Subject: MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS) FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES – CLARIFICATIONS REGARDING.

           The undersigned is directed to invite reference to the Department of Personnel and Training Office Memorandum of even number dated the 19th May, 2009 regarding the Modified Assured Career Progression Scheme (MACPS). Consequent upon introduction of the Scheme, clarifications have been sought by various Ministries / Departments about certain issues in connection with implementation of the MACPS. The doubts raised by varlous quarters have been duly examined and point-wise clarifications have accordingly been indicated in the Annexure.


2 The MACPS should strictly be Implemented in keeping wlth the Department of Personnel and Training Office Memorandum of even number dated 19/05/2009 read with the aforesaid clarifications (Annexure).


3. All Ministries / Departrnents may give wide circulation to the contents of this O.M. for general guidance and appropriate action in the matter.

1.	1 Whether the Pay Band would change in the hierarchy of Pay Bands & Grade Pay on grant of the benefits under MACPS?	Yes. The upgradations under MACPS is to be granted in the immediate next higher grade pay in the hierarchy of recommended revised pay (band and grade pay as prescribed in the CCS, (RP) Rules, 2008.
2.	Whether the benefits of MACPS would be allowed to the Government servants who have been later on inducted in the Organized Group “A” Service	No. The benefits under MACPS is not applicable to Group ‘A’ officer of Organised Group ‘A’ Services, as the officer under Organized Group ‘A’ Services have already been allowed panty of two years on non-functional basis with the officers of Indian Administrative Service (IAS)
3.	How will the benefits of ACP be granted if due between 01.01.2006 and 31.08.2008?	The new MACPS has come into existence w.e.f. 01.09.2008. However, the pay structure has been changed w.e.f. 01.01.2006. Therefore the previous ACPS would be applicable in the new pay structure adopted w e f . 01.01.2006. Para 6.1 of Annexure-1 of MACPS is only for exercising option for coming over to the revised pay structure and not for grant of benefits under MACPS. The following illustrations would explain the position: (A) In the case of isolated post: Date of appointment in entry Grade in the pre-revised pay scale of Rs.4000-6000: 01.10.1982 1^st ACP granted on 09.08.1999 : Rs.4500-7000 (pre-revised) 2^nd ACP due on 01 10 2006 : Rs.5000-8000 (pre-revised) [revised PB-2 Grade Pay of Rs.4200] 3^rd financial upgradation under the MACPS would be due on 01.10 2012 (on completion of 30 years of continuous regular service) in the immediate next higher grade pay in the hierarchy of recommended revised pay band and grade pay i.e. Grade Pay of Rs.4600 in PB-2. (B) In the case of normal promotional hierarchy: Date of appointment in entry Grade in the pre-revised pay scale of Rs.5500-9000: 01.10.1982 1^st ACP granted on 09.08.1999 : Rs.6500-10500 (pre-revised) 2^nd ACP due on 01.10.2006 (as per the existing hierarchy) : Rs.10000-15200 (pre-revised). Therefore, 2^nd ACP would be in PB-3 with Grade Pay of Rs.6600 (in terms of hierarchy available): 3^rd financial upgradation under MACPS would be due on 01.10.2012 in the immediate next higher grade pay in the hierarchy of recommended revised pay band and grade pay of Rs.7600.
4.	Whether the benefits of MACPS would be granted from the date of entry grade or from the date of thew regular servlce/approved service counted under varlous service rules	The benefits under MACPS would be available from the date of actual joining of the post in the entry grade.
5.	In a case where a person is appointed to an ex-cadre post in higher scale on deputation followed by absorption. whether the period spent on deputatlon perlod would be counted as continuous servlce in the grade or not for the purpose of MACPS	(i) Where a person is appointed on direct recruitment/deputation basis from another post in the same grade, then past regular service as well as past promotions/ACP, in the earlier post, will be counted for computing regular service for the purpose of MACPS in the new hierarchy. (ii) However, where a person iS appointed to an ex-cadre post in higher scale initially on deputation followed by absorption, while the service rendered in the earlier post, which was in a lower scale cannot be counted, there is no objection to the period spent initially on deputation in the ex-cadre post prior to absorption being counted towards regular service for the purposes of grant of financial upgradation under MACPS, as it is in the same Pay band/grade pay of the post.
6.	Whether the pay scale/grade pay of substantive post would be taken into account for appointment/selection to a higher post on deputation basis or the pay scale/grade pay carrying by a Government servant on account financial upgradation(s) under ACP/MACP Scheme	The pay scale/grade pay of substantive post would only be taken into account for deciding the eligibility for appointment/selection to a higher post on deputation basis.
7.	In a case where 1^st/2^nd~ financial upgradations are postponed on account of the employees not found fit or due to departmental proceedings, etc. whether this would have consequential effect on the 2^nd/3^rd financial upgradation or not.	Yes. If a financial upgradation has been deferred/postponed on account of the employee not found fit or due to departmental proceedings, etc.. the 2^nd/3^rd financial upgradations under MACPS would have consequential effect. (Para 18 of Annexure-1 of MACPS referred).
8.	In a case where the Government servant have already earned three promotions and still stagnated in one grade for more than 10 years, whether he would be entitle for any further upgradation under MACPS	No. Since the Government servant has already earned three promotions, he would not be entitled for any further financial upgradation under MACPS.
9.	Whether the pre-revised pay scale of Rs.2750-4400 in respect of Group ‘D’ non matriculate employees, would also be taken as merged to grade pay of Rs.1800 for the purpose of MACPS in view of merger of pre-revised pay scales of Rs.2550-3200, Rs.2610-3540, Rs.2610-4000 and Rs.2650-4000, which have been upgraded and replaced by the revised pay structure of grade pay of Rs.1800 in the pay band PB-1.	Yes
10.	If a Govt Servant on deputation earns upgradation under MACPS in the parent cadre, whether he would be entitled for deputation (duty) allowance on the pay and emoluments granted under the MACPS or not?	No. While eligibility of an employee for appointment against ex-cadre posts in terms of the provisions of the RRs of the ex-cadre post will continue to be determined with reference to the post/pay scale of the post held in the parent cadre on regular basis (and not with reference to the higher scale granted under ACPS/MACPS). such an officer, in the event of his selection, may be allowed to opt to draw the pay in the higher scale under ACP/MACP Scheme without deputation allowance during the period of deputation, if it is more beneficial than the normal entitlements under the existing general order regulating pay on appointment on deputation basis.
11.	Since the pay scales of Group “D” employees have been merged and placed in the Grade Pay of Rs.1800, whether they are entitled for grant of increment @ 3% during pay fixation at every stage.	Yes. On the analogy of point 22 of Annexure-1 of MACPS, the pay of such Group “D” employees who have been placed in the Grade Pay of Rs.1800 w.e.f. 01.01.2006 shall be fixed successively in the next three immediate higher grade pays in the hierarchy of revised paybands and grade pays allowing the benefit of 3% pay fixation at every stage.

