    Agenda Item No. 44-
    Sub-Anomaly in the Pay Scale / Pay Band and Grade Pay of Library Information assistants.

    Respected Chairman Sir and Hon’ble Member of NAC/JCM, Kindly discuss above anomaly.

    Library Information Assistants and School Librarians minimum educational qualifications are equal; nature of service is same but grade pay different. This is big anomaly in the pay scale/grade pay of Library Information Assistant (LIA), after implementation of 6th CPC.The Library Information Assistants are placed in the grade pay of Rs.4200/- and school Librarians placed in the grade pay of Rs.4600/-.

    The above referred anomaly existed in the 5th CPC too. That is, school librarians were placed in the pay scale of Rs.5500-9000/-, where as the Library Information Assistants were given the pay scale of Rs. 5000–8000/- initially. After some time this anomaly was removed by the Ministry of Finance vide its Office Memorandum No. 71/3/2001-IC, dated 21. 2. 2002, and placed in the pay scale of Rs.5500-9000. Above pay scale implemented in railways RBE No. 204/2003 Railway Board letter No. PC-IV/2002/Imp/2 dated 27/11/2003.

    It is stated that the Library Information Assistants and School Librarians require minimum educational qualification (3 year Graduation degree + one year Professional degree)i.e .B.A/B.Sc/B.Com.+ B.Lib.Sc. Above minimum educational qualifications are equal, but grade pay different.
    This anomaly may kindly be looked into seriously. I request to the National anomaly committee (6th CPC) to render natural justice to the Library Information Assistants (LIA). Hence it is justified that the Library Information Assistants deserve to be placed in the grade pay of Rs. 4600/- (from 01/01/2006).

    Hopping for the favorable outcome in the next NAC meeting.

    Dear sir,
    I would like to bring to your kind attention that if a person is retiring in the month of June , he will not get the increment due on 1st July, although he has served the complete year. It is unjustice to him because he has worked the whole year and on retirement he doest not get the increment because he is retiring on 30th June 2012, which puts in a great loss a increment and loss in pension. Hence you are requested to kindly look into the matter and decision may be taken that he should get the increment if he is working more than six month in a year before his retirement is due. Seeking justice

    We were waiting for since long that anomalies committee will approve the promotional hierarchy scale in the new MACP scheme just like it was given in the old ACP scheme but no favourable decision was taken. I requested the NAC members that promotional hierarchy may please be given to the employees under MACP to avoid the monetary loss and injustice with them. Hoping for favourable decision.

    It is good to know that the next(5th) meeting of the National Anomaly Committee is going to be held on 17.07.2012.There are many cases where the employees who were due to get their annual increment between Feb. to June during 2006 after grant of one increment in pre-revised pay scale as per OM.No.10/02/2011-E.III/A dt.19th March,2012 are not getting any benefit as in such case the pay on 1.1.2006 gets refixed at the same level as per the fitment table.The staff side now need to stress upon the action required from the official side that the anomalies that have arisen consequent upon the issue of this order are removed.The employees who retired between Feb.-June,2007 are at double disadvantage as they got only one increment in a period of two years. Hope the authorities will take the approapriate action to remove the anomalies to grant uniform benefit to all.

    Sub:Anomaly in the OM No.10/02/2011-E.III/A dated 19th March 2012.

    I wish to bring to the kind notice of the NAC members a fresh anomaly created by implementing the
    OM of reference above.

    As per the OM,it is decided that in relaxation of stipulation under Rule 10 of
    the CCS (RP)Rules, 2008, those central government employees who were due to get
    their annual increment between February to June during 2006 may be granted one
    increment on 1.1.2006 in the pre-revised pay scale as a one time measure and
    thereafter will get the next increment in the revised pay structure on 1.7.2006
    as per the Rule 10 of CCS(RP)Rules 2008.The pay of the eligible employees may be
    re-fixed accordingly.

    I wish to bring to your kind notice that the OM is silent on those central
    government employees who are promoted to higher grade between February to June
    during 2006 and their increment on promotion falls in the same period.

