ministry for Internal Security and CPMFs Affairs’ or so to deal with all matters pertaining to Internal Security and Paramilitary Forces of the Country.

    24. Flag Day for Paramilitary Forces.

    Police Commemoration Day (21st Oct.) may be observed as Flag Day of Paramilitary Forces and the funds so raised utilized exclusively for welfare and rehabilitation of CPMF ex-servicemen, widows and dependants.

    25. Constitute High Level Welfare Co-ordination Committee.

    Constitute a high level Co-ordination Committee comprising senior officers of MHA, CPMF and Office Bearers of Ex-servicemen Welfare Association to study the problems faced; b y CPMF serving/ex-servicemen, widows and dependants. Meeting of such high level committee be convened on half yearly basis to discuss various welfare measures to be implemented to CPMF serving/ex-servicemen, review the progress of funning the CPC and functioning of WARB at various levels and to make recommendation accordingly to the Govt from time to time which will definitely help to improve the working efficiency of the serving personnel and at the same time boost the morale of serving/ex-servicemen of CPMF.

    26. Provision of Accommodation for Central Committee Office of the Association.

    Our Association stands for the Welfare of Serving / Ex-Servicemen of CPMF the entire Country and the only Association of its kind. As per the recommendation of the Vth Pay Commission, such Welfare Associations may be provided with office accommodation. It is, therefore, requested that suitable accommodation in and around Delhi may kindly be provided for the smooth and effective functioning of Central Committee Office of the association.

    Conclusion
    Sir, the duties of CPMF Personal are identical in nature with that of Army. The bullets come out of the Guns of enemies have no discrimination between Military or Paramilitary when it hit. But when the question of granting benefits comes, CPMF are treated as Civilian Employees under CCS Rules. This step motherly treatment meted out to CPMF Officers and men by the Govt. and their own Heads of Forces has resulted in wide spread resentment amidst Serving / Retired Personnel of Para Military Forces who are totally demoralized.
    The Serving and Retired Personnel of ParaMilitary Forces feel like nomadic in front of their counter parts in the Military due to huge disparity in Pay & Allowances and Pension

    prevailing between these Forces. The Chiefs of Defence Forces did not accept the pay structure recommended by the 6th CPC and the Defence Minister also supported them. As a result the Govt. compelled to set up a separate Cabinet Sub Committee to study their cases and consequent upon the recommendation of ibid Committee enhanced their scales of Pay &Pension. Similarly a High Level Committee headed by the Cabinet Secretary has been reportedly set up to study the concept of “ONE RANK – ONE PENSIONâ€. All these happened because the Defence Forces are commanded by their own officers fully committed to look after the welfare of their Troops where as Paramilitary Forces are commanded by IPS Officers joined on deputation basis from States who are least interested in the welfare of Officers, Jawans and Ex-Servicemen of CPMF. The resentment amidst Serving/Ex-Servicemen of CPMF is nearing to dangerous proportion day by day which is not at all desirable keeping the overall security situation of the Country in view. The Country had once witnessed the first ever Armed Forces Strike in 1979 – the CRPF Strike. Now the Country is likely to face a similar situation in the very near future. But this time it would not be the CRPF alone but all the Paramilitary Forces as a whole, which will be disastrous to the Security of the Nation. It is high time for the Govt. to open its eyes and learn lessons from the recent mutiny in the Armed Forces in one of our neighbouring Countries.
    Hence, we on behalf of all Serving/Retired Personnel of CPMF fervently request the Govt. under your esteemed stewardship to take appropriate action to accept our just and genuine demands by incorporating all Central Paramilitary Forces in the definition of “Armed Forces of the Union†like the Army, Navy and Air Force for which appropriate Rules & Regulations be made in the interest of the Country in general and of the Central Paramilitary Forces Personnel in particular.
    Submitted with a humble prayer to look into the matter keeping the humanitarian aspect in view, on a priority basis.

