Given below is the Record note on the meeting of Joint Committee on MACP held on 15.03.2011.

The third meeting of joint committee on MACP was held today i.e 15.03.2011. This meeting was held at the specific request by the Secretary Staff Side, National Council JCM to review the decision taken in the earlier meetings in which all items had been discussed.


Item Nos. 1,3,8,9 and 29:
Grant of financial up-gradation in the promotional hierarchy instead of grade pay hierarchy under MACP Scheme

      The Staff Side pressed this demand on the ground that the ACP 1999 had become a service condition in respect of all those who were in service as on 31st August 2008. The MACP Scheme being less advantageous could not be imposed upon them. They stated that to resolve this anomaly, the first 2 ACPs may be continued in the promotional hierarchy to be granted after 12 and 24 years of service from the date of induction, the third ACP on completion of 30 years service may be in the grade pay hierarchy. The official Side did not agree with this proposal. The Staff Side then pointed out that the introduction of MACP Scheme in grade pay hierarchy 10, 20, 30 years of service from the date of induction will result that certain cadres would be placed in the grade pay which are not sanctioned in the structure of the departments and therefore it can not be treated as career progression at all.

The official Side wanted the particulars of those cadres which are going to face this problem, so that they could consider how to overcome such anomalies. The Staff Side agreed to provide the necessary information and departments concerned may also be asked to provide such information.


Item Nos. 2, 10 and 48:

The Staff Side also pressed for introducing MACP Scheme with effect from 1.1.2006 so that those who did not get any benefit under old ACP could atleast get the MACP scheme benefit before their retirement during the period from 1.1.2006 to 31.8.2008. The Official Side stated that this item has been closed and concluded and can not be allowed to be opened / reviewed. The Staff Side then stated that they would like to raise this issue in the meeting of National Anomaly Committee as the joint Committee on MACP Scheme is sub committee of the National Anomaly Committee. The Official Side stated that this may be raised as afresh item in the National Anomaly Committee.

The Staff Side also wanted that the option to choose ACP or MACP should be given to the individual employees and not the Department. The Official Side also did not agree to reopen this issue which has been concluded in the last meeting.
  
Item No. 57:
Ignoring the placement of Artisans of Ministry of Defence from HS grade II to HS grade I for the purpose of MACP Scheme.

The Staff Side pointed out that this restructuring by keeping 50% of Artisans in the HS grade I and placing 50% in the HS grade II was by way of placement and therefore it could not be treated as promotion. The Staff Side cited Supreme Court ruling to this effect. However the Official Side did not agree with this. The case of restructuring in IA & AD in 1984 and in organized accounts were also cited in which it was clearly stated that those who are in the higher grade would be treated as placement only those who are promoted later on against vacancies would be treated as promotion. The official Side view was that only in those cases where the entire cadre is placed in the higher pay scale it would not be treated as promotion. This matter will also have to be raised in the meeting of National Anomaly Committee.
  
Items Nos. 11, 15, 22, 39, 47 and 51:
Promotion in identical Grade Pay.

  
The decision that the normal promotions are in the same grade pay, they cannot be ignored for purpose off MACP Scheme and the specific cases would be examined separately.
  
Item Nos. 12, 30 and 49:
Employees appointed limited competitive examination from lower to higher post may treated as direct recruits in the higher post ignoring the service in the lower posts.

  
The matter is still being considered with reference to old ACP scheme clarification.
  
Item Nos. 13, 32, 38, 44, 50 and 58:
Counting of old service in the new establishments for the purpose off MACP. And
Item Nos. 21, 27, and 28:
Benchmark for financial up gradation under MACP.

  
Orders have been issued on 1.11.2010.

    To start with,

    A National Anomaly Committee (NAC) was constituted by the Govt to look into and rectify the anomalies in the 6th Central Pay Commission report. Eventually, the tenure of the NAC was extended up to 31/3/2011. What next?

    Q1. What is the present status of the NAC constituted for the 6th CPC – still existing, held in abeyance or disappeared like smoke at its own after 31/3/2011? Any official communication issued in this regard?

    Q2. What is the outcome of the anomalies which were related to the 6th CPC and were brought out before the NAC for consideration and rectification and are still existing unsettled?

    Q3. The NAC was earnestly requested to consider enhancement of grade pay being given to the LDCs and UDCs justifiably and in correct perspective. What is the outcome of this point – turned down or quarantined?

    Any answer to the above questions?

    The Govt employees who are actual tax payers on record, their legitimate and justified demands will never be heard/accepted by the competent officials under the Govt. Simple reason – they have limited approach to protest. The low paid category employees under the Govt are compelled to lead a stressful and socially incompetent life.

