EXCERCISING FR22(I)(a)1 OPTION: On 6th CPC recommendation
  
In Central Government employees, who have been Promoted / granted upgration under ACP scheme, everyone has to submitted an option form according to the rule of FR22(I)(a)1 to selected either Promotion Date or Increment Date.
  
At the time of promotion every individuals selected the option their own convenience of the next increment date.
  
On implementation of VI CPC recommendations, the FR22(I)(a)1 rule has been modified and published by DOP&T on 13.10.2008. The new FR22(I)(a)1 rule says,
  

           
Clarification 1: The date of next increment
  
(i) As per Rule 10 of CCS(RP) Rules, 2008 there will be one uniform date of annual increment, viz. 1st July of every year. Government servants completing 6 months and above in the revised pay structure as on 1st
of July will be eligible to be granted the increment. Accordingly, all Government servants who earned their last increment between 02.01.2005 and 01.01.2006 would get their next increment on 01.07.2006.
  
(ii) For those employees whose date of next increment falls on 01.01.2006, the instructions already provide for granting an increment in the pre-revised pay scale as on 01.01.2006 and then fixing their pay in the
revised pay scales. Such Government servants would also get their next increment on 01.07.2006.

  
Clarification 2 : The method of fixation of pay on promotion after 01.01.2006
  
On promotion from one grade to another/financial upgradation under ACP, a Government servants has an option under FR 22(I)(a)(1) to get his pay fixed in the higher post either form the date of his promotion,
or from date of his next increment, viz. 1st July of the year. The pay will be fixed in the following manner in the revised pay structure:-
  
a) In case the Government servant opts to get his pay fixed from his date of next increment, then, on the date of promotion, pay in the pay band shall continue unchanged, but the grade pay of the higher post will
be granted. Further re-fixation will be done on the date of his next increment i.e. 1st July. On that day, he will be granted two increments: one annual increment and the second on account of promotion. While
computing these two increments, basic pay prior to the date of promotion shall be taken into account. To illustrate, if the basic pay prior to the date of promotion was Rs.100, first increment would be computed
on Rs.100 and the second on Rs.103.
  
b) In case of Government servant opts to get his pay fixed in the higher grade from the date of his promotion, he shall get his first increment in the higher grade on the next 1st July if he was promoted between 2nd July and 1st January. However, if he was promoted between 2nd January and 30th June of a particular year, he shall get his increment on 1st July of next year.
  
Clarification 3: Use of fitment tables for cases of pay fixation under Rule 11 of CCS (RP) Rules, 2008
  
Rule 11 of CCS(Revised Pay) Rules, 2008 provides for fixation of pay in the revised pay structure subsequent to the 1st day of January, 2006. When the pay of a Government servant will be fixed as per Rule 11 on
a date subsequent to 01.01.2006, the fitment tables annexed with this Department’s O.M. of even number dated 30.08.2008 will be used as prescribed in the relevant provisions contained in para 2 of the O.M.
The pre-revised pay to be reckoned in such cases will be the pay of the Governement servant on the day of such fixation.
  
(iii) In the revised pay structure, the pay of a government servant would be regulated in the following manner on grant of proforma promotion to him under ‘Next Below Rule’.
  
(a) In case a Government servant on deputation to a post gets promoted in his cadre to a post in a higher grade, his pay in the pay band will be fixed with reference to the pay in the pay band of the employee
immediately junior to him in the cadre of his service. However, the government servant in question would continue to draw the grade pay attached to the deputation post for the remaining duration of the
deputation.
  
(b) In case a Government servant on deputation to a post in PB-4 gets promoted in his cadre to a post in HaG+, his basic pay will be fixed with reference to the basic pay of the employee immediately junior to him
in the cadre of his service, but the total of pay in the pay band and grade pay of the deputation post will not exceed Rs.79,000.
  
(c) In case a Government servant on deputation to a post in PB-4 gets promoted in his cadre to a post in the apex scale, his basic pay will be fixed with reference to the basic pay of the employee immediately
junior to him in the cadre of his service, but the total of pay in the pay band and grade pay of the deputation post will not exceed Rs.79,000.
  
(d) In case a Government servant on deputation to a post in HAG+ gets promoted in his cadre to a post in the apex scale, his basic pay will be fixed with reference to the basic pay of the employee immediately
junior to him in the cadre of his service.
  
Clarification 6 : Procedure for placing employees in upgraded scales in case of merger of scales/upgradations recommended by the Sixth CPC.
  