    From CPMF:- It is submitted that i am ASI since 2008 and drawing basic pay of Rs.8050 in ministrial stream with 14 years of service, whereas newly appointed ASI/Stenos appointed in 2009 January is drawing Basic Pay of Rs.8510.
    It is requested that promotees must be given minimum basic pay specified for new recruits according to rank and grade pay if they not reached to the minimum of that scale. It is really a heartburning to us being senior in the Force to draw lesspay. It is not understood how we will COMMAND……………………….. CHAIRMAN SIR PLEASE EXCEPT OUR DEMAND

    Sir,

    I want to draw kind attention towards the injustice done to the LDC/UDC category. They have been put to gether with the Gr.D Staff. This is great injustice to the SSC Qualified person, who are handling more more higher nature of work. The MACP has also resulted in more disadvantageous stage by connecting it to the hierarchy of the scales and not to the hierarchy of the posts as was available in Old ACP Scheme. This has created three categories of LDCs in our Deptt.(CGHS). One who got IInd ACP after 24 years of service, before the implementation of the MACP Scheme i.e. before 01.09.2008,, as per old Scheme and have received the Gr.Pay of Rs.4200/- (old SCale of 5500-9000 as per hierarchy of post- first UDC then Accountant)and after rendering 30 years of service are receiving next Gr.Pay of RS.4600/-. Second category, who completed 12 years of service before implementation of MACP Scheme have received first upgradation in scale of UDC i.e. 2400 and now they will get IInd upgradation in 2800 after 20years and IIIrd upgradation in 4200 after 30 years of service. The third category who have received Ist upgradation under MACP SCheme at 2000, IInd at 2400 and IIIrd at 2800. It means in a same Deptt. some LDCs have got IIIrd ACP at 4600, some have got at 4200 and rest are getting only 2800. Please please please look into the matter.

    Sir,
    I literally fail to understand under what concept this MACP has been introduced by replacing the previous version of ACP. Has it been introduced to create grave disparity, discontent-ment and all of that sort to keep the CG employees under continuous stress and strain. The policy of MACP apparently fails in terms of appropriation and ligitimacy. Under the previous ACP Scheme, person completing 24 years of service was granted grade pay of Rs 4200/- and now under the MACP Scheme a person is being granted Rs 2800/- as grade pay on completion of 24 years of service, ie. flatly a difference of Rs 1600/-. What an ideological and judicial policy. Can any authority explain me why a loss of Rs 1600/- has been caused to the employees without any fault on their part by introducing this `Modified’ ACP Scheme. Is it a modification in terms of causing financial loss to the employees and causing enormous disparity between the employees who were granted the upgradation upto 31.8.2009 under the ACP Scheme and those unfortunate employees who are covered under this MACP Scheme wef 01.9.2009? Such a grave disparity and impropriety remained unchecked/unnoticed and the policy has been introduced with full swing. I can assure that this disparity/discrepancy is being viewed with great discontentment by all affected employees and the matter may be challenged before the court of law for redressal. I will earnestly request the concerned authorities to take a serious note of this anomaly and rectify the same at the earliest please. The financial upgradation under the MACP Scheme should be granted as per the promotional norms than only it serves the very purpose of `Career Progression’ otherwise it’s simply a ridiculous sort of thing.

    Sir, As per the MACP Scheme the employee will get the G.P. as given in G.P. hierarchy i.e. 1900/-, 2000/-, 2400/-, 2800/-, 4200/- etc. and only on promotion he will get the G.P. as per the hierarchy of the post. In my case I was appointed as LDC through Staff Selection Commission in 1990 and remain without promotion till date after Surplus I was redeployed in 2006 and became junior for the purpose of promotion. In my new department there are less promotion and LDC will get his promtion after approximate 24-27 years of Service. I have only 16 years of service left if the retirement age continued 60 years. That means I will not get any promotion till retirement, so how can I will able to get my G.P. on the basic of my hierarchy.