Grade Pay 5400 is two Pay Bands PB2 & PB3. Currently if i an in GP 5400 PB2, what should be my new Grade Pay as a reslult of MACP. Should it be 5400 of PB3 or 6600 of PB3. The new clarification seems to suggest 6600 of PB3. Any comments/suggestions ? thanks

Sir in my dept (Mnistry of Home affairs) the promotion structure is Hav/Clerk( Pay scale 3200/-), Nb Sub/Clerk(5500/-), Sub/Clerk(6500) and Sub Maj Clerk as per our Rect Rules. Now the question is dept has given the promotion to some staff and ACP (as per 5 th CPC) from 3200 to direct 5500. As there is no rank structure in between 3200 to 5500. As on date also there is no any rank structure in between Havildar/clerk to Nb Sub/Clerk(i.e Grade pay 2400 to 4200). Request confirm what what will be the grade payin my case. I have completed 16 years of service. ACP on completion of 12 years has not been gtd to me. Under MACP scheme Ist MACP has been gtd (2800) wef 01 Sep 2008. Request clarify am I eligible for Basic pay for Rs.5500/- under ACP scheme after completion of 12 years of service.

I am staff Nurse working in Safdarjung Hospital joined in year 1992 sept. in the scale 5000-150 and we got promotion in the year 1996 5500-175 and we completed 10 year of service in the year 2006. We didn’t got our new upgraded pay band Rs.5400/- the same time other hospital under central govt. hospitals like lady hardings and kalawati staff got new pay band @ Rs.5400/- Why the same central govt.hospital staff (safdarjung hospital) is not paying the payband grade.

Further all allowances are doubled but as on today the icu allowance is not dobled in hospital. we are getting same Rs.120 as per recomendation of 5th pay commission.

please calryfy the same.

As per recent DoPT clarification dtd. 9.9.10, is it true that the upgradations to the next higher grade pay when reaches to the next pay band as recommended by Sixth CPC it should be declared as next pay band [(i.e) for MACP II, if the grade pay is Rs.4200/- it should be in pay band II only]

Sir i am employee of indian railway and i had joined in 1975 as group D employee with pay scale of 2550-3200 than i have got promoted in 1992 with pay scale of 3050-4590, after that promotion i have earned a another promotion in the year 2009 with grade pay of Rs. 2400/-. Now i have completed my 35 years of service in railway, i ask you one thing that which grade pay is applicable in my case after 35 years of service. and i hv got only two promotions. pls reply……..

I joined ICAR services on 21.6.1975. I was promoted to UDC through limited departmental exam during 1983 and thereafter promoted to Asstt. on 27.4.1993. I refused 3rd promotion as AAO offered to me during Feb., 2006 (i.e. after 8 months of completion of 30 years of service -1975 -2005 and 13 years in a grade – 1993- 2006). I had completed 30 years of service on 21.6.2005 and 10 years of service as ASSTT on 27.4.2003. I had not been granted 3rd financial upgradation by my office in view of of para 25 macp as I had refused promotion before 1.8.2009 i.e. date of implimentation of the MACP . In my opinion as per para 25 macp I refused promotion after becoming eligible for 3rd upgradation which was stagnated (completed 10 years in a grade) on the post of ASSTT on 27.4.2003 after serving 13 years at the post of ASSTT.(DOP as ASSTT – 4/93 – date of refusal 2/2006). Please clarify whether I am eligible for 3rd upgradation w.e.f. 27.4.2003 i.e. 1.9.2008.

An official holding the regular post in the pay structure of Rs.9300-34800 with Grade Pay of Rs.4200 and drawing his pay in the MACP scale of Rs.9300-34800 with Grade pay of Rs.4600 seeks absorption to a post which carries the scale of Rs.9300-34800 with Grade Pay of Rs.4200. It may please be clarified whether such official is entitled to continue his pay in the MACP scale (both Pay in PB and GP of Rs.4600)on his absorption in the scale of Rs.9300-34800 with Grade pay of Rs.4200/

An official drawing his pay in PB 5200-20200 with Grade Pay Rs.2400 got financial upgradation under MACP in PB 5200-20200 with Grade Pay Rs.2800 w.e.f.1-9-2008. Subsequently, he got appointment to a higher post in PB 9300-34800 witbh Grade Pay of Rs.4200 on permanent absorption basis in another Department w.e.f.3-9-2010. Kindly clarify whether his pay in the higher post will be fixed with reference to the pay admissible in the regular post or MACP Scale.