(i) Where all posts in one or more pre-revised scales are merged with a higher pre-revised scale and given a common replacement scale/grade pay, the suitability of the incumbents need not to be assessed for
granting them the higher replacement scale/grade pay and the incumbents will automatically be granted the replacement pay scale/grade pay recommended by the Commission. Their pay will be fixed in the
accordance with the fitment table annexed to this Department’s O.M. of even number dated 30.08.2008.
  
(ii) Similarly, in the case of upgradations recommended by the Pay Commission, i.e. where all posts in a particular grade have been granted a higher replacement pay scale/grade pay, the suitability of the
incumbents need not be assessed for granting them the higher replacement scale/grade pay. The incumbents will automatically be granted the replacement pay scale/grade pay recommended by the Commission.
Their pay in the pay band will be fixed with reference to their fitment table corresponding to pre-revised pay scale. However, the grade pay corresponding to the upgraded post will be granted.
  
Note: CCS(Revised Pay) Rules, 2008 define the term “basic pay” in the revised pay structure as the pay drawn in the prescribed pay band plus the applicable grade pay but does not include any other type of pay like special pay, etc. In the case of Government servants in the pay scales of HAG+ and above, basic pay means the pay in the prescribed scale.

    Dear Sir
    I will be highly obliged if someone clarify following disputes arise in my service with specific order no. of DOPT.
    1) I was appointed on 1980 as LDC and a promotional offer came on 1988 but I did not accept the said promotion. Therfore I was debared on 1989.(1st debared period)
    2) Same offer again came on 1990 and I refused. Again I debarded on 1991 (2nd debared period)
    3)Once again same offer again came on 1992 and I refused. Again I debarded on 1993 (3rd debared period)
    4) 1994 again I got another offer and I accepted it as UDC.

    Therfore I am working as UDC since 1994 and no promotion has to me afterwards. 1998 in 5th CPC the ACP scheme was introduced, So I am eligible for 2nd ACP in the year 2004 (24 yrs.) because I have joined on 1980.
    But my office has debarded me for 3 yrs, therfore I have got 2nd ACP on 2007. Afterward 6th CPC has come and New MACP scheme has introduced. According to 6CPC now I am entitled to get 3rd MACP on 2010 but again office is calculating those debared period.
    That means I am geeting three times penalty against each refusal. So far my knowledge according to Indian constutution there should be one punisment against every violation/disobey the rule. Not even that my refusal is well before the ACP scheme was introduced.
    Please guide me for my future course of action

    dear sir,
    i joined as an inspector on dec.1990 in the deptt.of customs & central excise.my ACP was due in 17-12-20-02.But undergoing disciplenary proceedings this will not granted to me.I was suspended by the deptt. in sept.2001 and chargesheed issued to me almost in sept.2002. after inquiry the inquiry authority submit their report on 28-02-2006 and i was not found guilty.but Disciplinary Authority did not agree with report of I.O. and i was penalised and accordingly order that my pay was reduced by two stages from Rs.7900/-to Rs.7500/-in the time scale of Rs6500/-200-10500/-for the period of four year with effect from the date of order i.e.12-03-2007 and will not earn increments of pay during the period of reduction and that on expiry of this period the reduction will have the efferct of postponing his future increments of pay.Then i filed appeal before Commissiner and in his order he stated that monetary consideration has not been proved in the case,accordinglyI reduce the period of penalty from four years to three years and after expiry of three years, the reduction eill not the effect of postpoing on his future increments of pay. My penalty was expired on 12-03-2010. and i am promoted as Superintendent with effect from 12-03-2010.
    Now my question is that : do i intitle for ACP as due on dec.2002.If not. Kindly clerify my position as on date.

    My basic pay has been fixed less than my junior stating reason that I have opted to be fixed my pay wef 01 Jul and my junior wef 01 Sep. Has there been any rule fixed by VI CPC under which a junior can be fixed at higher pay than his senior in any circumstances? I would wait for your reply on my e-mail.

    dear sir,
    i have a querry on stepping up of pay when junior draws more than his senior on promotion after 01 jan 2006. my junior is getting more pay than me on his promotion on 13 dec 2006. when i represented fr stepping i have been told that promotion of junior is not identical to me. my contention is that junior has been promoted in same pay band and same payscale then what other things are required.