    The grant of financial up gradation in the promotional hierarchy instead of grade pay hierarchy under MACP is again discussed in the Joint committee of MACP held on 15.03.2011. As per record note , the Official Side wanted the particulars of those cadres which are going to face the problems.
    In this regard, I want to draw the attention of National Council /JCM to review the decision taken in the earlier Meetings in which this issue was discussed. In the RPF a grade Pay of 4800/-which is not at all existing in the structure/promotional hierarchy of RPF but even then MACP is granted to the Inspectors in the GP of 4800/- by the Zonal HQ/RPF /N.Rly ignoring the promotional hierarchy vide letter no 752-E/1/61-Insp/RPF/Pt-II Dt 21.02.2011. This grant of MACP is not a carrier progression at all. The carrier progression should have been given in the same avenue in which they belong to in the department. The GP 4800/-is given to the technical staff or other Supervisory staff of Railways. To resolve this anomaly in MACP for Constable to Inspectors /RPF, it must be granted in the existing GP of departmental promotional hierarchy .i.e. 2000, 2400, 2800, 4200, 4600, 5400(PB-3 ASC).The MACP implemented as per GP hierarchy w.e.f. 01.09.2008 is clear violation of Natural Justice.

    It can be seen on the present site that so much of agony and dissatisfaction has been expressed by the employees in various posts/trades on the anomalies created by the VIth CPC and due to introduction of the MACP Scheme. The NAC was constituted to address the anomalies and eventually the tenure of the NAC has ended on 31/3/2011. The anomalies still remains as it was and the existence of NAC is in abeyance. The Govt is least bothered to pay the legitimate salary/allowances to the employees who are, in fact, paying the income tax as for their income on record. Such lapses on the part of the Govt leads to serious consequences on the functional and competence aspect of employees. It’s the high time that the Govt should realize that injustice to the employees will not be tolerated and this may take the shape of mass revolution as protest, causing adverse affect on various levels.

    DEAR SIR
    I am junior engineer since my joining date 20-10-1984 in S&JJ deptt. Now Delhi Urban Shelter Improvement Board (DUSIB) Govt. NCT ,Delhi. IN 6TH CPC THEIR ARE SO MANY ANOMALIES WHICH SHOLD BE REMOVED. GP SHOULD BE PROPOTIONATELY increased eg in the pay scale of 5000-8000 all (whose BP 5000&those Bp7850)get the same GP.INCREMENT SHOULD BE 5%.IN MACP IT IS worsen than OF PREVIOUS ACP. IN MACP JE WILL GET GP FROM 4200 TO 4600 TO 4800 TO 5400 WHILE OTHER (JOIN BEFORE 31-8-1984) WILL GET 4200TO 4600 TO 6600 TO 7600.HOWEVER THEY PERFORM THE SAME DUTIES WHICH IS AGAINST THE GOVT OWN POLICY.SAME WORK&POST BUT SALARY DIFFERENCE ABOUT Rs 6000/-WHICH WILL BE UP TO 15000/-AND TOTAL LOSS OF ABOUT Rs 30 LAKHS. In 2 nd ACP the scale jumps from 8700 in 6500-10500 to 10000 in 10000-15200 gain of Rs1300+DP+allowances while in 2 nd MACP GP jumps 200(4600 to 4800) only. Instead of increases by 1.86+GP it losses. Is it justified? ENGINEER SHOULD GET 25%AS TECHNICAL ALLOWANCE. THE PREREVISED PAY SCALE OF7450 SHOULD GET POINT TO POINT INCREMENTS. THE GP OF 7450 SHOULD BE IN THE SAME RATIO OF 5000 SCALE IE APPROXIMATE BE 6000/ SIR YOU ARE REQUESTED TO LOOK THE MATTER SERIOUSLY TO PREVENT JEALOUS & HATRED AMONGST EMPLOYEES .AND ALSO I HAD NOT GOT THE PROMOTION SINCE JOINING (20-10-84)THOUGH I AM ELIGIBLE AND FIT FOR PROMOTION SINCE 13-09-88.It is suggested that in MACP Of 10-20-30 should be amended to 12-24-30 with same PB&GP as promotional for 12-24 and for 3rd macp after 30 may be next GP of hierarchy for all, does not violate the rule same post same work same salary as against 10-20-30. It is prayed/appealed to look into genuine anomaly and do the justice.

    In 6th CPC higher categories and lower categoties were benefited,whereas clerical category is ignored. There is great in justice and financial loss IN GRANTING ACP/MACP especially to LDC AND UDC categories. Which may please be looked in to and early relief be granted.