I was appointed in Steno Gr.D in the year 1996, and i was granted ACP on 23.09.08 and my pay was fixed in pay scale 5000-8000(9300-34800 GP 4200). I opted for the said ACP. Then in Aug 2009 the order of MACP w.e.f. 01.09.2008. My ACP was withdrawn and I was again granted MACP w.e.f.01.09.2008 under pay scale 5200-20200 GP 2800. With this hiearcy system, the Steno cadre are having loss as the 1st ACP was with 4200 (GP) which now has been reverted and in MACP placed with 2800. Is it justified,as our stage of GP should have been 4200 , 4600 & 4800 as per new MACP but we are being placed at 2800 + 4200 + 4600. The old ACP scheme is more benificial to us. As all departments have few stenos are our voices are not being heard. Who will listen to us.

A person was appointed (LDC)on 16-12-1991 under the Scale of 950-1500 got pay upgradation of Rs.4500-7000 under the personal promotion scheme(i.e.One Upward Movement) after completion of 8 years of service.The same person got another upgradation of Rs.5000-8000/-under the ACP after completion of 9 years of regular service. Now, the same person going to get Grade Pay of Rs.4600 in PB-2 under the MACP within 20 years of service. As you clarified in point No.8 ,that a person or Government servant have already earned three promotions and still stagnated in one grade for more than 10 years is not elgibele for promotion. Like wise a person have already earned two upgardations within 20 years of service is eligible for another upgardation after completion of 20 years of service under the MACP?.Kindly clarify whether he would be entitle for any further upgradation under MACPS. Kindly clarify my doubt.

There is a parity in the pay and grade pay with my colleagues on implementation of MACP scheme, as they are drawing more pay then me. In this connection I have earlier approach to you through NET for soughting out the doubt of eligibilities of MACP benefits. No fruitful result has been received so far. So I am once again forwarding another tabulated comparative statement for your kind perusal.

I got two promotions through successful passing examinations and superseded to my colleagues in pay and allowances in two times. Now they are drawing more pay then me on implementation of MACP benefits. Please clarify whether I am entitled for MACP benefits or Stepping up of pay with my colleagues.

I have joined in DAD at the post of Clerk in 1981. I have promoted at the post of Auditor in the scale of 4000-6000 in the month of Mar.’1993 on seniority basis. In Oct.’99 I was promoted as Sr.Auditor in the scale of 5500. My pay was fixed in grade pay 4200 in the VI pay commission and as I have completed 10 years in the scale of 5500, through MACP I have been awarded grade pay 4600 since 2009. Kindly intimate whether I will get any further promotion after expiry of my 30 years of service i.e. in 2011 or till my retirement which will commence in April.’2019.

I retired on 30th Sep.2010 as Supdt.Central Excise drawing grade pay of Rs.5400/- in PB-2. The DOPT issued a clarification vide No.62460/US/(D)/2010 dt.26.7.2010 in response to query raised by Pr.Chief Controller, N.Delhi that benefit of 3% increment + PB 5400/- will be treated/viewed as upgradation in terms of para 8.1 of Annexure-I of O.M.dated 19.5.09 and the same would be off set against one financial upgradation under MACPs. Whether this clarification would be applicable to those who have already taken the above benefit of 3% + PB-2 Rs.5400/- in 2006 on completion of four yrs. regular service ? The clarification has quoted para of MACPS which is effective from 1.9.2008. KINDLY CLARIFY

I am a technician,servicing for 16 yrs at Pondicherry JIPMER HOSPITAL. My scale of pay is Rs5000-150-.,My First ACP FALL on 24-08-2006. As ther is NO CADRE rewiew Iwas awarded one increment & one notional increment in the same existing scale by not awarding to next Higer Sacle ie., 6500-150+150.thereby they given me a desparity.
AS such the case, the MACP made effect from Sept2009.Our officers says to neglect the previos award of acp & get new MACP from sept 2009 not awarding corresponding NEW PAY commission reccomendations.
Sir, I want you to clarify what would be my coresponding my ACP awarded on Aug 2006 in relation with 6 th Pay Commission

My query in connectionwith clarification on ACP/MACP given by dopt on 9-9-10 our hierarchy of post /promotion are 5500-6500. I was appointed in payscale of 4000-6000 on 18-12-1989. I got Ist ACP under the pay scale of 5000-8000 on 18-12-2001. Thereafter my pay scale revised on the recommdation of the SIU wef 22-12-2004 in the pay scale of 5000-8000 instead of 4000-6000 and revised Ist ACP in the scale of 5500-9000. I have complited 20 years on 18-12-2009 but I did not found any promotion till now. Whether I am eligible for 2nd MACP from 18-12-2009,in which pay band and grade pay. When I will get 3rd MACP in which payband and grade pay. If I will due for the promotion in 2011 what will be the new payband and payscale at the time of promotion. Request for early clarification please.

Sir,
There are some unfortunate group A staff in central water Commission who are departmental candidates come up from the basic level of junior engineers and have completed more than 30 years of service. These people on account of being group A staff (Asst. Exe. Engineers) are not eligible for third ACP as per DOPT clarification. But other Junior engineers, who are very junior in service and posses lesser qualification, and who have not got any promotion at all for the last 30 years have been given third ACP and put under the scale of 15,600-39,100 with grade pay of 6600/-. On the contrary, the Asst. exe. engineers many of whom are at the verge of retirement are put under the lower grade pay of 5400/- only in the PB 15600-39100. As a result the senior people are drawing lesser grade pay than junior people. This is a great injustice and anomaly has to be rectified .These Asst. Exe Engineers who are at present in group-A are different from the direct recruited AEE’s (through IES examination) and deserve the grade Pay of 6600/- atleast on par with their juniors. These people are actually departmental promotees and the word ‘Inducted’ used by DOPT in issuing MACP Clarification vide point No.2 of their OM dtd 9th Sept. 2010 should not be made applicable.

my qualification is 12th. I want to know the criteria for promotion to the next level on the basis of my qualifications. I am handling Complete packing section of my depot, Most of my superiors are Unskilled and promoted on the basis of Reservation and Seniority. I toped the trade promotion test taken by depot many times, but they promote unskilled on the basis of seniority. So please Provide me details like Rules and regulations For promotion of Civilians in center Government Army ordinance Depot.