    sir Iam working incometax department in hyderabad.i joined the it dept in 1990 and in the year 1998 i went to kolkata as my husband got transferred to that place, on own intrest on intercharge transfer in the year 2005 i came back to the same department as tax assisstant. in year 2009 december i got promotion as senior TA i.e. with pay 9300 – 34600 with a grade pay on 4200. is there any chance of getting my seniority back. I have cleared ITI’s departmental examination and ITO’s examination also. Unfortunaately I am in the cadre where I have joined even after 20 years of service.Initially I joined the department as LDC and in the year 1994 I was promoted as UDC all my batchmates are promoted as ITIs. please advise

    Sir, I have joined in Employees provident fund organisation on 15.11.99 as Data entry operator grade-A in the pay scale of Rs.4000-100-6000/-(Grade pay of Rs.2400/-in PB-1 as per 6th cpc). But now the post of Data entry operators grade-A,B&C have been converted in the post of Data processing assistants in pre-revised pay scale of Rs.6500-200-10500/- or granted grade pay of Rs.4600/-in PB-2 w.e.f. 30.05.09.In that case,Only Grade pay of Rs.4600/- has been exercised. Neither the increment of 3% for upgradation/promotional nor the entry pay scale of Rs.17140/-has been exercised. However, the Pay Band and Grade Pay (from PB-1 to PB-2) have been changed. Whether will I get one increment of 3% on conversion of post or initial pay scale of Rs.17140/-including Grade Pay of Rs.4600/-.

    Sir,

    I am a Stenographer promoted vide order dated 29.8.1996. I received the order late in September 1996 and I joined the post on 8.9.1996. However, while benefits under ACP were granted, my name was omitted in the list. I could not assume the post on or before 31.8.1996 due to belated receipt of the order. Three of my colleagues, in the same order, who were posted in the same place assumed the charge as Stenographer before 31.8.1996 and their GP is fixed @Rs.4200/- under the erstwhile ACP. Now I am given the benefits under MACP fixing the GP @Rs.2800/-. I am of the opinion that my representations were not properly considered by our Administration for no fault of mine. Please clarify the situation.

    Sir,

    I am working in Employees P.F.Organisation as DEO(Grade-B) in the old pay scale of Rs.4500-125 (Present Grade pay Rs.2800 as per the VI CPC). Recently in our Organisation all the DEO’s(Grade-A,B,C) were CONVERTED to Data Processing Assistants(DPA) in the pre-revised pay scale of Rs.6500-200 with effect from 30.05.2009 (Grade pay of Rs.4600). Though the conversion of DEO’s to DPA’s were made in batches, all the conversions would become effective only on reporting at the new place of posting. The conversion is notionally effective from 30.05.2009, the date of notification of the recruitment rules of DPA.

    I was converted to DPA in the second batch and I accepted the place of posting and joined on 01.07.2010 though my conversion order clearly states that the conversion would be effective from 30.05.2009 on reporting at the new place of posting.

    Now I have been given the new Grade Pay of Rs.4600/-. My doubt is whether my pay will be fixed as per FR 22 1(a)1 or
    22 1(a)2 or whether I will be given an initial fitment of
    Rs.12540+4600 as will be done for a new direct recruit DPA as per the VI CPC recommendations. Whether I am eligible for arrears from 30.05.2009? and if yes, with what pay and grade pay? Please clarify.

    Respected Sir,
    I joined Govt. as Accounts Clerk and promoted on merit after passing the examination to Accountant and after 3 years I promoted as Sr. Accountant in AG’s Office. Simultaneously I appeared for Section Officers Exam and passed in 1993 and appointed as Section Officer. Now after 6th pay commission this post treat as Assistant Accounts Officer. In our office the hierarchy of post are Accounts Clerk, Accountant, Sr. Accountant and Supervisor. Section officer post only granted on clearance of SOGE. Now I completed 17 years in one post and I denied MACP. All my juniors granted the Grade Pay Rs. 5400/- Myself and some college’s are deprived the promotion. This financially and mentally weaken us. Please help.

    I have been appointed as LDc in 1974.After passing the SAS Part I I was granted promotion to the Grade Of Auditor in 1985 on the basis of passing SAS Part I.After passing SAS PART II in 1987 I was promoted as SO{A} in 1991 and AS AAO in 1996, In 2007 I was appointed as AO . I have the opinion that I have been granted two promotions in the entire service that one for SO{A} and AAO and the second for AO. Please confirm that I am entitled to upgradation under MACP on completion of thirty years of sevice wef 1-09-2008 as I consider that my promotion from Clk to Auditor on passing SAS PART I is not to be treated as promotion for benifit under MACP Pl Clarify