    It may kindly be noted that both those employees who opted for the pay revision
    to Revised pay on their date of next annual increment between February to June
    2006 and those employees who opted for the pay revision on promotion date to
    higher grade between February to June 2006 were not granted their next increment
    in Revised Pay structure on 1.7.2006.

    By implementing the OM of reference above,those employees with annual increment
    between February to June 2006 are granted two increments ,one on 1.1.2006 in
    pre-revised scale and the next increment in the revised pay structure on
    1.7.2006,while as those promoted employees are granted only one increment on
    their promotion.

    This leads to a clear anomaly,where the promoted employee draws one increment
    less than the employee not promoted in the same grade on 1.7.2006-a senior
    drawing less than his junior.

    This anomaly shall be rectified by granting the benefits given in the OM,
    namely ,the grant the next increment in the revised pay structure on 1.7.2006
    as a one time measure, also to those employees who are promoted between
    February to June 2006 .

    This note is put up for your kind and immediate attention of the NAC members for
    discussions and rectification in the next National Anomaly Committee meeting on
    17th July 2012.Thanking You.

    As per IV CPC, the Assistants in the Civil Departments were drawing a pay scale of Rs.1400-2300, which was revised to Rs.5000-8000 as per V CPC and to the pay structure in PB-II Rs.9300-34800 with Grade Pay Rs.4200 as per VI CPC. Whereas the Office Superintendents in the Civil Departments were drawing a pay scale of Rs.1600-2600 as per IV CPC, Rs.5500-9000 as per V CPC and Rs.9300-34800 with Grade Pay Rs.4200 as per VI CPC. From the above it is clear by merging both the cadres by giving the same grade pay and pay band, the position of the Office Superintendents have been brought down. Though the Pay Commission recommended to merge all these scales taking into account the need to bring the Assistants in the CSSSs cadres also at par with other Civil Departments, ultimately the Assistants in the CSSS cadres were granted the grade pay of Rs.4600. Hence, the Office Superintendents in Civil Departments though carry higher responsibilities than the Assistants, should be given at par with the Grade Pay of Rs.4600. I hope the anomaly commitee will definitely look into the matter.

    Sir,

    Kindly take up the matter of senior-junior anomaly in respect of grant of MACP. Many junior AAOs in IA&AD were granted gp 5400 on completion of 10 years service in AAO cadre whereas many senior AAOs were ignored only because they got three promotions. Para 20 of the MACP Scheme is all violation of the FRs and the matter may be discussed in the Anomaly Committee and benefits of MACP given to the juniors should also be extended to the seniors in the same grade/cadre.

    Dear Sir
    Due consideration has been given to, in fixing the pay of employee on 1st July. I have gone through all the circular. Similar kind of thinking is required for the time of superannuation. An employee earned an increment after working for an year. Employee who are retiring on 31st July will get the increment on 1st July but look at the cases of poor person who are superannuating on 30th June / 31st May/30th April. Their 12/11/10 months service have become redundant for all pensionary benefits. It is there submitted that for such employee completing six months and above ( after earning the increment on !st July) be given an increment on date of superannuation for pension and other superannuation benefits.Further, this in within the frame work of 6th CPC and made applicable to all those who have superannuated after 01.01.2006. Even I am of the strong view it should be made a general rule.

    The Pay Scales recommended by successive Pay Commissions to Trained Graduate Teachers, School Librarians and Library & Information Assistants were identical till 4th CPC but the 5th CPC recommended different pay scales for School Librarians and Library Information Assistants but the anomaly was rectified by the Department of Expenditure vide their OM FNo. 71/3/2001-IC dated 21.2.2002, revised the Pay Scale of Library Information Asstt. Retrospectively to Rs.5500-9000 w.e.f. 1.1.1996. The Library & Information Assistants in Government Departmental Libraries besides having the same educational/professional qualifications as those of the School Librarian carry much more responsibilities than the School Librarian.

    It is therefore I would request to the members of the staff side of the anomaly committee to strongly put forward the case in favour of Library Information Assistants to be granted PB-2, Rs.9300-34800 with Grade pay of Rs. 4600.

