NATIONAL ANOMALY COMMITTEE MEETING CONCLUSIONS AND DISCUSSIONS

     Sub:- National Anomaly Committee Meeting held at North Block, New Delhi on 27.3.2010

      Conclusions on important issues pertaining to Anomalies as a result of discussions in to-day’s meeting are mentioned below:-

1. Anomaly due to postponement of increment in the case of those whose increment has fallen from February to June, 2006:

After discussions, it was agreed to issue orders for rectifying the anomaly. We have suggested that in all those cases the annual increment may be pre-dated to 1.1.2006. We are hopeful that order as demanded will be issued.

2. Various aberrations in the Modified Assured Career Progressive Scheme (MACPS):-

The Chairman of the National Anomaly Committee has decided to constitute a Joint Committee to deal all such aberrations and submit its report for the Government to take decision. Very soon a Joint Committee will be constituted. Affiliates are free to furnish the deficiencies of the scheme to NFIR immediately.

3. Junior drawing higher pay than the Senior :-

The Chairman has advised Railways to collect data and furnish to DOPT and Ministry of Finance for taking appropriate corrective steps.

4. Health Insurance Scheme recommended by VI CPC – Implementation of the recommendations:-


The Chairman has assured that without prior consultations, the scheme shall not be finalised and allowances such as Risk Allowance, Patient Care Allowance etc. will continue till the final decision is taken.

5. VI CPC pay fixation – Grant of another option to the staff:-

The Chairman said that the proposal for delegation of powers is under process and very soon this will be finalised.

6. Revision of medical allowance to the Pensioners :-

Under consideration. The issue is now before the Committee of the Secretaries. The Chairman has assured to see that processing is speeded up.

7. Denial of increment due to absence without pay:-

We have explained the grave implications of the Government’s. decision and demanded that the increment should be granted when the employee has put in six months qualifying service in a year. It was agreed to consider and rectify the anomalous situation.

    What about the UMF and parity between the staff of field offices and Secretariat. These are the top most issues which are to be resolved.

    pay scale Rs 12000-16500 in pay band 3 that is Rs.15600-39100 with pay grade Rs 7600 and pay scale Rs.14300-18300 is given pay band 4 that is Rs.37400-67000 with grade pay Rs.8700. and net diference in pay is Rs.22000. In the fifth pay commission this diference was only Rs.2300. How this govt will remove this much diference. It means the diference of rs 2300 turned into Rs 22000

    Respected Sir,
    Ministry of Railway issued a letter on 30-03-10 regarding to new pay structure of Pharmacist,according to the letter Entry Grade of Pharmacist will be Rs.2800 and after completion of 2 yrs it will upgraded in the G.Pay of Rs 4200.I would like to know,will this upgradation treated as promotion or it will be simple upgradation.

    R/ Sir,
    As per Notification the Gazette of India: Extraordinary of Ministry of Finance/ 3255/61/08-6A New Delhi, the 29th August 2008. Page No. 47.

    There is an anomaly in the post of Trained Graduate Teacher (TGT) as follows:-

    1. In the Notification of 6th Pay Commission Rules it has given for TGT in Grade I i.e. selection Grade with scale 8000-13500, Grade Pay 5400 and Pay band -2(9300-34800).

    2. But, In the Notification of 6th Pay Commission Rules it has given for PGT in Grade II i.e. Senior Grade with scale 8000-13500, Grade Pay 5400 and Pay band -3(15600-39100).

    3. While TGT Grade- I i.e. selection Grade, which is granted after (10+8) =18 years residency period in the same post TGT and PGT Grade –II i.e. senior Grade, is granted after 8 years residency period in the same post PGT, is always same in scale and financial benefits. It was even same treated in the rules of 5th Pay Commission.

    4. In the Notification of 6th Pay Commission Rules it has given for TGT in Grade I i.e. selection Grade and PGT Grade –II are equal in the scale 8000-13500 and Grade Pay 5400 But not equal in Pay band. It is clear as below;

    So, TGT Grade –I is in PB- 2 (9300-34800) while PGT Grade –II is in PB-3 ( 15600-39100) Why ? This is an anomaly.
    5. Even then this anomaly was already corrected in the recommendation reports of 6th Pay Commission ,issued on 4.4.2008, on the page No. 217 section 3.8.22. The following table is the copy of the page.

    Dear Shri.Raghavaiah Sir,
    May I request you sir, for your valuable advice on the point or get it clarified from Government.