    (b) Mr BN Choudhury, S.Banerjee, ML Verma & PK.
    I have gone through your responses on the dissatisfaction and discontentment expressed by you all for the injustice done to the clerical cadre by the VIth CPC. I am equally placed like you all, highly upset and distressed after serving with the Defence for 24 years. I have come across 03 Pay Commissions so far, the IVth, Vth and now the VIth. The clerical cadre has been placed in a callous state from the IIIrd CPC itself and its perpetual affect has resulted in a grave injustice to the clerical cadre in the present VIth CPC. Surprisingly, the respected members of the CPC have literally failed to distinguish the functional aspects, degree of responsibilities/promptness involved in clerical tasks and various other working conditions in comparison to trades like Boot Maker, Cook, etc. Resultantly, a LDC and these Class IV trades have been placed in an identical pay scale. The difference in the grade pay of a LDC and Class IV trades is Rs 100/-. Evidently, LDCs/UDCs in the present trend of functional conditions are operating computer, drafting letters, notings, maintaining report/returns apart from all other tasks of routine nature. They are even dealing with subject of complex nature like court cases, recruitment, discipline and budget. Most importantly, the clerks are under the scan of ACR (now APAR). In APAR, the clerks are judged for their performance on various criteria like state of health, personality, attention to routine nature of work, knowledge of rules/regulations and ability to apply the relevant rules correctly, capacity to examine/inspect cases thoroughly and comprehensively, quality of noting/drafting, promptness in disposal of work, amenability to discipline, punctuality in attendance, public relation and integrity. Apparently, the clerks are constrained to work strictly under these obligations. Does any of the above obligations is applicable or compulsory for Class IV employees? Then how is it justified to keep the clerks and Class IV trades in the same pay band with a difference of Rs 100/- in the grade pay? Can any comparison be drawn between the functional aspects of clerks (as brought out above) and the Class IV employees? Can any authority explain me this logically? This is a clear violation of natural justice, a matter of cardinal error and an aberration caused to the entire clerical cadre in Defence estts. Due to this injustice, the morale of the clerical cadre has been badly affected which is causing adverse reflection on all other aspects like functional capabilities, social status and health. This mis-appropriation, injustice and a serious anomaly on the part of the CPC and the Govt is highly reprehensible and condemnable. Keeping the above facts and figures available on record, I request the Govt authorities to consider this serious lapse in true spirits and take appropriate remedial measures at the earliest please. Compare the pay scales and promotional prospects of clerks in Defence estt. with the clerks in other establishments like banks, railways, IT deptt and PSUs and then observe the difference. Keeping in view the above stated anomaly and mis-appropriation, I would request the Govt to consider the legitimate demands of the clerical staff in Defence estts and grant the following:-
    PAY SCALES
    (a) LDCs in the Pay Band (S-9)with corresp grade pay
    (b) UDCs in the Pay Band (S-10)with corresp grade pay
    (c) Asstt (now OS) in the Pay Band (S-14) with corresp grade
    pay
    (d) EMEO(Civ)in the Pay Band (S-15) with corresp grade pay
    FINANCIAL UPGRADATION UNDER THE MACP SCHEME
    The financial upgradation in terms of grade pay should be granted on promotional norms under the MACP Scheme.
    I would request the respected Staff Side members of the National Anomaly Committee Sarvashri M. Raghavaiah (Leader), UM Purohit (Secy), Rakhal Das Gupta, KKN Kutty, SG Mishra and other members to kindly highlight the above matter to the respected members of the Official Side of the NAC and submit a forceful demand before the Govt for early implementation of the same. Please insist the Govt that by implementing the above proposal, it will not exert financial burden on the Govt exchequer to the extent of the up-coming Common Wealth Games but will certainly result in high morale of the clerical staff and thereby improved functional capabilities and positive approach to all assignments. I would also request my respected colleagues named above to make concerted efforts at their level to submit their grievances/representations to the NAC through the respective Association(s) functioning in their unit (one like the All India EME Civilian Personnel Association [HQ at Secunderabad]).     how long will the national anomaly committee take in solving the problem of pay fixation with regards to new recruits and promotees of central government employees. as discussed earlier i am losing more than Rs.2010/- on my basic pay alone due to this anomaly. i am fixed at Rs.10560/- on 26/09/2008 (date of promotion to inspector of income-tax), whereas junior inspectors joining the department after that date (my date of promotion) are getting more basic pay than me. shall we have to wait till 2016….. great news for govt. employees that now kids are given more benefit inspite of seniors having more experience and same educational qualifications (more qualification in some cases). So, is it 2016 at last?