    GROSS ANOMALY HAS BEEN CREATED BY THE OM DTD.19-3-2012(REG. ONE TIME INCREMENT FOR EMPLOYEES WHOSE INCREMENT FALLS BETWEEN FEB. TO JUNE 2006). FOR THOSE PERSONS WHO HAVE GOT PROMOTION/ACP DG. FEB. TO JUNE 2006, AS THEY ARE NOT GETTING ONE TIME INCREMENT ON 01-01-2006(IN OLD SCALE) AND ALSO NOT GETTING INCREMENT ON 01-07-2006.THIS GLARING ANOMALY NEED TO BE REDRESSED DURING UPCOMING NAC MEETING DATED 17-07-2012.

    DATE OF NEXT INCREMENT–AGENDA ITEM No.5(v):-
    My normal date of increment was 1.5.2006. but,I retired on 31stJanuary,2006 (AN)(i.e.w.e.f.01-02-2006).Please clarify whether I am eligible for the additional increment in pre-revised scale on 1.1.2006 and also for re-fixation of pension as well as get other retirement benefit since I was in service as on 01-01-2006?
    The Ministry’s order is not clear whether Govt.employees retired between FEBRUARY AND JUNE, 2006 and whose normal date of increment was between the said period (FEB.2005 to JUNE,2005)will get one time increment as on 01-01-2006 as they were on duty on that date i.e. 01-01-2006 ,although Confederation of Central Government Employees as intimated as under
    THIS WILL BE APPLICABLE TO ALL GOVERNMENT EMPLOYEES AS ON DUTY ON 1.1.2006 AND WHOSE DATE OF INCREMENT WAS BETWEEN FEBRUARY AND JUNE, 2006 WOULD BE NOW GIVEN AN INCREMENT IN THE PRE-REVISED SCALE OF PAY AS ‘ONE TIME MEASURE’ AND THEN AGAIN REFIXED WITH ANOTHER INCREMENT IN THE NEW PAY ON 1.7.2006.ALL SUCH OFFICIALS WHOSE PAY WILL BE REFIXED W.E.F. 1.1.2006 SHOULD GET ARREARS AND OFFICIALS WHO RETIRED AFTER 1.1.2006 WILL GET THEIR PENSION UPWARDLY REVISED WITH ALL CONSEQUENTIAL RETIREMENT BENEFITS.

    6th pay commission : Fresh recruit V/s Direct recruitment

    Rule 8. Fixation of pay in the revised pay structure of employees appointed as fresh recruits on or after 1.1 .2006 – Section-II Part ‘A’ of first schedule of the CCS(RP) Rules 2008 .

    The rule has raised the anomaly for person who is already a Govt servant and has joined as direct recruit in new Govt department after tendering technical resignation in the previous govt department in the interim period of 1.1.2006 to the date of notification of 6th pay commission. The pay has been fixed as per section –II for all employees

    The pay protection is being denied by Science and Technology department to the govt servant who has come from other govt department due to ambiguity in the rule. The reason quoted is that pay protection cannot be acceded to the incumbent as he is the direct recruit in the department and pay will be fixed as per this rule 8.

    Please issue precise clarification on this clause is meant only for the person who is fresh recruit in Government service /join the Govt service for the first time and not on incumbents who is already Government employee and is selected to the post on direct recruitment basis. The pay protection under other CCS service rule is applicable for govt servent even on selection as direct recruit in new govt. department .

    Anomly to get increment for govt servent whose increment fall in January 2006 and join new govt departmnet in June 2007

    i joined the new govt department on 20th June 2007 after tendering technical resignation to my previous service in same pay scale and grade pay in 6th CPC (Rs. 6600 / equivalent academic grade pay 7000 introduced by Govt of india ).

    My increment date fall on 8th january in 5th pay commission. The previous department has not give me the increment on 1st July 2006, as ,i have not completed 6 months on July 06 . The new department is treating me a fresh recruit and neither protecting the pay and nor the increment due on 1st july 2007.

    The anamoly has resulted that the incumbent is harassed to draw less basic pay and got next increment after 29th months ie on July 2008 for none of his fault.

    Please resolve the anaomly of increment of January 2006 and June 2007.