    1. Sub: Regulation of Pension in the case of an employee from Central Autonomous body appointed on immediate absorption basis in Central Government service.
    An employee having 17 years of service in a permanent capacity in a Central Government Autonomous body (Pensionable service), applied for a direct recruitment post under the Central Government service through proper channel. On selection, he submitted technical resignation from the Central Autonomous body and joined the Central Government service in August 1989 on immediate permanent absorption basis.
    For the service under the Central Autonomous body, he was granted pro-rata pension and gratuity from the Pension Fund constituted and maintained by the Autonomous body. In accordance with the option available at that time, he drew 100 % lumpsum payment in lieu of pension. The employee is therefore not entitled to count the qualifying service under the Autonomous body as qualifying service under the Central Government for pension. On completion of 15 years, one-third of the pension was restored to him.
    The officer has now completed 22 years of qualifying service under the Central Govenment service and is retiring next month. As per the latest orders, issued by the Government of India based on the recommendations of the Sixth Pay Commission Report, those who have completed 20 years of qualifying service is eligible for full pension at 50 % of the Average emoluments or the last pay + Grade Pay, which ever is higher.
    In this case, is he not eligible for the full pension from the Central Government Office as he has completed more than the minimum qualifying service of 20 years in the Central Government OR
    Is there any specific orders/Rule for restricting it or linking it to the pension he was granted for the pension received from the Autonomous body ?
    Kindly enlighten.

    in the case of extra-ordinary leave, if a employee is on EOL even if 1 day more than 6 months. his next increment is postponded for next year. such anamoly should be removed.

    Sir,

    I am a stenographer, Grade-III since 11 years no promotion was given to me luckily MACP was given but not in the promotional grade pay. Will the MACP clear the questions raised by the employees. The seniors are more benefited because they got revised their scale in ACP and MACP but we are unlucky that we are getting only 2400 to 2800 gp which is injustice to us. Atleast we must be given our promotional Gradepay. Please rectify this problem Sir. Thanking you.

    Sir,
    Did the second anmoly comittee decission are announced whn they are expected. Increment predating to 1.1.06 whchich are fallin between feb and june 06.

    Respected Sir,
    I am drawing kind attention of all concerned towards the shortcomings of 6th CPC that may kindly be forwarded to the representatives of staff side for consideration and discussion at National Anomaly Committee, if not taken up so far.

    That I was drawing Rs.4135/- in my pre-revised pay scale Rs.3200-85-4900; i.e 11 incremental stage

    above minimum pay of my pay scale. My pay scale has been upgraded to Rs.4000-100-6000 by the 6th CPC. Still then my pay has been fixed at Rs.7700 + 2400 (GP) = Rs.10400 with DNI on 1st of July 2006 which was previously 1st of February.

    The clinching point to be noted here that a new entrant supposed to be recruited in my post would have drawn Rs.7510 + 2400 (GP) = Rs.9910, just Rs.190 less from my pay as on 01.01.2006. Is it justice for an older employee who has earned 11 increments in his pre-revised pay scale ? So far the rules covering stepping-up is concerned it can be implemented subject to following condition as per FRs.

    a) Both the junior and senior officers should belong to the same cadre and the posts in which they have been promoted or appointed should be identical.

    b) The scales of pay of the lower and higher posts in which they are entitled to draw pay should be identical.

    c) The anomaly should be directly as a result of the applications of FR-22 C.

    In view of the above I am anxious to know whether there is any agenda point on this issue before the NAC. So far my little knowledge is concerned, there was a provision in 5th CPC vide third proviso to Rule 7 that “The fixation shall ensure that every employee will get at least one increment in the revised scale of pay for every three increments (inclusive of Stagnation Increment(s), if any) in the pre-revised scale of pay.

    Therefore, it is requrested that, if any gentleman or lady finds my point genuine then please forward it to the representatives of staff side for putting this matter before National Anomaly Committee for remedy or please mail me the address of the representatives of staff side enabling me to put forth my suggestion.

    Respected Sir,
    I want to draw your kind attention towards the matter.I joined indian railway in 14/8/1996 got my promotion as Travelling Ticket Examiner in april 2000 ,as per the revised pay in 6th CPC now i am in grade pay of 2400 as per MACPS now getting the grade pay of 2800 which i think is injustice because 2800 grade pay is not in our cadre(TTE), our next promotional grade pay is 4200 that is Head TTE,if i’m getting the financial benifit of next promotional grade i should be getting 4200 grade pay .

    What about the orders on increment for Anomaly due to postponement of increment in the case of those whose increment has fallen from February to June, 2006:
    as stated in para 1 of your letter bearing No. IV/NC/JCM/NAC/09 dated 27.3.10 (published above). It is August 2010 now and we are still waiting for it. Lakhs of employees like me will give you blessings if you got these orders issued at an early date.