    Respected Staff Side Members of the NAC, Sirs,
    The last meeting of the NAC was held long back on 27/3/2010 as per the available information. When is the next meeting going to be held, the matter is in abeyance. Since the tenure of the NAC has been extended upto 31/3/2010, I hope that at least two meetings will be held by the end of this year to rectify some of the compelling anomalies. Although, it is merely an expectation.
    There has been a tremendous representation from the clerical staff of the Central Govt (Defence) since introduction of the VIth CPC against the pay band and the grade pay the clerical staff has been placed in. It is obviously a matter of serious concern that the clerical staff, the executive functionary in any deptt., has been ill-treated causing great mental distress and low morale to the entire cadre. This will certainly have a horrific affect on the performance, capabilities and competence of the clerical staff which will, proportionately cause adverse reflection on Govt work at every level as well. Mis-placing the clerical staff at par with the Class IV trades is the blunder mistake/lapse on the part of the Pay Commission. Further damage has been caused to this cadre by the introduction of the MACP Scheme which is like adding insult to the injury. I, therefore, request the Staff Side Members to take up this issue seriously and effectively with the Official Side of the NAC and to place a favourable report before the Govt for immediate rectification of the anomaly. I strongly represent on behalf of the clerical staff and demand the following :-
    (a) The initial grade pay of the LDCs should be Rs 2400/-
    (b) The initial grade pay of the UDCs should be Rs 2800/-
    (c) The financial upgradation under the MACP Scheme should be granted on PROMOTIONAL NORMS only and not on hierarchical basis. It is a policy framed for Career Progression and should be treated as such to make it actually meaningful in true spirits; else it would be a mockery of the terminology `Assured Career Progression’.
    The above demands are absolutely justified and legitimate and the NAC or the Govt should not find it difficult to accept or implement. [Subir UDC, Agra]

    This is with reference to the comments given by my good friend A Mahesh Babu (01/7/2010) on the inequality/anomaly in the grade pay of a clerk and a peon (promoted to daftry). He has cited a fine example to prove the actual discrepancy prevailing on ground between the grade pay of a clerk and a Class IV workmen. I appreciate Mahesh for highlighting the point as a illustration. This is actually the problem on ground and that is why the clerical staff is placed in a mentally distressed state. Representations are being made by the clerical staff at various levels but very unfortunately the legitimate and justified demand of the clerical cadre has fallen into the deaf ears of the NAC/Govt. I find it enormously difficult to understand how the nature of duties and the gravity of responsibilities of a clerk can be compared with that of a Class IV workmen. In the todays trend of functional procedures, a clerk is operating a computer (working on various programs), drafting letters/noting sheets, maintaining accounts, dealing with tasks of complex nature like court cases, discipline, recruitment, budget, etc. Most importantly, a clerk is under the scan of ACR (now APAR)and therefore, has to maintain his working as per the columns specified in the APAR to avoid adverse remarks by two officers, the Initiating Officer and the Reviewing Officer. Apparently, a clerk has to perform satisfactorily in the eyes of two different officers. These compulsions/commitments are NOT applicable for a class IV workmen. Then how can the pay band or the grade pay of a clerk and class IV workmen can be identical? Can any of the authority at any level give a logical justification to this discrepancy? No one can has a reply to this mis-appropriation. Surprisingly, this blunder mistake has gone unnoticed in the VIth CPC and now the NAC has also sidelined the issue resulting as a mis-placed priority. The NAC should at least consider this lapse seriously in the larger interest of the entire clerical cadre and place its strong recommendations before the Govt to rectify the anomaly at the earliest. I would appeal all my colleagues (LDCs/UDCs) that its the high time to unite and forward their representations before the NAC through appropriate channel/platform so that the NAC/Govt takes cognizance of our grievances and legitimate demands.     I have promoted to the rank of HC/Ministerial on 21St October 2004 in the Pay Scale of Rs. 3200-85-4900,during the year 2007, I have been again promoted to the next higher post i.e the rank of Asstt. Sub. Insp(Ministerial) in the pay scale Rs. 4000-100-6000,in between Central Govt.have declared 6th Pay Commission w.e.f. Ist January-2006 & i have fixed on 1/1/2006 Rs. 6590 + Rs. 2400 Grade Pay. various HC/Min. have joined SSB during the year 2007 and fixed Rs. 7510 + Rs. 2400 Grade Pay. At present i am drawing basic Pay Rs. 8390 + Rs. 2800 Grade Pay & HC/Min. are drawing Basic Pay Rs. 8440 + Rs. 2400 Grade pay, I humbly request you to kindly discuss the matter with all Anomaly Committee members regarding my pay fixation please.