I joined as LDC in one Central govt. office in Aug.1987, I got 1st ACP from August 1999. I am getting 2400/- GP from 1/1/2006 I have been promoted as UDC from 1/2/2008, thereafter on completion of 20 years I got 2nd MACP from August 2009 and got 2800/- GP from August 2009. Please tell me, how much Grade Pay I will get and from when. Second thing I got only one promotion till date and I have ompleted 20years of service in August 2007. Please clarify my doubt.

I joined as Attendant in Central Gov. Autonums Body, IIT Kanpur in the Basic scale of Rs. 210-290.

After completion of 8 year service in the same scale get first upgradation through assessment from 1.4.1991 in the Basic Scale of Rs. 950-1500 revised into Rs. 3050-4590 ( 6th pay commission revised 5200-20200 with GP Rs. 2000.00)in the same post.

After completion of more than nine and half year service get one selection w.e.f. 25.10.2000 as an LDC in the same pay scale i.e. Basic Scale of Rs. 3050-4590 (in 6th pay commission revised 5200-20200 with GP Rs. 2000.00) Only get two extra increments).

I am still working in the same pay scale w.e.f. 1.4.1991 more than 19 years, but does not award any assessment or any upgradation.

I want to say something our institute not in position to give any upgradation from 1.4.1991 (Because I am still working in the same pay scale from 1.4.1991).

Many junior are drawing more basic pay and salary than me, but adminitration does not want to do something. I have already written many grievance to director to please give me natural justice. But result ZERO

I am depressed at present now, what can i do, retirement in 2019.

Therefore I humbly request to you kindly give my query’s answer. Am I eligible for next upgradation under MACP. (Under MACP three upgradation will be award entire service? Please what is our next upgradation date?

of 260-400, I was granted 1st.acp in july 2004 in the pay scale of 4000-6000 after qualifying electrical supervisor
examination and departmental trade test.I was granted 2nd.
acp in the pay scale of 4500-7000,on completion of 24 years.
At present I am getting 2800 Grade pay .What grade pay will I get on 3rd acp on completion of 30 years of service?

I am a junior Chemist working in the Directorate of Marketing and Inspectoin,Minisry of Agriculture,Govt of India in Prerevised scale of Rs.4500-7000 (Grade pay 2800) after completion of 10year I got first ACP in as our promatation hierarchy Cader is Sr.Chenist in pay scale Rs.5500-9000 (GP4200).and Complition of 20 year I Got II ACP as our promatation hierarchy Cader is Chief Chemist in pay scale Rs.6500-10500(GP 4600) after completion of 30 year I Got III ACP as our promatation hierarchy Cader is Assi Director in pay scale Rs.8000-10500(GP5400) but department has given next higher garde pay Rs 4800 ignored next hierarchy Cader so is this right step? taken by the depart ment or they have to give GP Rs 5400 as per MACP?

dear sir, I Joined as HSK-II ( Defence Civilian employee) at a Basic of Rs 1230/-pm in Jul 1997 & was fixed at a Basic of Rs 4100/- pm during 5th Pay commission.

I was promoted to HSK-I in Dec 2002 by Departmental promotion committee and opder for the same was published.

Later on , both the grades were merged to HSK and the Basic was same 4000-100-6000.

During the 6th Pay commision fixation. I was lept in Grade pay of Rs 2400/- only.

Now, it is being told to me that I am only liable to get the benifit of HSK-I from Jan 2006 as a promotion.

Sir, My question is , when i was promoted in Dec 2002 even if my current position is counted as HSK-I why it is not counted from Year 2002. As a result I will withdraw less salary than a junior person getting the MACP benifit.

The both grades were merged in 5th Pay commission and agin splitted in 6th Pay commission.

Why i am deprived of the placement as I am in the 50% of employee to be splited in HSK-II & I.

If The Promotion is counted from 2006 I will get my first MACp in 2016.

I was appointed in Steno Gr.D in the year 1996, and i was granted ACP on 01.11.08 and my pay was fixed in pay scale 5000-8000(9300-34800 GP 4200). I opted for the said ACP. Then in Aug 2009 the order of MACP w.e.f. 01.09.2008. My ACP was withdrawn and I was again granted MACP w.e.f.01.09.2008 under pay scale 5200-20200 GP 2800. With this hiearcy system, the Steno cadre are having loss as the 1st ACP was with 4200 (GP) which now has been reverted and in MACP placed with 2800. This MACPs is unfair to me. In my case to whom and how shall I approach ? Please guide me in this matter.

I am an Sr.Ar. of the O/O the PDA(ER)/KOlkata.As per clarrification, if an employee on deputation gets MACP from his parent office, he can’t get two benifits simultanously ( Benifit of MACP & Deputation allowance).But if an employee after getting MACP in his parent office, comes on deputation he is getting deputation allowance along with MACP. What is the fault of the employee in first case( Is it to get MACP during deputation?)

I have joined the service as Junior stenographer in April 1979 and got promoted as Senior Stenographer in April 1984. Later, got promoted as Private Secretary in December 1996 and now in PB-3 with NFS with the GP 5400/-. As such have rendered more than ten years even after obtaining the NFS.
Will I be getting the MACP and move on to GP 6600/-

I have been woking on deputaion from June 2010 as Asst dir in the grade pay of Rs.4800/-, whereas in my parent office I got the MACP on July 2009 and grade pay becomes Rs.4800/-from the original grade pay of Rs.4600/-.
Now, My present office where im wkg on deputaion is not giving me the deputaion allowance. It may noted that at the time of application, I was in the pay scale of Rs. 6500-10500 and the pay scale of Deputaion post was also Rs.6500-10500.
Shall I eligible for deputaion allowance or not?

