Subject:- Promotion to the grade of PPS.
Kum.Patricia D’Silva, presently serving as Senior Private Secretary (Group ‘B’) in the office of the PCDA (Navy) Mumbai has been approved for promotion to the grade of Principal Private Secretary (Group ‘A’) (Scale of pay Rs.15600-39100 + GP Rs.6600) on regular basis and posted to the office of the C.G.D.A., Delhi Cantt. The promotion shall take effect from 01.07.2010 or from the date of assumption of charge of the
2. The above named officer approved for the promotion to the grade of Principal Private Secretary will be on probation from the date of promotion and till the date of superannuation as the period of remaining service is less than two years.
3. The relief of the officer shall not be deferred on the ground that a representation has been submitted for change of place of posting or on the ground that reliever has not reported/been posted. It may be brought to the notice of the officer that no representation for change of posting etc. will be entertained in
4. TA and joining time as admissible under rules may be authorised to the officer.
5. The copies of Part II Office Order / Office Order notifying the officer’s relieving / assumption of charge on promotion and fixation of pay in the new grade may be endorsed to this HQrs Office.

Esteemed Sir,
With due respect and humble submission, I beg to draw to
your kind attention the following subject for your kind consideration
and lmpartial justice please.
That Sir, I had appealed before PIO cum Sr.DCM/APDJ under RTI Act’ 2005 seeking clarification, whether appointment as Goods Guard from Sr. Signaller in same identical scale(Rs1200-2040/-)is a promotion or not?
That Sir,PIO/APDJ has clarified that” my appointment as Goods Guard was a promotion and on this ground,I am not entitled to get the benefit of MACP”.
That Sir,I would like to mention here that as the Signaller category was going to be abolished from Rly due to modernization of Information technology,I was appointed as Goods Guard in 1989 after successfully completion of Guardship training and medical fitness.But I did not get any promotion/financial benefit on the plea, that it was an identical scale.Pay scale of Goods Guard merged with higher scale(Rs 4500-7000/-)as per recommendation of5th CPC and decision of Rly Board in 1996. Therefore,the Sr Signallers & Sr Comml.Clerks are getting promotion benefit after 1996 due to differences of their pay scale.
But Sir, my case is related with 4th CPC, when the pay scale of Sr Signaller and Goods Guard was equal i.e. Rs 1200-2040/-which was revised in 5th CPC Rs 4500-7000/-.After 19 years,Rly administration is treating it a promotion and I am being deprived from benefit of MACP also.Thus I have got only two promotion/financial benefit during my total service period of about 34 years.(First as Sr Signaller in 1980 and second as Sr Goods Guard in 1999). My superannuation date is 30/04/2011.The placement of Guard’s pay scale in higher grades consequent upon revision on administretive reason on account of implementation of 5th CPC recommendation which should not be construed as regular promotion.In fact,these are to be treated as mergers of higher grades on account of the decision of the 5th CPC.
Sir,I want to give an reference of Rly Board’s vide RBE No. 101/2009 dated 10/06/09-(Annexure-item 23):-
“In case,an employee is declared surplus in his organization and appointed in the same pay scale of pay in the new organization,the regular service rendered by him in the previous organization shall be counted towards the regular service in his new organization for the purpose of giving financial up gradation under the MACPS.”
In the year 1989,as per 4th CPC recommendation, pay scale of Sr Signaller and Goods Guard was equal i.e. Rs 1200-2040/-and I joined on same existing pay & scale.
In this context,I would also like to inform you that I was selected as Pass Guard in 2003,but again I was deprived on the same plea that it was Identical scale. Similar,when I upgraded as Sr Pass Guard in Scale Rs 5500-9000/- in 2007,but after 6th CPC,5000- 8000/- been again fixed in scale 5000-8000/- on 1/1/2006 and so again I lost the earned financial benefit.
That Sir, as it has been clarified by PIO/APDJ, that appointed as Goods Guard had been treated as an promotion,so I request you to either refixation of my pay should be done from date of my joining as Goods Guard or I should get the benefit of MACP,as I have got only two financial benefit(first as Sr Signaller in 1980 and second as Sr Goods Guard in 1999)during my service about 34 years.
Therefore,I request your kind honour to consider my case sympathetically and give me properjustice accordingly .