    Is there anybody, who can do something for the lower level officials Peons/LDC/UDC/Assistants/S.O., who are being deprived of benefit of actual promotion (Grade Pay) in the name of three Modified ACP and knock the door of the Government or Unions or Higher Level Officers (Class-1) to consider the following points :-

    1. Why Higher Level (Class 1) Officers are given 5-6 promotions without passing further exams for promotion ? i.e. Under Secretary –>1. Deputy Secretary –>2. Director –>3. Joint Secretary –>4. Additional Secretary –>5. Secretary –>6. Cabinet Secretary; etc.

    2. Why Lower Level Officials (other than Class-1 Officers) are restricted to only 01 or 02 promotions without passing further exams for promotion ?

    3. What is the Government planning/doing for reducing Strikes/Agitation, corruption and Court Cases etc. at Lower Levels (other than Class 1 Officers)?

    4. What is the Government planning/doing to reduce Mess at lower levels (other than Class 1 Officers) and doing efforts for smooth sailing for promotions etc. as available at higher levels (Class-1 Officers)?

    5. Why generally LDC has to pass UDC exams and prove oneself to get maximum 03 promotions ? LDC-1. UDC (after Exam) -2. Assistant & -3. S.O. (Promotion)

    6. Why mostly Assistants have to pass S.O. exams and show skill to get max. 03 promotion ?Assistants – 1. S.O.(after Exam) 2.Under Secretary 3. Deputy Secretary (promotion)

    7. Why LDC has to pass UDC and S.O. exams and then entitled for max. 04 promotions ? LDC-1.UDC (Exam)-2, Assistant (promotion)-3. S.O.(Exam)-4. U.S (Promotion)

    8. Why exams at only lower levels for promotion, when most of them are Graduates except Peons ?

    9. Why not exams for promotion at higher level (Class 1) Officers, when most of the competence, skill, knowledge, responsibility etc. is required at higher levels for policy making, framing rules & regulations, FR & SR, new projects, Court Cases, foreign tours, planning etc. ?

    10. Who makes Promotion/Recruitment Rules, Pay Structure etc. for Lower Levels officials (other than Class-1 Officers) in Government of India ?

    11. Why not at least benefit of 4 Promotions be given to lower levels (other than Class 1 Officers), without passing any further competitive exams for promotion ?

    12. What is the Government of India planning/doing for conducting competitive exams even for promotion at higher levels (for promotion of Class 1 Officers) ?

    13. What is the Government of India planning/doing for providing equivalent pay/salary for the denied due leaves, when leaves are denied in the interests of the work of the Government, while higher level (Class 1 Officers) generally get not only, due leaves, but also, enjoy foreign Seminars/Tours/Trainings/Workshops etc. along with financial benefits including Foreign Allowance, TA / DA etc.?

    14. What is the Government of India planning/doing for fixing of salary from the date of issue of Promotion Order, instead of date of joining, when joining is delayed/deferred, in the interests of the work of the Government, as joining of duty of Lower Level Officers (other than Class 1 Officers) on promotion is delayed/deferred, thereby causing lot of financial losses to them, while Officers at higher levels may generally join duty immediately/same day of Promotion Orders?

    15. Who keeps the interests of Lower Level Officers (other than Class 1 Officers) all the time, while framing FR & SR, other rules etc. – Government / Higher Level Officers / Agitation / Strikes / Unions / Welfare Associations / Courts ?

    16. What is the Government of India doing for removing in-between Grade Pays between the two Posts for Lower Level Officers (Please see Table given below)

    17. How many Vigilance Cases are pending in Departments of Government of India against (i) Higher Level (Class-1 Officers) (ii) Lower Level Officials, (Please give separate figures)?

    18. What is the Government planning/doing to provide equal number of promotions to Lower Levels, as is given to Higher Levels (Class-1 Officers) ?