I joined in a Central Government organization (research station) in New Delhi as a Senior Research Officer (Scientist C) in the grade of 10000-325-15200 (Pre revised) on 29-12-1997 directly through Union Public Service Commission (UPSC). FCS is existing in our office. For the first time I was assessed in UPSC for the Chief Research Officer (Scientist D) post in 2006 September (after almost nine years) and I was droped. Since then no assessments have been held due to administration problems. Kindly let me know that whether I am eligible for 1st MACP on 29-12-2007 or not. I am a compassionate appointment at CGHS., PERAMBUR WC., as L.D.C. My grade pay is RS. 1900/-. As per the 6th PC now i am under MACP Scheme, which says that the upgradation would be in the next higher grade pay which is Rs. 2000/-. After 10yrs of service a hike in grade pay of just Rs. 100/- is realy unfair. If i am in the ACP scheme itself i would have been given a grade pay of Rs. 2400/- which gives a upgradation to the next hirearchy in the pay scale of U.D.C. Career Progression Scheme means Upgradtion of pay and position (promotion). Even if there are no promotion chances this ACP Upgradation would give the employee the next hirerachy pay scale. I am graduate(B.Sc.–Chemistry), Post-graduate (Public-Administration) and also completed Hindi exams (Prathmiuc to Visharadh Poorvardh). I do both English And Hindi typing. I am keen to learn and work Computers also and my services are utilised in all fields but my grade pay is RS. 1900/-. Kindly consider the grade pay of L.D.C.s with regard to their nature of their work, responsibility, accountability and Qualification.Expecting a relevant hike soon. kindly review the cadre and grade pay of L.D.CS

I joined as Inspector, Central Excise, on 07.10.1978 in the pay scale of Rs 5500-9000(later revised to Rs 6500- 10500 from 21.04.2004). I got promotion on 30.09.1996 and placed in pay scale of Rs 6500-10500(later revised to Rs 7500-12000). Get 2nd ACP on 07.10.2002 and palce in the pay scale of Rs 8000-13500. In the 6th pay commission, place in PB-3 with Grade pay of Rs 5400 on 1.1.2006. Got MACP on 06.10.2008 and place in Grade pay of Rs 6600. Under the O.M dated 9th september, 2010, I got the impression that I should get Grade pay of Rs 6600 in the 6th pay commission as on 1.1.2006. And I should be place in the Grade pay of Rs 7600 in MACP as on 06.10.2008.
Please help me to understand whether I am correct?

Now as per MACPs after completion of 20 years of regular service IInd financial upgradetion is granted to me from may 2009
Please clarify me whether I am intitled for IInd MACP benefits from may 2009 in the PB-2 with grade pay 4200

I have been appointed in Sept 1993 as sub stenographer and earned first ACP in Sept 2005. But stenogphers appointed in 1995 earned their first ACP in 2007 thus they get 3 % increment due to which they are drawing more pay than seniors. My pay (appointed in 1993 ) may be stepped up to pay of person appointed in 1995 otherwise it will be very demoralising factor to a senior employee i.e. his juniors getting more pay than seniors without any fault of the seniors.

My third ACP in the GP of Rs. 7600/-is due in the year 2013. What should be the benchmark of ACRs and of how many years. Is is necessary the ACRs of all the years required should be of ‘very good’. If suppose one year ACR carries only ‘good’ and all other years ACRs carry ‘very good’. In that case shall I be entitled to grant of MACP. For example ACR for the year 2008-09 and 2009-10 carry ‘very good’ status and the ACR for the year 2010-11 carries only’ good’ and again ACRs for the years 2011-12 and 2012-13 carry ‘ very good’ remkars. In that case am I entittled to grant of MACP to the Grade of of Rs. 7600/-? Please replyearly.

An employee was appointed wef 17.03.2001 in pay band of Rs.5200-20200 + 2000 GP. He has been found fit for financial up-gradation under MACP Scheme after completion of 10 years of regular service wef 17.03.2011 by the screening committee held on 28.07.2010. He was under suspension wef 15.03.2011 to 15.05.2011 & awarded with the major penalty of Reduction of pay to the minimum stage for a period of three years with cummulative effect.The suspension period has been treated as suspension.Kindly clarify the following points:
1.Whether his pay will be fixed wef 17.3.11 whereas he was under suspension wef 15.3.11 to 15.5.11

2.Since the individual was awarded with major penalty, whether the earlier grant of FUG under MACP will be cancelled & will be considered again in the next Board.

3. At present he is drawing the pay of Rs.7570/- + 2000 GP in the pay band of Rs.5200-20200+2000 GP, what will be his minimum stage.

I joined as SLIA in 2004 in central govt. in the pay scale of Rs.5500- 175 – 9000. Our grade pay is fixed by VI pay commission as Rs. 4200.

LIA/SLIA and school librarian were placed under the same scale under V pay commission ( i.e. 5500 – 9000), but the grade pay of School Librarian was fixed as Rs. 4600 by VI pay commission. This anomaly should be removed. (Both having Dual degree i.e. Graduation + BLISc).

As par as MACP is concerned, we will get three MACP in the grade pay of Rs. 4600, 4800 and 5400 after the completion of 10, 20 and 30 years of service respectively. But under 5 th pay commission our hierarchy of scale was as follows:

5500 – 9000 ( AS SLIA or entry level equivalent to grade pay Rs. 4200)
6500 – 10000 (1st ACP after 12 years of service or Promoted as ALIO equivalent to grade pay Rs.4600)

10000 – 12000 ( 2nd ACP after 24 years of service or promoted to LIO equivalent to Grade pay of Rs. 6600). You are getting it after 24 years of service.

But here under VI pay commission the highest grade pay one can achieve under MACP is Rs. 5400. (I think in PB 3 lowest fixation)and even we are getting it after 30 years of service. This should be happened. This anomaly should be removed.