    Humble appeal to Anomaly Committee.

    1. the qualifications of “School Librarians” and “Library Inoformation Assistants” are same then why not emolument.

    2. In 5 CPC, the scale of “School Librarians” and “Library Inoformation Assistants” was same but why not considered in 6 CPC.

    This is requested to the Hon’ble Chaiman and Members of 5th National Anomaly Committee to kindly consider our genuine demand and revise the grade pay as Rs. 4600/ instead of Rs. 4200/-

    i want to draw your kind attention of anomaly created by 6cpc in the sss(statistical subordinate service) cader of mospi 6pc merge 4 tier of 5000, 5500, 6500 and 7450 and merged 5000 &5500 and 6500 & 7450 into 2 tier and give 4200 and 4600 gp respectively sir this is an unsolved issue all other 5500 was granted 4600 gp and SSS wasgiven 4200 gp please solve the anomaly as other

    Upgradation of Grade Pay in SSS(statistical subordinate service) : Sir, we would like to bring to your kind notice that
    under combined Graduate Level Examination conducted by SSC, Exams are conducted for the
    Post of Assistants ( Gr. B with GP Rs. 4600), Inspector of Central Excise etc. ( Gr. B with GP Rs.
    4600), Inspector of Income Tax ( Gr. C with CP Rs. 4600), Assistant Enforcement Officer ( Gr. C
    with GP Rs. 4600 and Statistical Investigator Grade II ( Gr. B with GP Rs. 4200. Sir, Aspirants of
    SSS ( S.I. Gr. II ) have to appear for all the papers required for the other services besides one
    more paper of 200 marks in compulsory subject like Economics or Statistics or Commerce or
    Mathematics. Though Statistical Invt. Grade II is a Group-B post with Grade Pay of Rs.4200/
    but it’s the last option in comparison to other posts like Income Tax Inspector and Asstt.
    Enforcement Officer though categorized as Group-C but having more grade pay of Rs.4600/-
    and more bright career prospects than that of Statistical Invt. Gr.II. The 1983 batch of
    investigators got its first promotion in 2009, that too on Adhoc basis

    A resolved anomaly of the 5th CPC has appears again like a incurable disease (anomaly) in the 6th CPC for Library & Information Assistants. Sadly official side of the NAC described the anomaly as a consciously created anomaly without going into the facts. 6th CPC placed the Library and Information Assistants in the grade pay of Rs. 4,200 whereas the school Librarians are placed in the grade pay of Rs.4600/-in the PB-2 without taking note that School Librarians require double graduation for their recruitment i.e. Bachelor degree (B.A/BSc/B.Com.) and a degree in Library & Information Science. On the other hand Library and Information assistants too require two degrees i.e. a degree and a degree in Library & Information Science for their appointments. On recruitment qualification grounds Library and Information Assistants deserve to be placed in the grade pay of Rs. 4600 like school Librarians.
    The above referred anomaly existed in the 5th CPC too. But that anomaly was removed by the Ministry of Finance vide its Office Memorandum No. 71/3/2001-IC, dated 21. 2. 2002.
    I request the anomaly committee to do the justice consciously in favor of Library and Information Assistants.

    Dear Sir,

    I got promoted from PB- 1 to PB-2 scale in the Month of April, 2008. (Scientific Assistant-c)
    As my pay fixation done Rs.9300 band with GP 4600/- But same scientific assistant who joined after 2006 are getting direct Basic of Rs.12540 with GP 4600 . This is gross violation of fundamentals with juniors and seniors pay. Kindly lookinto the matter and implement Step-up for seniors who got promoted in middle as per junior pay,

    The anomaly in granting the Grade Pay to LDCs and UDCs has been pending right from the implementation of 6th Pay Commission and they have been demanding for up-gradation of their Grade Pay. It was very worst decision to grant such a low grade pay to LDC/UDC. LDC/UDC posts are key position in the hierarchy. However, VI Pay Commission neglected the interest of LDC and UDC and granted such a low GP of Rs.1900 and 2400 to them in caparison to GP granted at PB-3 and PB-4.

    Hence, the demand to grant the GP of Rs. 2400 to LDC and GP of Rs.4200/- was quite justified.