    19. What is the Government planning/doing to protect the interests of Lower Level Officers (other than Class-1 Officers), as and when the Rules for Promotion/Recruitments/Pay Scales etc. are amended/framed?

    20. Why the Government of India is not interested to give the benefit of Actual Grade Pay of next promotion to lower levels, even after their 10 years of Service ?

    21. How much the total amount of Salary paid including Foreign Allowance, TA, DA was given during the last four Financial years separately to (i) Higher Level (Class-1 Officers) (ii) Lower Level (other than Class-1 Officers) of Government of India year-wise ? (Please give figures separately for (i) and (ii)?

    22. Why not, Promotion Rules, Recruitment Rules (FR & SR) including modified ACP Rules, etc. may be made and considered in such a manner, which may provide smooth sailing not only at higher levels, but also at lower levels, thereby minimizing mess, agitation, strikes, corruptions, court cases, etc. at lower levels ?

    23. How many total court cases are pending of (i) Higher Level (Class-1 Officers) (ii) Lower Level (other than Class-1 Officers) in Departments of Government of India?

    24. What is the Government of India planning/doing for upholding the promotions of Class 1 Officers for more than 10 years, so as to bring all the Officials under the Modified Assured Career Progression (MACP) and reduce the overall burden of expenditure on Salaries etc. ?

    25. What is the Government of India planning/doing to insert Grade Pays in between two posts also for Higher Ranks (Class 1 Officers), as are applicable for Lower Officials

    Dear Sir,
    Please discuss the LDC’s grade pay upgradation in next Anamoly Committee as the Peon’s are getting the same grade pay in all central govt offices. Kindly go through our matter seriously otherwise LDC’s in all offices will become demorolise in nature of their work. We are looking for a positive step for you sir.if you provide with the same grade pay for both peons and LDCs then please do not ask type writing test should be passed who are applying for LDC posts. because while you are paying the same grade pay then the qualification should also be the same ie., peon may be 8th, or 10th but where as LDC is concerned 10th plus type writing with computer knowledge. in the matter of Grade pay how u make both equal. Besides this why can’t you equalise LDCs with Data Entry operators what extra these DEOs are doing and what not LDCs.

    Respected Sir,
    I joined as LDC in the year 1988 and got promotion to UDC in the year 1993. After then I have not got any promotion. At present my grade pay is Rs.2400=00 and I am the only clerk in my institution to look after all the things. I always word hard and want to continue till my retirement. From the grade pay it seems unjustified in the grade pay. Another point is that if two U.D.C. join in the same day and one gets promotion to assistance durring December,2005 his grade pay will be 4200=00 whereas person having same responsibilities and same work load will get Rs.2400=00. Do you feel it is justice. Kindly look into the matter and give justice to all LDC and UDCs.

    My dear colleagues, (the entire clerical cadre)

    First of all I would like to thank my friend Kamaljit for his response and support vide his message dt 16/8/2010.

    The most vital issue here is that we, the clerical staff, have been making our submission before the Govt to consider the injustice done to this cadre by the VIth CPC and a further damage caused due to inception of the MACP Scheme. This comprises of two serious anomalies : (a) the grade pay being given to the LDCs and UDCs; and (b) grant of financial upgradation as per hierarchy under the MACP Scheme. Undeniably, both the above objections raised are absolutely legitimate, logical and justified but very unfortunately, our submission has not been able to draw the attention of the Govt or the members of the NAC so far. It seems that our submission has fallen into the deaf ears of both the authorities. Ultimately, this apprehension will lead to various consequencies even to the extent of moving a petition before the Hon’ble Tribunal on the ground of `violation of natural justice’.

    I, therefore, on behalf of the entire clerical cadre, hereby request the authorities to address the matter seriously at this stage for the sake of betterment of the cadre. The entire cadre is eagerly waiting with a hope of justice.

    I request the authorities to please consider the following points/demands in true spirits:-
    (a) Grant of grade pay of Rs 2400/- to the LDCs and Rs 2800/- to the UDCs.
    (b) Grant of financial upgradation in terms of promotional norms under the MACP Scheme and not on hierarchical manner.

    I would request my colleagues to respond on this issue promptly. (Subir, UDC, Agra)