Even after 6 more years of service we are getting grade pay of Rs. 5400, as compare to 6600 for 6 less years of service in 5 th pay commission.

Here their is career stagnancy. Hardly there is promotion. We, the library information professionals are the sufferer. Hence I request the authority to look into this matter.

Presently I am SSE of Indian Railways. As SE & SSE are mergerd then my date of last promotion is 13.01.92. My appointment was as Appr. Mech (D-H)on 15.02.83, training was for 02 years. My question is :- Due of 3rd MACP
My reular post from 25.02.85, my last promotion was 13.01.92.
It is heard that 3rd MACP will due 20 years last promotion or 30 years of service which ever is earlier.

Am I correct? If so kindly furnish the rule

I am working in a department where there is no promotions for the LDC. We have LDCs serving from 1978, but are still LDCs. However with the ACPS they have benefited with Grade pays given with hierarchy. However LDCs appointed later on and are given MACPs are not at all benefitted with the Grade pays because they are getting only the next Grade pay. They are more like Group D employees… I can give you an example of two LDCs appointed in 1984 with only 6 days difference. But of them were drawing same pay, same increement etc. However with the MACP order. one LDC got ACP in August 2008 with Grade pay of Rs.4200.. and the other got MACP on 6th September 2008 with Grade pay of Rs.2800… Strange very strange….Who will correct this anamoly.. Govt. is waiting for the next pay commission, so all the anamolies can be carried forward…. ACT IMMEDIATELY BEFORE IT IS TOO LATE………….

I am a direct recruit Assistant from UPSC since December, 1979. I was promoted as Section Officer in 1993. After completion of 24 years of service I was granted 2nd ACP in the pay scale of Rs.10000-Rs.15600 with a grade pay of Rs.6600/- w.e.f. 1.7.2003. I did not derive any benefit (notional or actual) from NFS which was introduced w.e.f. 03.10.2003, in which SOs with 4 years of service got pay scale of Rs.8000-Rs.13500. Hence, NFS is not applicable to me as I was drawing a higher pay (Rs.10000/-) in a higher pay scale (Rs.10000-Rs.15600) from an earlier date (1.7.2003). Please confirm that I am eligible for 3rd ACP/MACP in the PB-III of Rs.15600-Rs.39100 with a grade pay of Rs.7600/-in terms of DOPT’s circular No.35034/3/2008-Estt.(D) dated 9.9.2010.

1. Pease refer my letter No14247519F/FO/06/2011 dt 11 Apr 201. And even No dt 11 May 2011.
2. I was enrolled in Army (Corps of Signals) as a Sepoy on 21 Dec 1982 and got retired on 01 Jan 2007. After completion of 24 years of distinguished service (12 years served as Havildar)
3. At present I am in receipt of pay and pension benefit as per 6th CPC recommendation which is made effective wef 01 Jan 2006.
4. As per GoI, MoD vide letter no14(1)/99-D (AG) dt 30 May 2011, MACP to JCOs/OR has been granted wef 01 Sep 2008.
5. In view of the above, you may please clarify the reason to deny the ACP for the persons who ware retired in between 01 Jan 2006 till 31 Aug 2008. In this date only two ACP are granted but I am served one years after 6th CPC, why not granted me III ACP. Please clarify?
6. Therefore, I am requesting your kind honour to take appropriate necessary action to bring all the pensioners who ware retired on and after 01 Jan 2006 at par for the purpose of ACP.

I am working in the ministry of defence DGQA,SA – III in the equivalent pay scale of 5000 – 8000 scale w.e.f 14.12.1981 and got my first promotion on Oct 1996 in the pay scale of 5500 – 9000 as SA – II and I have been awarded my 24th year II ACP (of 5th Pay commission) w.e.f 14.12.2005 in the pay scale of 6250-10500. As per pay commission recommendation the pre-revised scales of 5000 – 8000, 5500 – 9000 and 6250-10500 are asper the illustration I of Annexture to MACP DOPT OM dated 19/05/2009.

W.e.f 01.01.2006 the post SA III and SA II merged as SA with 6th CPC grade pay of 4200/= and SA I and JTO merged as JTO with the 6th CPC grade pay of 4600/=

In my case I was getting the scale of SA – I with scale irrespective of my promotion w.e.f 14 dec 2005 on account of my ACP. As the SA
I got my promotion order to SA – I on 10 Aug 2006 however I refused promotion and was debared for one year upto 09 Aug 2007 and got my promotion on 10 Aug 2007 as SA – I. As SA – I and JTO are merged and upgraded I was re-designated as JTO with effect from 10 Aug 2007 without any financial implication as I have got the scale already.

I was awarded my second ACP w.e.f Sep 2008 of GP 4800/=
I am completing my 30 years of service on 14.12.2008. I am due for my third ACP with GP of 5400/=

In this regard kindly clarify whether the debar period will be taken for postponment further irrespictive of no promotional benefit with effect from 10 Aug 2007.

In some Central government departments, some of the personnel joined on selection to Group-A post/s in open competition are working without any promotion avenues. Is it justifiable to fit them in MACP scheme, though they have potential to prove themselves for higher posts?

It is suggested to motivate and boost the morale, the period of MACP for grant of higher grade may be curtailed from 10 years to 6 to 8 years for first and subsequent financial up-gradations similar way.

I have joined as L.D.C on 15.1.88. I have passes SAS(JAO)Exam conducted by Min. of Fin. in Jan, 1996.Due to non-availability of vacancies I was given adhoc posting as JAO in June,2002 in the scale of 6500-200-10500. In the meantime I got promotion in May 1998 as U.D.C and served upto 31.5.2002 before posted as J.A.O. I was regularised in the post of J.A.O in Feb,2008. After pay commission report JAO & AAO posts were merged and placed in scale of 9300-34100 with grade pay of 4800. My designation also changed to AAO and at present I am drawing Rs.21520(16720+4800)from 1.7.11.