    Presently, LDCs are getting GP 1900 and on grant of MACP, only the GP 2000 is being granted i.e. just a 100 rupees benefit. Similarly, UDCs on grant of MACP are being granted the GP of Rs.2800/- only, whereas on actual promotion they are eligible to greater GP than that of the Grade Pay on MACP. This is totally injustice to them.

    Anomaly Committee, may accept the demand for grant of Grade Pay to LDC and UDC as under:

    Post Present GP Justified GP
    LDC Rs. 1900 Rs.2400
    UDC Rs.2400 Rs.4200

    All federations are requested to help the clerical cadre in getting justification.

    Sir,
    I am working as Assistant Audit Officer in the Indian Audit and Accounts Department. I joined as Auditor in Nov 1981 and got upgraded as Sr.Auditor in March 1983 following restructuring of the Department in to Audit and Accounts. I became Section in September 1989 and AAO in March 1993. I was offered promotion as Audit Officer in Feb 2007, which I deferred citing domestic problems. When MACP was introduced in Sep 2008 I was not considered for financial upgradation as I was offered AO post already. The MACP orders clearly stated anomally in pay in the same cadre will be ignored even if a junion is getting more on account of getting MACP. But in our Department some of the Senior Auditors were given MACP and are getting Rs. 5400 grade pay. But people like me are still getting only Rs. 4800 grade pay. The Sr.Ars who lower in cadre are paid more pay than us. This clearly created anomally between cadres. The supervised is getting more pay than supervisor. Further, as per old ACP if no promotion is given till 12th year from the date of joining one ACP will be granted and no further is promotion is given at the end of 24th year the second ACP will be given. In my case I joined as Auditor and got upgraded as Sr. Ar in March 1983 ( which was not a promotion) The Section Officer and Assistant Audit Officer posts are merged from 1-1-2006 on account of VI CPC. As on 1-1-2006 that is after completing more than 24 years of service I got only one promotion as SO/AAO (as per VI CPC recommendations). In these circumstances am I not eligible for second ACP as I was offered Audit Officer promotion only in Feb 2007. Hence kindly clarify whether I have placed in an anamolous situation on account of Lower cadre employees getting more than myself under MACP and am I not eligible to get second ACP under ACP scheme in force prior to MACP.

    Employees who got promoted to higher grade in march 2007 did not get an increment due to DNI and also subsequently retired in june 2008 without an increment. the last increment drawn was in july 2006.This anomaly certainly needs to be addressed in the comming 17th july 2012 NAC meeting.

    Dear sir,
    It is seen from the replies that the official side is not responding positively to the genuine anomolies of the employees.
    1. DRDO has not implemented the MACP to Scientific and Technical personnel starting with a grade pay of 1900 onwards.
    2. Employees of the grades of 5000-8000, 5500-9000 who were promoted before 2008 were reverted back to lower levels. They were not promoted after that and no promotion or MACP even after 10-12 Years.
    Please look into that.

    The anomaly in granting the Grade Pay to LDCs and UDCs has been pending right from the implementation of 6th Pay Commission.

    It was very worst decision to grant such a low grade pay to LDC/UDC. LDC/UDC posts are key position in the hierarchy. The job profile of the post of LDC/UDC has undergone significant changes after introduction of modernization in Government offices. Now, computers have taken over the place of Manual & Electronic Typewriters. Accordingly, LDC & UDC have been trained to work in various computer applications viz. MS Word, Excel & MS Power Point etc., without granting the minimum pay scale prescribed for doing such specialized work.

    In all the organizations, the UDCs are functioning as Dealing Assistant in all the matter being dealt there and they are supposed to well verse with all the rule positions and computer operation including sending mails, searching useful information/rule position on internet.

    However, 6th Pay Commission neglected completely the role of an LDC/UDC and their interest by granting them such a low GP of Rs.1900 and 2400 to them in caparison to GP granted at other Pay Band. It was very surprise to see that there was only difference of Rs.100/- between the Grade Pay of Group D(Peon) & Group C (LDC) which beyond the justification.