One of my colleagues joined as L.D.C in December,1989 and passed SAS exam alongwith me in Jan,96.He was posted as JAO on adhoc in Dec.,2002.and regularised in October,2008. His designation also changed to AAO after pay commission report alongwith me. Recently he was given MACP with gradepay of Rs.5400 w.e.f 1.12.2009 on completion of 20 years and placed at basic pay of Rs22,160(16110+5400).
I was denied MACP from 1.1.2008 on the ground that you are promoted as UDC before posting as JAO. Being junior he is drawing more than Rs. 4000 salary than me . I am facing severe loss. Please advise whether I am eligible for MACP 2nd from 1.1.08 ? other wise when I will get benefit of next MACP? or any other option , even I am ready to return the difference of pay between LDC and UDC if allowed MACP from 1.1.08. WE have commpleted 16 years services got. ACP Feb 2006 from scale 5000 to 5500 which was merged and asigned grade pay 4200.

I have been woking on deputaion from June 2010 as S.A. in the grade pay of Rs.2400/-, whereas in my parent office I got the MACP on July 2009 and grade pay becomes Rs.2800/-from the original grade pay of Rs.2400/-.
Now, My office where i m wkg on deputaion is not giving me the deputaion allowance. It may noted that at the time of application, I was in the pay scale of Rs.4000-6000 and the pay scale of Deputaion post was also Rs.4000-6000.

Sir,
I am serving in a dept under the ministry of home affairs. In my dept, the promotion structure in my trade is Havildar, Naib/Subedar, Subedar and Sub/Maj and basic pay is starting from Rs. 3200/-, 5500/-, 6500/- and 6500 +200 appt pay respectively in the pre-revised 5th CPC scale. My dept had given ACP to Hav after completion of 18 years service upto 31 Aug 2008 and their basic pay was raised from 3200 to Rs.5500/-. But I was deprived of the ACP as I had not completed 18 years service on 31 Aug 2008. Now, the pers who are 02 year sernior to me and got the ACP are drawing basic pay Rs. 4000/- more than my basic pay.

As per the rule existed in 5th CPC, the pers who completed 12 years service was eligible for the 1st ACP. But my dept has not given the same. I was granted the first MACP on 01 Sep 2008 with grade pay Rs.2800/-. Now, I have completed 20 years service on 01 Mar 2012. In view of above, request intimate, whether I eligible for the second MACP and also confirm am I eligible for the first ACP on completion of 12 years service. Thank you sir.

My entry scale is Rs. 5000-150-8000. I got ACP in the month of April, 2006 in the pay scale of Rs. 5500-175-9000. At the fixation of pay I got grade pay of Rs. 4200. According to sixth pay commission three scales were merged i.e. 5000, 5500 and 6500.
When three scales are merged in 1.1.2006 then what grade pay I will get on my ACP which was due on April 2006.

My entry scale is Rs. 5000-150-8000. I got ACP in the month of Feb, 2006 in the pay scale of Rs. 5500-175-9000 and my salary was fixed in 4200GP.

When three scales 5000, 5500 and 6500 were merged in 1.1.2006 then what grade pay I will get on my ACP which was due on Feb 2006.

My humble request from the Authorities please issue a order with clarifications. Many Deptts are not clear about these merged scales, they are following according to them like some are giving benefit to employee and some are not.

Further, granted 1st A.C.P. on completion of 12 years w.e.f. 13.01.2005 & awarded grade pay Rs.2400/-. I was appointed (23/07/1983)as D’Man Gde II in MES in the pay scale 425-750 (RPR-73),1400-2600 (RPR-86)now 9300-34800 with Gp 4200 (RPR-2008),I got Ist ACP wef 09/1999 and promoted as D’Man Gde I on 04/2000 in the scale of 5500-9000 and after completion of 24 years of service i got IInd ACP wef23/07/2007 in the scale of 6500-10500,and promoted as Tech. Officer on 17/11/2007 in the scale of 6500-10500
After merger of pay scales of 5000-8000,5500-9000 and 6500-10500 in PB-2 (9300-34800 with GP 4200)Practically My Ist and IInd ACPs benefits were NIL.
D,Man Gde II,Gde I were also merged in PB-2 (9300-34800 with GP 4200) wef 01/01/2006.
I request to clarify that what would be my Pay band and GP on 01/01/2006 and on 23/07/2007 and after comp of 30 years on 23/07/2013.
My humble request to the authorities please issue clear orders with clarifications departments are not clear about these mergers they are following according to them like some are giving benefits to the employees and some are not. departments

I joined a Attender, PEC as on 11.08.1988 in the scale 800-15-1010-20-1150 and got first promotion as on 21.02.1995 in the scale (5th pay 1400-40-1600-50-2300-60-2600) 5000-150-8000 as Mechanic and second promotion as on 16.11.2000 as Jr. Instructor in the scale of of 5500-175-9000. After merger of 6th pay Scale 5000-150-8000, 5500-175-9000 as pay band 9300-34800 Grade pay 4200, practically my promotional benefit is Nil.
Therefore it is requested kindly clarify whether I am eligible for MACP (grade pay 4600) and actual date effect date

(1) Sir I joined All India Radio & Doordarshan on 10.04.90 as a Technician.
(2) ACP as per Vth pay comm. was not awarded to all the Engg. cadre of department due to some court cases.
(3) After completing regular 15 year service in a grade I was offered 1st promotion on April 2005 but some family cicumstances I did not accept same.
(4) Then after a promotion was again offered me on april 2006 and I accept it.
(5) Meanwhile VIth pay comm. came in existence and its MACP benefits was also extended to us say all the engg. cadre of department resultant I become eligible for MACP.
(6) Sir clarify am I eligible for II nd MACP on 10.04.2010 or 10.04.2011.
(7) Sir my request is that I refused promotion after become eligible for 1st ACP which was stagnated ( Completed 12 years in a grade) and no promotion was offered me from April 2006 to till.
(8) Reply early as our office has fixed my MACP date as on 10.04.2011 by counting one year debar period.

sir,Iam working with delhi govt as statistical investigator in the plg&statistical cadre since 1july,2005 as i am merged wef 1.7.2005 in this cadre.befor this,Iwas working in Urban Development,delhi govt on the same post&grade since 22.09.1992 as regular service.I have taken benefit of ACP in the year 2004 when it was due.later on I was merged in the above said cadre,naw my MACP has been due as my regular service will be 20years.But,my cadre cadre controlling deptt.is not counting my previous regular service for the purpose benefit of MACP.Please clarify whether my past regular service shall be count or not for the benefit of macp.

Please confirm that I am eligible for 3rd ACP/MACP in the PB-III of Rs.15600-Rs.39100 with a grade pay of Rs.7600/-in terms of DOPT’s circular No.35034/3/2008-Estt.(D) dated 9.9.2010.

Sir,
With due respect I beg to state following points for your kind and sympathetic consideration for granting MACP:-
• I was initially appointed as an LDC through SSC in the pre-revised pay scale of Rs.260-400/- and joined at Sena Bhawan, Naval HQrs, M/O Defence on dated 12/ 05/ 1982.
• Soon after, I was appointed as an Investigator through SSC in NSSO, M/O Planning in pay scale of Rs. 425-700/- and joined on 23/08/83.
• Thereafter, I was selected as a Research Assistant (Gr. B Non-Gazetted) through UPSC in the pre-revised pay scale of Rs. 1640-2900/- and joined in Doordarshan, M/o I & B on 11 /08/1992. This post of Research Assistant was re-designated and bifurcated according to seniority as Assistant Research Officer Gr.-I and Assistant Research Officer Gr.-II by the 5th CPC in the pay scale of Rs. 7500-12000/- and Rs. 6500-10500/- respectively.
• The pay scales of Rs. 6500-10500/- of Assistant R.O. Grade-II recommended by 5th CPC have been implemented from 08 /08/2000 for Audience Research Staff, Doordarshan whereas 5th CPC pay scales are awarded since 01/01/1996 in all offices of Central Government.
• First ACP was given to me since 11 /08/2004 with the pay scale of Rs. 7500-12000/- when I was working as a Assistant Research Officer Grade-II in the pay scale Rs. 6500-10500/- .
• I got grade pay of Rs. 4800/- in the pay scale of Rs. 9300-34800/- since 01/01/2006 which was recommended by 6th CPC when I was working as a Assistant Research Officer Grade-II in the pay scale Rs. 7500-12000/
. • I have been promoted on 19/09/2011 as a Assistant Research Officer Gr.-I from Assistant Research Officer Grade-II and my grade pay remained the same i.e. Rs 4800/- in the pay scale of Rs 9300-34800/- . (ACP given on 11/08/2004 was regularized).

• I have completed 30 years of Govt. Services on 12/05/2012; so I am eligible for 2nd & 3rd MACP in GP of Rs. 5400/- and Rs. 6600/-, which have not been granted to me so far.

It is, therefore, requested that my entire service since 12/05/1982 may be counted for MACP purposes and I may be granted 2nd & 3rd MACP of G.P. Rs. 5400/- and Rs. 6600/- respectively. I hope that the matter may be taken up positively at the earliest possible. I shall be highly obliged for your consideration please. Kinly, give me solution please.

Respected Sir,
I was initialally appointed as Data Entry Operator Grade ‘A’ on ad-hoc basis w.e.f. 1.1.1997. Then w.e.f 1.1.1998 my service as Data Entry Operator Grade A was regularised.Thus, it was my entry grade appointment. Thereafter, w.e.f. 1.1.2002 I was given ad-hoc promotion to the post of Data Entry Operator Grade ‘B’ which is the promotional post from Data Entry Operator Grade ‘A’ with the requisite term of 5 years regular service. This ad-hoc promotion was later regularised by the DPC w.e.f. 20.1.2005 and my service in the same post cotinued till date.

Now,from 1.1.2002 to 1.1.2012, I spent 10 years continiously in one post i.e. Data Entry Operator Grade ‘B’ and in one Grade Pay i.e. Rs. 2800/-. It is given in DOPT’s Order that “For the purpose of MACPS regular service will commence form the date of regular appointment in the Entry Grade”, which is in my case is 1.1.1998.

Hence, as per MACPS Rules I should be elligible for financial upgradation under MACPS (2nd MACP)w.e.f. 1.1.2012. Is not it ?

1. All the writ petitions relate to claim by the respective
petitioners that they have diploma certificates from recognized institutes
and they also have 10 years of technical experience in the appropriate
fields. By a notification issued by the Ministry of Education and Social
Welfare, Department of Technical Education, dated 26.05.1977, and
acting on the recommendations of the Board of Assessments for
Educational qualification and the Recommendation of Defence Director
(Technical), the Government of India has decided to recognize such
diploma with 10 years experience as equivalent to a degree in
engineering. The notification further states that it shall be valid for the
purpose of selection to gazette post and service under the Central
Government or the State Government. It is not denied that all the
petitioners have diploma and also the requisite number of years namely,
more than 10 years of technical experience in the appropriate fields.
They are, therefore, entitled to be recognized as possessing degrees in
engineering. This issue was considered in a decision of this Court in
Civil Writ Petition No.17974 of 2006 in Devinder Singh Malik Versus
HPGCL, Panchkula that a person who holds a diploma with the requisite

number of years of experience shall be entitled to be issued with a degree
certificate. Following the decision of the Division Bench of this Court, I
direct that the respondent No.3 under whom the respective petitioners
were in service shall issue the certificate to the effect that by virtue of the
possession of diploma with the requisite experience, they shall be treated
as having degree in engineering in the respective fields of academic
discipline.