Similarly, UDCs on grant of MACP are being granted the GP of Rs.2800/- only, whereas on actual promotion they are eligible to greater GP than that of the Grade Pay they gets on MACP. This is totally ridiculous and injustice to them.

    Anomaly Committee may accept the demand for grant of Grade Pay to LDC and UDC as under:

    Post Present GP Justified GP

    UDC Rs.2400 Rs.4200

    All federations are requested to help the clerical cadre in getting justification.

    Respected Sir, It is a great injustice shown to the clerical staff and junior stenographer and other isolated categories as they have been given MACPS with grade pay hierarchy whereas they should have given promotional grade pay hierarchy as has been done in ACP. Lakhs of clerical staff will be grateful to the National Anomoloy Committee, if the MACPS is provided with promotional grade pay hierarchy. thanks prakash

    Sir, please solve the problem those who received two benefit (change of scale only ) in 2000. Is there any chance for this employe to get further changing of scale even one completed 12 years of continue service from 2000? (the above said employe those who completed total service 24 years).It is very injustice done for Low group employes grade pay in 6th cpc (GP 1800, 1900, 2000).One has to wait minimum 10 years to get Rs. 100 benefit by next GP KGM Pillai

    Sir, by not granting pay to promotee at par with Direct recruited is creating humuliating situationa amoung the staff. this must be solved to eradicate such discriminational situation.
    Furthermore, the O.M regarding change of option upto 31.12.2010 has not been highlighted well and some offices also not circulated this o.m and some of officials like me has not been given opportunity to revise the option. the validity date of this O.M should be extended further else it may be faciliated that any govt. servant can change the option for fixation pertaining to the period between 01/2006 to 08/2008 at any time if beneficial to them.

    Stenographers cadre of ordnance factories needs to be upgraded at par with Central Sectt.Steno Services. It is also learnt that there is a proposal to upgrade Private Secretaries to Group A scale as done for similarly placed cadres like Hindi Officer,Matron etc. It is high time that P.S.should be upgraded to Group A and given 6600 fixation also. Also payscales of PA/Steno need to be upgraded. Please look into these urgently. I also request anomaly committe to maintain parity with CSSS and give all others equal pay and promotional avenues.

It was very worst decision to grant such a low grade pay to LDC/UDC. LDC/UDC posts are key position in the hierarchy. However, VI Pay Commission neglected the interest of LDC and UDC and granted such a low GP of Rs.1900 and 2400 to them in caparison to GP granted at PB-3 and PB-4.

    I also agree with dayal singh’s below statement. In every anomoly committee meeting held and nobody raising LDC, UDC issues. I hope this the right time and committee will recommend and resolve LDC & UDC issues.

    SuB: Anomalies arises in Hierarchy of Central Government …..Employees after implementation VIth pay Commission & MACP …..reg.
    After going through almost all the queries, analysis on this subject over the few years on this matter of anomaly in junior drawing more grade pay than seniors and Gazetted officers drawing less grade pay than their subordinates, In touring departments it is more grave because a non-gazetted officer can travel by Air if he have GP of Rs.5400/- while A gazetted office who supervise them travel in lower because he got only Rs. 4800/- as GP these are all a grave demoralising thing in every office . More over the GP 5400 holder can lodge for Rs. 1500/(Now 1800+) daily rent his supervising gazetted officer can do with only Rs. 500(Now Rs.625). In order to set right these thing Please consider this formula:

    I.All Gazetted officers having a total service of 20 or Years( Both B&C cadre) grant them GP of Rs. 5400-

    II.All Gazetted officers having a total service of 25 years and more (Both in C&B cadre) Grant them GP of Rs.6100 and

    III.All Gazetted officers having a total service of 30 or more years of service (Both in C&D cadre) grant then GP of Rs.6600/-

    More over All the Central Government employees organizations should fight to bring a new slab in tour entitlements ofr those having GP of Rs. 4600& GP.4800 in rent element from Rs. 500 to Rs.1000/- immediately

    I hope this will do away with almost 98% anomalies now debating and for this government will have an expense of nearly Rs.200 crore only means negligible one when compared with the size of our Budget.
